About this file

This is a Sole Source Justification document for contract 36C25225P0286 awarded to Azimuth Contracting, LLC for emergency boiler operator support staff at Edward Hines, Jr. VA Hospital in Hines, IL. The contract was awarded on February 20, 2025 for $204,890.40 to cover a 3-month base period from February 1, 2025 to April 30, 2025, with an option for an additional 3 months (May 1, 2025 - July 31, 2025).

The emergency interim contract was necessitated by a protest of contract 36C25225P0226 which was supposed to begin February 1, 2025. Azimuth Contracting, LLC, an SDVOSB and incumbent contractor under contract 36C25224P0480, was selected to continue providing qualified and licensed boiler operators to maintain 24/7 coverage of the facility's boilers. The justification cites unusual and compelling urgency, as the facility faced potential shutdown without qualified operators to monitor the boilers, which directly impacts patient health and safety. Upon resolution of the protest, if corrective action is required, the service will be re-solicited as an SDVOSB set-aside.

2. Nature and/or Description of the Action Being Processed: The Great Lakes Acquisition Center – VISN12 was informed of the urgent need for continuation of boiler operator support staff at the Hines VAH due to protest of award received for contract 36C25225P0226 for same service. Without qualified boiler operators, facility faced immenent shut down as the facility is currently short staffed and unable to cover ther 24/7 shifts as required. Notice to Proceed was issued by the Contracting Officer/Division Chief Scott Ivy on January 31, 2025. The NTP will cover a 3 month base period (February 1, 2025 – April 30, 2025) with an option of an additional 3 months (May 1, 2025 – July 31, 2025) should it be needed while the protest is investigated and resolved. Operation of the boilers is a necessity and directly impacts patient health and safety as the loss of boilers can cause death and shut down of the entire facility.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Qualified and licensed boiler operators are required for safe boiler operation. If not monitored around the clock, boilers can malfunction causing loss of heat or can explode causing loss of life. New contract (36C25225P0226) with effective date of 2/1/2025 was protested. Interim contract is needed to ensure that boilers are monitored for proper function while protest is investigated and resolved.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

( ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (X ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Contractor is SDVOSB and incumbent under contract expiring January 31, 2025 (36C25224P0480). Contractor was able to keep current qualified and licensed boiler operators in place at the facility ensuring there was no break in facility operations therefore avoinding a disruption in direct patient care.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: If corrective action under protest is warranted, requirement will be re-solicited on the open market as a SDVOBS set-aside.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Based on prices received for protested contract (36C25225P0226) Contracting Officer is able to determine that price is fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research performed for protested contract (36C25225P0226) supported a SDVOSB set-aside therefore contractor selected to provide emergency service is a SDVOSB who was currently performing the same service at the facility.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Service proceeded on an emergency basis due to protest of award of contract that was to be effective 2/1/2025. Vendor selected for interim contract was incumbent performing same service and was able to keep current boiler operators in place avoiding disruption of facility function and direct patient care.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None, emergency NTP issued to avoid facility shut-down.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Upon resolution of protest, and if corrective action is required, service will be solicited on the open market as a SDVOSB set-aside.
