About this file

This document is a Sole-Source Determination Memo from the Oregon Health Authority (OHA) regarding the purchase of a Radionuclide Identification Detector (RIID) with a mobile device and supporting software for remote detection using a drone. The OHA's Radiation Protection Services (RPS) and Health, Security, Preparedness, and Response (HSPR) programs require this equipment to respond to various emergency response efforts, including transportation accidents, nuclear power plant accidents, and identifying radioactive materials. After conducting market research, the OHA determined that the SPIR-Ace detector made by Mirion Technologies is the only product that meets their requirements for being lightweight and powerful enough to detect radioisotopes from a distance. The estimated total contract value is $33,710.

The OHA is purchasing this equipment under its sole-source authority, as Mirion Technologies is the sole manufacturer of the SPIR-Ace detector with the necessary features. The contract will allow the OHA to purchase additional goods and services, including on-call maintenance, preventative maintenance, repair, and training (unless available on a DAS price agreement), up to $150,000 or 10 years, whichever comes first. Protests are due by 3:00 PM within seven calendar days after the first date the notice is posted on Oregon Buys.

SOLE-SOURCE DETERMINATION MEMO

FOR SUPPLIES AND SERVICES

Date: 6/16/2022 Sole source number: 44300-00003472

To: Kirk N. Rhoades, Designated Procurement Officer DHS Office of Contracts & Procurement

Requestor: Hillary Haskins Agency/division: OHA – Public Health, herein after referred to as “Agency” Program/office: Center for Health Protection - Radiation Protection Services Contract specialist: Andria Otjen

Agency Sole source rule: Sole source authority:

OHA OAR 137-047-0275 ORS 413.033

Estimated total contract value: $33,710.00

Description of goods or services: Radionuclide Identification Detector with mobile device and supporting software.

1. Background: This sole source justification applies to the purchase of:

a) This will be a purchase of a Radionuclide Identification Detector (RIID) with mobile device and supporting software for remote detection using a drone.

b) Radiation Protection Services (RPS) in partnership with Health, Security, Preparedness, and Response (HSPR) have a drone program to respond various emergency response efforts. Drones can be equipped with visual and thermal imaging cameras which can search debris for survivors, assess structural damage, and map disaster areas while keeping the operator at a safe distance. In the case of a chemical or radiation event, distance is especially important for operator safety. Radiation Protection Services will use the drone with a Radioisotope Identification Device for various radiation incidents including transportation accidents, nuclear power plant accidents, and identifying radioactive materials at waste facilities.

c) There are many RIIDs available however they are either too heavy to be lifted by a drone or not powerful enough to detect radionuclides from a distance. After performing market research, the SPIR-Ace was identified as being both lightweight and powerful enough to detect radioisotopes quickly. The mobile device can send back real time data to the supporting software, RadResponder that is used for emergency response data sharing.

Once the drone has returned, the data can be further analyzed to quantify activity and estimate potential harm to people and the environment.

d) Mirion Technologies is the only maker of the SPIR-Ace detector that has all the options RPS needs.

Mirion SPIR-Ace • Easily detachable

• Weight: 1450 grams

• Can be used in other applications such as lab work

Agency reserves the right to purchase additional goods, services to include on-call maintenance, preventative maintenance, repair and training (unless available on DAS price agreement), up to $150,000 or 10 years whichever comes first.

3. Written findings of fact (market research):

The findings below must include factual information supporting the determination that meet the sole source requirement in statute.

Pursuant to ORS 279B.075, Agency must conduct market research that supports the assertion that there is only one source that can provide the goods or services. Market research includes utilization of the internet, trade journals, agency vendor lists, professional organizations, studies, catalogs/industrial periodicals, vendor sources, yellow pages, etc.

For information technology contracts, any ownership or proprietary issues should be fully addressed with written documentation to support facts.

Agency must select at least one of the findings and prepare the determination as it specifically relates to the good or service being procured. More than one finding can be addressed. The findings are as follows:

Pursuant to ORS 279B.075 (2)(a): Provide findings supporting the determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source. RadResponder software used by SPIR-Ace detector is currently being used by Radiation Protection Services as a part of the Radiation Protection Services program.

or Pursuant to ORS 279B.075 (2)(b): Provide findings supporting the determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source. [Enter supporting documentation] or Pursuant to ORS 279B.075 (2)(c): Provide findings supporting the determination that the goods or services are for use in a pilot or an experimental project. [Enter supporting documentation] or Pursuant to ORS 279B.075 (2)(d): Any other findings that support the conclusion that the goods or services are available from only one source. Mirion Technologies is the only maker of the SPIR-Ace detector that has all the options RPS needs to conduct remote radiation detection using a drone.
