About this file
This document is Addendum 1 to RFQ 2025-002 for Delinquent Tax Collection Services issued by the City of Burleson, Texas. The RFQ seeks qualifications from companies to provide delinquent ad valorem tax collection services, including penalties and interest as authorized by the Texas Tax Code. A virtual pre-submittal meeting is scheduled for August 27, 2025 at 11:00 AM via Microsoft Teams, and the City clarifies that this is a qualifications-based solicitation rather than a pricing proposal. Selected consultants must maintain specific insurance coverage including $1,000,000 Commercial General Liability, $1,000,000 Automobile Liability, statutory Workers' Compensation limits, and $1,000,000 Professional Liability coverage, with certificates naming the City as additional insured.
The City currently operates under a contract that began November 1, 1989, paying the incumbent vendor fifteen percent of all delinquent taxes, penalties, and interest actually collected, including collections through bankruptcy proceedings. The current contract has no extension options and terminates upon mutual agreement or thirty days written notice by either party, with the vendor having an additional six months to reduce pending tax suits to judgment. The accounts will be primary placements, though some may have initially been serviced by the current vendor. The City uses Tyler Munis ERP as its case management system and Tyler Payments for electronic payment processing. No bid bonds or performance bonds are required for this qualifications phase, and submissions containing pricing information will be disqualified.

ADDENDUM 1:
RFQ 2025-002 Delinquent Tax Collection Services
Any interpretations, corrections or changes to this RFP and Specifications will be made by addendum, unless otherwise stated. Submitting companies shall return and acknowledge receipt of all addenda when replying to this bid.
1) Can you please provide the insurance bidders must have?
Per the City’s standard agreement, the selected consultant must provide insurance with the following minimum coverage: Commercial General Liability – $1,000,000 each occurrence and aggregate;
Automobile Liability – $1,000,000 combined single limit; Workers’ Compensation – statutory limits and $100,000/$500,000/$100,000 employer’s liability; and Professional Liability (Errors &
Omissions) – $1,000,000 per claim and aggregate. Certificates of insurance must name the City as additional insured and be in place prior to commencement of work.
2) Has the current contract gone full term?
No. The City is under contract with a current vendor.
3) Have all options to extend the current contract been exercised?
There are no options to extend the current vendor contract. The current vendor contract ends when the City and the current vendor mutually agree or either party gives thirty days written notice of termination, provided the current vendor will have an additional six months to reduce to judgment all tax suits filed after the date of termination.
4) Who is the incumbent, and how long has the incumbent been providing the requested services?
The current contract commenced on November 1, 1989.
5) To what extent will the location of the bidder’s proposed location or headquarters have a bearing on any award?
Only to the extent the bidder’s location impacts their ability to perform the services solicited and to the extent Chapter 2252, Texas Government Code, may be applicable.
6) How are fees currently being billed by any incumbent(s), by category, and at what rates?
The City pays the current vendor fifteen percent of all delinquent taxes, penalty and interest as authorized by Section 33.01 of the Texas Tax Code, which are actually collected and paid to the
City’s tax collector, or in the case of real property, collected and paid as the result of forced sale. The
City also pays the current vendor fifteen percent of taxes actually collected and paid to the City’s tax collector via bankruptcy.
7) Can you please provide a greater description of the specific kind of receivables to be placed for collection?
Delinquent ad valorem taxes, penalties, and interest as authorized by the Texas Tax Code.

8) Will accounts be primary placements, not having been serviced by any other outside collection agency, and/or will you also be referring secondary placements? If so, should bidders provide proposed fees for secondary placements also?
The accounts will be primary placements, though initially certain accounts may have been serviced by the current vendor.
9) Have all cases been fully adjudicated by the time of placement?
No. The current vendor contract ends when the City and the current vendor mutually agree or either party gives thirty days written notice of termination, provided the current vendor will have an additional six months to reduce to judgment all tax suits filed after the date of termination.

13) If there was a previous solicitation for these services, what was its title, number, release date, and due date?
There has not been a previous solicitation for these services.
14) Why has this bid been released at this time?
The City has issued the solicitation now to competitively evaluate the market and confirm we are receiving the best collection service available.
15) Can you please provide greater details regarding your bid bond and/or performance bond requirements related to this contract? For example, what is required with the proposal, and what is required to comply during the term of the contract?
This is an RFQ, and the City is seeking qualifications rather than pricing or contract terms at this stage. No bid bond or performance bond is required to submit qualifications.
16) Are bidders permitted to deviate in any way from any manner of quoting fees you may be expecting?
For example, if there is a pricing page in the RFP, can bidders submit an alternate fee structure? If there is no pricing page in the RFP, do you have any preference for how bidders should quote fees or can bidders create their own pricing categories?
This is an RFQ, and the City is seeking qualifications rather than detailed pricing proposals. As indicated in
Section 3B, pricing should not be included with submissions. Submissions containing price information will be disqualified.
