About this file
This document is a Sole-Source Determination Memo for the Oregon Health Authority (OHA) - Oregon State Hospital (OSH) to purchase Collaborative Problem Solving (CPS) Tier 2 Training services from the Massachusetts General Physicians Organization Inc. (MGPO), acting in support of The General Hospital Corporation, d/b/a, The Massachusetts General Hospital (MGH).
The memo states that OSH intends to provide its employees with four annual CPS Tier 2 trainings from 2021 through 2026, with a total estimated contract value of $360,000. Depending on the contractor's performance and training needs, OHA reserves the option to amend the sole source contract for additional time (through July 2030) and funding (up to $600,000 total). The CPS model is essential for OSH to address behavioral emergencies and reduce the use of seclusion and restraint, and MGH is the only known provider of this specialized training.

Description of goods or services: Collaborative Problem Solving (CPS) Tier 2 Training
1. Background: This sole source justification applies to the purchase of:
The Oregon Health Authority (OHA) - Oregon State Hospital (OSH), through its Collaborative Problem Solving Department, is preparing to purchase training services from the Massachusetts General Physicians Organization Inc. (MGPO), acting in support of The General Hospital Corporation, d/b/a, The Massachusetts General Hospital (MGH). The training services pertain to the Collaborative Problem Solving® (CPS) program. It is OSH’s intention to continue to enhance the provision of CPS training to staff as the clinical coordinating approach that both serves as a therapeutic intervention in its own right and as a framework within which to embed the application of other clinical therapeutic interventions from the perspective of direct care staff.
CPS is a model of intervention supported by evidence. The CPS model leads to therapeutic engagement between staff and persons served and reduces the use of seclusion and restraint (see literature in the references at the end). In short, CPS can be described as a technique based on the premise “people do well if they can” (postulating that the lack of skills is at the root of most confrontations). “Plan A” (“do it my way”), “Plan B” (“let’s collaborate”) and “Plan C” (“let’s let it drop”) are separated as negotiation tracks. The technique then focuses on teaching/practicing problem-solving skills reliably by using “Plan B.”
Specifically, OHA-OSH intends to provide OSH employees with four annual CPS Tier 2 trainings beginning in 2021 through 2026. Accordingly, OSH will schedule and administer four CPS Tier 2 trainings in 2021, 2022, 2023, 2024, 2025 and 2026 respectively.
Based on the information contained in this revised sole source memorandum and pursuant to ORS 279B.075 it is determined that the services required for this procurement are only available from one source.

Cost and Term:
OHA intends to establish the new five-year Contract (#171219) with an initial maximum total not-to-exceed compensation limit of $360,000. Depending on the Contractor’s satisfactory performance, available funding and training needs, OHA reserves the option to amend the sole source contract for additional time (through July 2030) and additional funding (total NTE $600,000).
3. Written findings of fact (market research):
Based on the information contained in this sole source memorandum and pursuant to ORS 279B.075, it is determined that the services required for this procurement are only available from one source.
The findings are as follows:
|X| Pursuant to ORS 279B.075 (2)(a): Provide findings supporting the determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
CPS is structurally designed to help OSH address the high prevalence of behavioral emergencies and potentially attendant restrictive responses, such as seclusion and restraint. Numerous incident analyses show room for improved collaboration between staff and patients at OSH, rather than using a “limit setting” model to terminate behavioral emergencies as they arise.
OSH is seeking Sole Source procurement because no other options exist to purchase the needed service. MGH, the proposed contractor, is the only known “manufacturer” of the CPS model. “Think: Kids” is a program in the Department of Psychiatry at the Massachusetts General Hospital, which has its roots in what was originally known as The Collaborative Problem Solving (CPS) Institute. The CPS Institute was established in 2002 under the direction of Dr. Ross Green and Dr. Stuart Ablon. The CPS Institute sought to disseminate the CPS approach to understanding and helping challenging children and adolescents that was described originally by Dr. Greene in his book, The Explosive Child, and subsequently further developed and described for clinical populations in the book Dr. Green and Dr. Ablon co-authored entitled, Treating Explosive Kids: The Collaborative Problem Solving Approach. The CPS approach has since also been described in numerous journal articles and book chapters.
In 2008, the CPS Institute was dissolved and the Department of Psychiatry at MGH created a new program, Think: Kids, with Dr. Ablon as its Director. Think: Kids continues to develop the Collaborative Problem-Solving approach to help families and to teach clinicians, educators and facilities around the world.
CPS is a model that has been pursued by AMH within the OHA.
Note. “Collaborative Problem Solving” as used refers to the model a federal judge has ruled to be the trademarks for “Collaborative Problem Solving” and “Collaborative Problem Solving Approach” and that they belong to the Massachusetts General Hospital (MGH).
and |X| Pursuant to ORS 279B.075 (2)(c): Provide findings supporting the determination that the goods or services are for use in a pilot or an experimental project.
The CPS model was introduced in and has an evidence base for use with children and adolescents. Use in adults is increasing across the country, locally and within OSH. Moreover, the continued use in a forensic psychiatric inpatient setting must be considered a pilot application.
