The certification, mandated by Section 1352 of Title 31, U.S. Code (The Byrd Anti-Lobbying Amendment), establishes compliance requirements for the Small Food Equipment procurement. The document serves as a prerequisite for contract award and certifies that no federal appropriated funds have been or will be used to influence government officials, members of Congress, or FCS board members and employees in connection with the federal contract award, grant, loan, or cooperative agreement.
The certification imposes material obligations on the submitting organization and its sub-recipients. Any person failing to file the required certification is subject to civil penalties ranging from $10,000 to $100,000 per violation. Organizations must disclose any non-federal funds used for lobbying purposes on Standard Form-LLL and must include identical certification language in all covered sub-awards exceeding $100,000 in federal funds, requiring compliance throughout the contracting tier structure. The undersigned official attests to these certifications and assumes responsibility for ensuring sub-recipient compliance.
