About this file
This is a Sole-Source Determination Memo issued by the Oregon Department of Human Services Office of Contracts & Procurement on behalf of the Oregon Health Authority for the supply of food-grade CO2 tank products and associated delivery and pickup services. The procurement is designated for the Oregon State Hospital Junction City Campus Food Services department located at 29398 Recovery Way, Junction City, OR 97448. The Agency seeks a vendor to supply 50-pound food-grade CO2 tanks, provide delivery and pickup services, perform tank refilling and maintenance, and deliver emergency orders within 24 hours. Specifications require that tanks be aluminum or steel construction, arrive ready to use at full capacity, and comply with NFPA standards and OSHA, EPA, and FDA guidelines. The vendor must also assign a dedicated contact representative for billing issues and customer service. Standard delivery and pickup will occur Monday through Friday during normal business hours from 6:00 a.m. to 5:00 p.m., excluding state holidays, with emergency deliveries required within 24 hours of notification. No specific response deadline or award date is provided in this determination memo, though protests are due within seven calendar days after the first posting notice on OregonBuys.
The estimated total contract value is $150,000.00. Airgas USA, LLC, located at 2446 NE Diamond Lake Boulevard, Roseburg, OR 97470, has been identified as the sole prospective vendor meeting all requirements. The Agency's market research determined that Airgas USA, LLC is the only company willing to provide the complete service package, including both tank supply and delivery-pickup services. This determination was reached after two separate Request for Quote postings on OregonBuys yielded no responses, and direct outreach to other suppliers including Messer, Inc., Walmart, Tractor Supply, B&I Hardware and Rental revealed that these vendors either do not provide food-grade CO2 tanks or lack delivery and pickup service capabilities. The sole-source justification is supported under ORS 279B.075(2)(a), which permits procurement from a single source when efficient utilization of existing goods requires compatible goods or services available from only one source. Protests must be submitted to Victoria Crosby, Contract Specialist, at Victoria.a.crosby@odhsoha.oregon.gov via OregonBuys or email within the protest period.

A few companies that could provide the Tanks (Walmart, Tractor Supply, B&I Hardware and Rental) in the area, but their services did not include delivery and pick-up services, or they did not provide Food Grade Co2 Tanks. Due to posting the bid solicitation twice in OregonBuys, without any bids received, as well as contacting companies and being informed that delivery/pick-up services are not an available service through these vendors, it was determined that Airgas USA LLC is the only company that is willing to provide all required services at this time.
