About this file

The document is an Addendum to a Commercial Products and Commercial Services solicitation (52.212-2) for Railway Safety Training issued by the Department of the Navy Naval Sea Systems Command. The solicitation will be awarded using a Lowest Price Technically Acceptable (LPTA) source selection method, where technical acceptability will be determined by reviewing technical capability documents such as Technical Capabilities Statement, Rigging Sketches, Vendor Certification, and Technical Data Sheets.

Vendors must submit a comprehensive quote that includes all required documentation by the specified date and time. The evaluation will first rank quotes from lowest to highest price, then review the lowest-priced quote for technical acceptability. If found acceptable, that quote will be awarded the contract. Pricing terms include a requirement for prices to be considered fair and reasonable, with quotes held firm for 60 days. The government reserves the right to disqualify quotes that do not meet all submission requirements, and may evaluate potential option prices as part of the overall proposal assessment.

Evaluation-Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Technical Capability

2. Price Technical acceptability will be determined by reviewing, as applicable, the Technical Capabilities Statement Attachment, Rigging Sketches, initialed Vendor Certification, Technical Data Sheet/Brochure, and any other items requested in the Statement of Work.

Price will be evaluated in accordance with FAR 13.106-3.

Technical Evaluation Ratings:

Rating Description Acceptable Quote/Proposal meets all identified requirements Unacceptable Quote/Proposal does NOT meet all identified requirement The Government will conduct a Lowest Price Technically Acceptable (LPTA) source selection. To determine LPTA, the Government will place all quotes in order of lowest total price to highest total price. Starting with the lowest total priced quote, the Government will review the non-price submission for acceptability. If the quote is found to be "Acceptable," no other quotes will be reviewed, and award will be made. However, if the quote is found to be "Unacceptable," the next lowest total priced quote will be considered. This process will continue until either a quote is considered "Acceptable" or until all quotes have been considered "Unacceptable."

The Vendor's proposed price will be evaluated based on price reasonableness. All prices must be considered fair and reasonable as determined by the Government. Price quote shall be held firm and valid for sixty (60) days.

The completion and submission of the above items will constitute a quote and will be considered the Vendor's unconditional assent to the terms and conditions of this solicitation and any attachments and/or exhibits.

Failure to provide all documents by the required date and time may preclude a quotation from award consideration at the discretion of the Government.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
