Memo to File Justification for Other than Full and Open Competition
5PA0312
Social Security Administration
Easton, PA
1. Nature and/or description of the action being approved.
This project is to complete an eight (8) month extension from May 13, 2015 through December 31, 2015 for the Social Security Administration lease, LPA03361 which expires May 12, 2015. The lease is for 10,072 RSF (8911 ABOA SF) of office space located in Easton, PA. The extension will be executed via Lease Amendment.
2. Description of the supplies or services required to meet the agency’s needs (including estimated value).
The SSA currently occupies 10,072 RSF (8911 ABOA SF) of office space at 134 North 4th Street in Easton, PA; where they are the sole tenant. Their current lease LPA03361 expires May 12, 2015. A sole source procurement is underway to complete a succeeding lease with the current lessor but will not be completed by the expiration of the current lease. As such, an extension is needed for the succeeding lease to be completed. No improvement work will be required as part of the extension. The current rental rate is which includes TI. The TI will be paid in full at the end of the current term. It is anticipated that the lease will be extended at the current rental rate (shell and operating only).
3. Identification of the statutory authority 41 U.S.C. 3304(a)(1). Only one responsible source and no other supplies or services will satisfy agency requirements.
4. Demonstration that the proposed contractor’s unique qualifications or nature of the acquisition requires use of the authority cited.
In accordance with 41 U.S.C. 3304(a)(1), the agency’s minimum needs can only be satisfied by unique supplies or services available from only one responsible source and no other type of property or services will satisfy the needs of the agency. It would be economically infeasible to relocate for a short time frame. A sole source action has already commenced to award a succeeding lease at the current location. An extension of the lease is the only logical action to maintain continuity of occupancy.
5. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

8. Other facts supporting the use of other than full and open competition
The field office has confirmed that the lessor is great to work with and very responsive to any issues.
The SSA completed the Tenant Satisfaction Survey in 2011 with an 82% overall satisfaction rating.
The lessor has expressed his interest in retaining the SSA as a tenant.
9. List of any sources that expressed in writing an interest in the acquisition
No expressions of interested were received.
10. Statement of actions the agency may take to remove or overcome any barriers to competition
If applicable, full and open competition will be utilized in future acquisitions.
