About this file
This document contains a justification and approval for other than full and open competition and a related federal contract opportunity notice. The justification document requests approval for a sole-source architect and engineering contract with Miller-Remick, LLC to provide design refresh services for renovating and upgrading operating rooms at the Charlie Norwood VA Medical Center. The services are needed to update an existing design to comply with revised VA surgical standards. Miller-Remick designed the original project and has the necessary expertise and institutional knowledge to efficiently complete the redesign within the required 90-day timeframe. The related federal contract opportunity notice further specifies the $75,000 sole-source award to Miller-Remick on September 23, 2020 for NAICS code 541330 engineering services to complete the design refresh.

OFOC SOP Revision 09 Original Date: 03/22/11 Revision 05 Date: 04/17/2020
DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A)
For
Other Than Full and Open Competition
1. Contracting Activity: Department of Veterans Affairs, VISN 07, Charlie Norwood VA
Medical Center (WJBD VAMC) 1 Freedom Way, Augusta GA, 30904.
2. Nature and/or Description of the Action Being Processed:
This request is for other than full and open competition for approval of a firm fixed price
Architect & Engineering (AE) contract for Design Refresh..
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
This request is for Architect and Engineering (A/E) Services in support of project 509-14-
106, Renovate and Upgrade Operating Room, Phase 1. VA requires design review and update of above-mentioned project, for compliance with VA Surgical and Endovascular
Services, revision dated April 2020. Redesign is estimated to take 90 calendar days from receipt of notice to proceed. The Proposed award for approximately will be awarded to
Miller-Remick, LLC, a Service- Disabled Veteran Owned Small Business (SDVOSB).
4. Statutory Authority Permitting Other than Full and Open Competition:
(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency
Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1.
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the
Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
On September 29, 2015, VA awarded an A/E contract for Project 509-14-106, Renovate and
Upgrade Operating Rooms, Phase 1 to prepare design drawings documents as well as provide construction period services and site visits once the construction contract has been awarded based on the design. Prior to project solicitation, a new VA Surgical and Endovascular Manual was issued, requiring a design update to comply with the new standards.
Miller-Remick is the Architect of record and has the institutional knowledge and expertise to update the existing design for the Renovate and Upgrade Operating Rooms, Phase 1 project.
Soliciting another firm to review and interpret the design documents, when the Architect of record is available will not be cost effective to the government. Therefore, it would be cost prohibitive to have another company perform this requirement in a short period of time as costs would not be recovered through competition. Based on this information it is on the best interest of the government that this contract be awarded IAW FAR Part 6.302-1 in order to avoid duplication of costs.
6. Description of Efforts Made to ensure that offers are solicited from as many potential
OFOC SOP Revision 09 Original Date: 03/22/11 Revision 05 Date: 04/17/2020 sources as deemed practicable:
While there are other contractors in Vetbiz.gov, A determination that only one SDVOSB concern is available to meet the requirement has been made.
The Contracting Officer has determined that Miller-Remick, LLC. is a qualified
SDVOSB; and is the only source familiar enough with the completed design to fulfill this requirement. Minimal to no sources would be expected to have provided a response if sources had been sought based on the unfamiliarity with the completed design.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:
Fair and reasonable cost will be based on FAR 15.404-1(b)(2)(v).
8. Description of the Market Research Conducted and the Results, or a Statement of the
Reasons Market Research Was Not Conducted:
Market research was not conducted because Miller-Remick is the only source that can provide Design Refresh. The VIP database was queried in accordance with VAAR 810.001, Market Research policy. Miller-Remick is listed in the VIP database along with other multiple SDVOSB concerns.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
Miller-Remick has provided all the contract drawings and documents for the current 100% design document
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
See paragraph 6 above.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any
Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
All requirements, including the subject requirement, are thoroughly reviewed to ensure that competition is not unnecessarily restricted. This contracting action has no other sources of competition.
12. Requirements Certification:
