OFOC SOP Revision 10 Original Date: 03/22/11 Revision 10 Date: 09/10/2020

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A)

For

Other Than Full and Open Competition(<SAT)

1. Contracting Activity: Department of Veterans Affairs, VISN 07, Charlie Norwood VA

Medical Center (CNVAMC) 1 Freedom Way, Augusta GA, 30904.

2. Nature and/or Description of the Action Being Processed:

Critical Alert (Code Blue) Nurse Call System procurement to upgrade nurse call systems

(hardware and software) for new elevators on the CNVAMC Campuses.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

As part of a project to upgrade elevator systems, the Nurse Call systems for these elevators are required to be upgraded with the same capabilities of the current system. The proposed award is approximately $51,215.00.

4. Statutory Authority Permitting Other than Full and Open Competition:

(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency

Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability ofauthority):

The Charlie Norwood VAMC campuses already has key infrastructure in place to support the Critical Alert Nurse Call software-based systems. The current contract is through Signal

Technologies. The new elevators on both campuses requires the integration of the Critical

Alert software into the elevator code blue system. Signal Technologies also furnished the existing code blue system, which integrates with the Critical Alert Nurse Call system.

Providing a different Nurse call system will not allow for the integration as required by

CNVAMC.

6. Description of Efforts made to ensure that offers are solicited from as many potential sources as deemed practicable:

While there are other contractors in Vetbiz.gov, a determination that only one source is available to meet the requirement has been made.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:

OFOC SOP Revision 10 Original Date: 03/22/11 Revision 10 Date: 09/10/2020

Fair and reasonable cost will be based on FAR 15.404-1(b)(2)(v).

8. Description of the Market Research Conducted and the Results, or a Statement of the

Reasons Market Research Was Not Conducted:

• Review of previous proposals to upgrade the Nurse call (provided in December 2017).

• On-site walk through conducted between Electric shop and Signal Technologies in May 2019 and in January of 2020.

• Internal On-site walk through conducted to determine elevator nurse call systems needing replacement and upgrades (January 2020).

• Discussions between Electric Shop, Biomed, and potential contractor to determine upgrade requirements.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

Only one source, Signal Technologies who is an authorized reseller, installer, and technical service provider for the Critical Alert software-based nurse call systems on the CNVAMC campuses can provide the equipment, software, services, and maintenance required.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

See paragraph 6 above.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any

Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

All requirements, including the subject requirement, are thoroughly reviewed to ensure that competition is not unnecessarily restricted. This contracting action has no other sources of competition.

12. Requirements Certification:

I certify that the requirement outlined in this justification is a Bona Fide Need of the

Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
