Justification and Approval (J&A) for Other Than Full and Open Competition
FOR OFFICIAL USE ONLY
March 2018 FOR OFFICIAL USE ONLY Page 2 of 6
I. Contracting Activity.
Department of the Air Force, Air Combat Command, 55th Contracting Squadron (55 CONS), Offutt AFB NE, is the contracting agency responsible for the proposed contract action which necessitates this justification for other than full and open competition. United States Strategic Command (USSTRATCOM), Offutt AFB, NE is the organizational activity responsible.
II. Nature and/or description of the action being processed.
This is an amended Justification and Approval (J&A) IAW AFFARS 5306.304(e).
This J&A authorizes the use of other than full and open competition procedures for the Department of Defense (DoD).
The contractor is SciTec (CAGE code 2S031), which is a Small Business under NAICS code 541512 - Computer Systems Design Services.
This contract will be a new, sole source C-Type contract utilizing the Cost-Plus Fixed Fee (CPFF) structure due to the fact that it is an RDT&E effort with relatively high risk to the contractor.
III. Description of supplies/services required to meet agency needs.
This acquisition will integrate into a broader research effort by the to develop and maintain data management, data integration and fusion, and situational awareness frameworks for the Intel Community. This J&A will allow data and systems relevant to USSTRATCOM missions to potentially support across multiple Government domains at multiple classification levels. This requirement as part of the overall Global Data Integration (GDI) has been approved and budgeted across the Future Year Defense Program. GDI identifies and leverages current operational data dissemination capabilities and develops an interoperable format standard. It seeks to expose and expand data dissemination across multiple classifications and operational environments. No other J&A has been denied for this contract.
Anticipated Period of Performance:
Base Period: 1 July 2020 - 30 Jun 2021 Option 1: 1 July 2021 - 30 Sep 2021 Option 2: 1 Oct 2021 - 31 Dec 2021 Option 3: 1 Jan 2022 - 31 Mar 2022 Option 4: 1 Apr 2022 - 30 Jun 2022
This is an amended J&A IAW AFFARS 5306.304(e). The original J&A was approved by AFICC/KC on 16 Jun 20 for an estimated contract cost of $2,438,184.90. The original estimated contract cost was based upon an Independent Government Cost Estimate (IGCE) received from the customer. The IGCE was built using initial research accomplished during the first year
There was a cost increase between the IGCE and proposed price.
The proposal was found to be technically acceptable and the price fair and reasonable through cost analysis IAW FAR Subpart 15.4.
This will be a new $2,848,813.76 Cost Plus Fixed Fee (CPFF) contract with 2 year period of performance, funded by RDTE (3600) funds. This contract provides the Requiring Activity time to prepare and award a contract via full and open competition. The contract will include travel, labor, and data not separately priced. No Contractor Acquired Property is anticipated.

Award to any other source would result in unacceptable delays in fulfilling the Air Force's requirements. SciTec has and accredited facilities and existing MOAs in place for use of their facilities. Delays of one year can be anticipated in order for a new vendor to develop these MOAs, process contractor personnel clearances, and to obtain the required facility clearances. Anticipated delays of approximately 90 days, within that same year, include validation of all new hardware and software, even if previously developed H/W and S/W are utilized, since H/W would need to be moved or new H/W purchased and operators would need to become proficient in the S/W programming and prove their proficiency and interoperability to the Government. These delays are on top of the anticipated 12 months required to competitively award a new contract. Consequences of 24 months total delay in the effort are that USSTRATCOM and our USG partners will continue to operate in an unnecessarily cumbersome environment with slower response times than we could achieve by continuing this project and unnecessary latency in delivery of data of interest and unnecessary latency in subsequent response. This will in turn drive unneccessarily increased costs and schedule delays within other projects that will rely on the FEAST Software. To maintain military SIGINT superiority, DoD must continue to pursue excellence in synergies and synchornizations. Additionally, a 2 year delay in this project would put it out of sync with the budget, which in turn could result in further delays.
Subsection 3
Accordingly, SciTec, Inc. is the only firm capable of providing the services described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirements.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A Sources Sought Announcement was posted in Feb 2020. The Sources Sought requested the submission of packages to determine the capabilities of potential offerors and ability support this requirement.
SciTec has Memorandums of Agreement with multiple agencies that are coordinating on this project, as well as site access to r; all of which are critical to successfully fulfilling this requirement by the 30 September 2020 need date. Sources Sought responders other than SciTec do not already have these agreements in place.
Due to the 30 September 2020 need date, SciTec is the only capable vendor.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer will ensure that the negotiated price is fair and reasonable to the Government based on price analysis and cost analysis. The proposed rates and hours will be analyzed and compared to rates and hours on the similar contracts and the Government estimate of hours. Cost analysis shall be used to evaluate the reasonableness of
March 2018 FOR OFFICIAL USE ONLY Page 5 of 6 individual cost elements. The following steps will be taken to ensure the final contract price is fair and reasonable: (1) Obtaining a DCAA audit of the Contractor's proposed costs, if necessary, (2) Getting a technical evaluation from the technical team familiar with the past and current effort and qualified to make recommendation that evaluates the proposed labor hours for reasonableness, (3) Using the Weighted Guidelines (WGL) tool to determine the appropriate profit/fee, and (4) In accordance with the Truth in Negotiations Act (TINA) and FAR 15.403-4, upon conclusion of negotiations, the Contracting Officer will obtain a Certificate of Current Cost or Pricing Data from the Contractor.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
As described in Section VI above, market research in accordance with FAR Part 10 was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
A Sources Sought Announcement was posted to Contracting Opportunities from 27 February 2020 to 19 March 2020.
Ten vendors responded, but only seven responded to the Sources Sought Notice with a capabilities package. The technical team evaluated each response based upon its ability to meet the salient characteristics stated in the Sources Sought Notice.
However, SciTec has Memorandums of Agreement with multiple agencies that are coordinating on this project, as well as site access to , all of which are critical to successfully fulfilling this requirement. Sources Sought responders other than SciTec do not already have these agreements in place.
they would not be able to get the agreements in place to perform by the 30 September 2020 need date. Therefore, SciTec is the only capable vendor.
SciTec and are both small businesses under the NAICS code, while is a large business.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
The current contract with SciTec ends 30 Sep 2020. In order to avoid a gap in support, this sole source effort will provide a contract to mature the requirement to support full and open competition in the future. At that time, the Government will be able to determine the ability, cost, and time involved in other vendors obtaining access MOAs similar to SciTec's accesses/agreements.
X. List of any sources that expressed, in writing, an interest in the acquisition.
See Section VI above.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
This contract will allow the time necessary for competition of subsequent acquisitions. A follow-on competitive acquisition is planned with a projected award date in FY22. This contract will ensure the proper data rights are in place to support a follow-on competitive award. Additionally, USSTRATCOM is pursuing its own memorandums of agreement supporting multiple agency collaboration for global data integration that future contractors potentially could leverage -- at a minimum, USSTRATCOM will be in a better position to advise and support new contractors joining the collaborative efforts, once it has gone through the process itself. USSTRATCOM is exploring the possibility of obtaining the required servers where the data resides, which will alleviate some, potentially all, of the need for
March 2018 FOR OFFICIAL USE ONLY Page 6 of 6 future contractors to have their own servers, which would expand the competitive environment significantly.
The future requirement for the competitive process is anticipated to be more refined, as currently it is only one year into a basic R&D effort. The maturation of the research will better support a competitive process as it moves from basic research toward sustainment. USSTRATCOM is also analyzing the 'right mix' of Government versus contractor sustainment support in the out-years. A 2-year PoP for this contract will allow time to further vet what is required, prioritize requirements and funding, and discover the successes and failures of the current R&D effort.
