4. Authority:

Order IAW PL 109-461: PL 109-461 requires the Department of Veterans Affairs to increase contracting and subcontracting opportunities for Service-Disabled Veteran-Owned Small Businesses and Veteran-Owned Small Businesses (VAAR 819.7007).

5. Describe why you believe the order represents the Best Value consistent with FAR 8.404(d) to aid the Contracting Officer (CO) in making this Best Value Determination:

IAW FAR 8.404(d), supplies offered on the schedule are listed at fixed prices. Services offered on the schedule are priced either at hourly rates, or at a fixed price for performance of a specific task (e.g.,installation, maintenance, and repair). GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, saving administrative time and monies for use in other efforts of acquisition, ultimately leading to greater Veteran care. However, the CO intends to request a price reduction before placing an order IAW FAR 8.405-4.

IAW FAR 8.402(f), “For administrative convenience, an ordering activity contracting officer may add items not on the Federal Supply Schedule (also referred to as open market items) to a Federal Supply Schedule blanket purchase agreement (BPA) or an individual task or delivery order” only if “(1) All applicable acquisition regulations pertaining to the purchase of the items not on the Federal Supply Schedule have been followed (e.g., … contracting methods (parts 13…)…).” IAW FAR 13.106- 3(a)(2), prices will be determined to be fair and reasonable by “(ii) Comparison of the proposed price with prices found reasonable on previous purchases” and “(vii) Any other reasonable basis” for open market items.

6. Describe the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted:

The CO conducted a search on the VIP VetBiz database for the keyword, “Vocera” to determine if there are any Veteran-Owned Small Businesses (VOSBs) or Service-Disabled Veteran-Owned Small Businesses that can fulfill the requirement. Zero results were returned.

The CO conducted a search on the GSA Advantage! catalog. Most of the items requested by the facility are on GSA contract, number GS-35F-0858N with Government Marketing & Procurement, LLC, a VIP-verified SDVOSB (see explanation of open market items in number 5, above). As previously described, ordering from a single source already on schedule provides the Best Value for the Government.

Public Law 109-461 requires the Department of Veterans Affairs to increase contracting and subcontracting opportunities for Service-Disabled Veteran-Owned Small Businesses and Veteran- Owned Small Businesses. IAW VAAR 819.7007(a), “A contracting officer may award a contract to a verified SDVOSB concern using procedures other than competitive procedures…”; (b) “The contracting officer’s determination to make a sole source award is a business decision wholly within the discretion of the contracting officer”; (c) “A determination that only one SDVOSB can meet the requirement is not required.”

7. Any other facts supporting the justification: Vocera is the only known solution to provide Office of Information and Technology (OI&T) Technical Reference Model (TRM) approval in addition to Federal Information Processing Standards (FIPS) 140-2 certification and VA PIV card compatibility.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: None.

9. Requirements certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
