Pricing is required for a base year and two option years, including trip charges and hourly rates. Proposals are due by September 12, 2024, and the government intends to award without discussions. Questions are due by August 29, 2024. The solicitation incorporates FAR Part 12 and 13 provisions and clauses, and the awardee must have an active SAM registration with no exclusions.

52.212-1 INSTRUCTIONS TO OFFERORS FOR PROPOSAL SUBMITTAL, ADDENDUM

1. Basis for Award

The Offeror must provide service to all location for the maintenance and/or repair of the equipment listed on the “Exercise Equipment List and Location”. This is an “All or None” requirement. The evaluation for award is based on the “Lowest Price Technically Acceptable”. Request for Proposals will be rated either “Acceptable” or

“Unacceptable” in accordance with (IAW) the Technical Evaluation Criteria located at paragraph 5 below.

However, Past Performance will be evaluated to assist in determining the contractor’s responsibility in accordance with FAR 9.104-1 but will not be included as a sub-factor or rated. By submission of its offer, the

Offeror accedes to all solicitation requirements including terms and conditions herein. Failure to meet a requirement may result in an offer being determined unacceptable for award. The Offeror must clearly identify any exceptions to the solicitation terms and conditions with accompanying rationale. The evaluation shall proceed as follows:

2. Proposal Documentation

The following must be included in the Offeror’s proposal when submitted by the close date and time:

a) Acknowledgement of ALL Amendments to the Request For Proposal (RFP), if applicable.

b) Technical Proposal and Price Proposal is submitted IAW the Technical Evaluation Criteria (see paragraph 5). PRICE PROPOSAL SHALL BE SEPARATE FROM THE TECHNICAL

PROPOSAL.

3. Received Proposal Review

a) If the Offeror’s proposal is received by or before the due date and time, the proposal will be considered “Responsive”.

b) If the Offeror’s proposal is received late, past the due date and time, the proposal will be considered “Non-Responsive”.

4. Responsive Proposals

The Offerors’ company will be checked in the SAM.gov database.

a) Offeror’s SAM registration with an “Active” status, no “Exclusion”, and has a favorable “Determination of Responsibility” will be considered for a

“Technical Evaluation”.

b) If the Offeror’s registration shows “Inactive” or “Pending”, has “Exclusions”, or has an unfavorable “Determination of Responsibility” the proposal will not be considered for a technical evaluation nor award.

5. TECHNICAL ACCEPTABILITY:

The Government Technical Evaluation team shall evaluate the technical proposal at the factor level, assigning an

“Acceptable” or “Unacceptable” rating as defined below.

a) Acceptable – The proposal clearly meets the minimum requirements of the solicitation and Performance Work

Statement (PWS).

b) Unacceptable – The proposal does not clearly meet the minimum requirements of the solicitation and PWS.

6. PROPOSAL

There are two parts to the technical evaluation: Technical Proposal and Price Proposal. If the Offeror’s proposal is found to be responsive, the Technical Proposal will be evaluated first separately from the Price

Proposal; therefore, the Offeror is required to submit the Technical proposal in a separate document than the

Price Proposal.

a) TECHNICAL PROPOSAL: Offeror will respond to the following:

v. Will the Offeror provide removal and/or replacing repair services (ex: treadmill belts, cable, motherboards, etc.) on annual and/or as-needed basis based on the requesting agency?

vi. Will the Offeror provide calibrating maintenance services (ex: ellipticals, treadmills, rowers, etc.) on annual and/or as-needed basis based on the requesting agency?

7. PRICE PROPOSAL

The Government will evaluate the Offeror’s Price Proposal, to include all options, for price completeness and reasonableness as described below.

a) Completeness:

The Offeror’s Price Proposal will be evaluated for completeness by confirming the Offeror has provided pricing for each location. This is an “all or none” requirement and all locations must be serviced.

b) Price Evaluation:

The Offeror’s price will be evaluated for reasonableness through one or more of the methods specified in

FAR 13.106-3.

c) Options:

The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
