About this file
This is a Justification and Approval for Exception to Fair Opportunity Memo from the Department of Veterans Affairs for a sole-source task order against an Indefinite Delivery Contract.
The contracting activity is the Columbia Veterans Administration Medical Center (VAMC) located at 6439 Garners Ferry Road, Columbia, SC 29209, under Purchase Request 544-26-3-4046-0011 and Acquisition Plan Action ID 36C247-26-AP-1592. The proposed action is a one-year firm-fixed-price (FFP) task order for mail and package delivery services by United Parcel Service (UPS) against Indefinite Delivery Contract HTC71123Dc025, with an estimated value of $796,600.00 and a performance period from April 1, 2026, through March 31, 2027. The justification for sole-source authority is based on Section 41 U.S.C. 4106(c) and FAR 16.505(b)(2)(i)(E), citing the Veterans First Contracting Program under 38 U.S.C. 8127(c), which permits direct contracting with a Service-Disabled Veteran-Owned Small Business (SDVOSB) or Veteran-Owned Small Business (VOSB). The rationale is that the required mail automation service must be compatible with the existing Script-Pro and WorldShip software systems already installed at the facility, and UPS has these systems operational, whereas Federal Express would require new database installation and staff training, causing unnecessary service delays. Market research confirmed that both FedEx and UPS hold National mandatory contracts (NGDS), but only UPS meets the existing system requirements. The justification was approved by Joseph E. Horn, Contracting Officer (RPO-E NCO-7), and certified by Sara Simmons, Inventory Management Specialist Supervisor at Dublin VAMC, with one-level-above approval from Michael Tempero, Branch Chief (RPO-E NCO-7). The action will be synopsized at award on the Federal Business Opportunities Page (FBO) with the justification made publicly available.

Attachment 1: Request for Exception to Fair Opportunity Memo Format
Effective Date: 12/30/2025 Page 2 of 3 Revision: 03 Acquisition ID#:
Service-Disabled Veteran-Owned Small Business (SDVOSB) or a Veteran-Owned Small Business
(VOSB).
5. Rationale Supporting Use of Authority Cited Above: The Service must be compatible with existing mail automation system, Script-Pro, and WorldShip Software.
6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government’s requirements. There is no competition anticipated for this acquisition. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available.
7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be completed.
8. Market Research: Both Federal Express (FEDEX) and United Parcel Service (UPS) hold National mandatory contracts (NGDS). However, FedEx would not be able to meet requirement needs for the facility listed because of the need to install new shipping database and system at facility and train facility staff on system. UPS Script-Pro and WorldShip software is already installed and utilized at facility.
Implantation of new system would cause unnecessary delays of service.
9. Other Facts: N/A
10. Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.
Sara Simmons Inventory Management Specialist Supervisor Dublin VAMC
