About this file
This is a Non-Collusion Affidavit document required for the Cherryville Road Sidewalk Extension project (Contract No. 999111905) administered by Allen Township, Northampton County, Pennsylvania. The affidavit must be executed by an authorized representative of the bidding contractor and notarized. Questions regarding the project will be accepted until 10:00 A.M. local time on Tuesday, October 27, 2026, with sealed bids due online via PennBid by 10:00 A.M. local time on Tuesday, November 3, 2026. Bid opening and public viewing will occur on PennBid at 10:00 A.M. on the same date. No prebid meeting will be held for this project. The successful bidder must provide satisfactory Performance and Payment Bonds equal to 100 percent of the contract amount and a Maintenance Bond equal to ten percent of the contract amount, with each bid accompanied by a bid bond or certified check for not less than ten percent of the bid amount.
The affidavit certifies that the bidder has not engaged in collusion, conspiracy, or any restraint of free competitive bidding regarding this project and that all proposal statements are true and correct. Bidders must warrant that no agents or selling agencies have been retained on commission or contingent fee arrangements except bona fide employees or established commercial agencies. The affidavit also requires disclosure of any conviction or liability for acts involving conspiracy or collusion in connection with public contract bidding within the preceding three years, though such history does not automatically prohibit bid acceptance but may result in administrative suspension or debarment at the discretion of Allen Township. The work shall be compensated in accordance with the Pennsylvania Prevailing Wage Act (Act No. 442).
