1.0 SCOPE
This contract covers all legal notices required by Wisconsin statutes to be published in the official state newspaper designated by the legislature, currently the Wisconsin State Journal. This is an ongoing contract until another newspaper is subsequently designated by the Legislature. The Department of Administration adjusts the rates every year based on market variables.
985.04 Official state newspaper. The joint committee on legislative organization shall recommend to the legislature to designate some newspaper published in Wisconsin to be the official state newspaper, which shall publish all legal notices required to be published therein. Any such publication from any of the state agencies shall be deemed official. The joint committee may invite bids from all newspapers which meet the requirements of s. 985.03, but if it does so, it is not required to recommend the lowest bidder as the official state newspaper. The joint committee shall introduce its recommendation in the legislature in the form of a joint resolution. No designation takes effect until the joint resolution is adopted. A newspaper which is designated the official state newspaper shall continue as such until the legislature designates another newspaper to be the official state newspaper.
History: 1977 c. 29; 1979 c. 34; 1981 c. 372 ss. 12, 13.
Article VII, sec. 21 [Art. IV, s. 17] requires full text publication of all general laws, and publication of an abstract or synopsis of such laws would not be sufficient. Methods other than newspaper publication, under s. 985.04, may be utilized to give public notice of our general laws. 63 Atty. Gen. 346. See also s. 14.38 (10).

Unless otherwise directed by the ordering agency.

9.2 PAYMENTS
The State of Wisconsin will normally pay properly submitted invoices within thirty (30) days of receipt at the billing address specified for each notice. Invoices must be submitted in accordance with the instructions contained on the order form, including but not limited to the following:
Purchase order, sub-order and/or direct charge coding.
Actual date(s) of publication.
Itemized rate calculations for each insertion.

The newspaper shall return agency phone calls within two working hours. Returning a phone call includes leaving a voice mail, email or other message if the agency contact person is unavailable. This provision is for the purpose of establishing a minimum level of responsiveness for communication with the agencies. It does not require the newspaper to solve a problem with an order within two working hours.
11.0 RELATED CONTRACTS
Contract 505ENT-M25-RATECERT-00 covers the publication of legal notices in newspapers other than the official state newspaper.
12.0 INSTRUCTIONS
All State of Wisconsin agencies, including UW System campuses and the Legislature, shall use Legal Notice Order-Official State Newspaper, DOA 3428 when placing orders for legal notices to be run in the official state newspaper. The newspaper will not accept legal notice orders without this form. This standard form reduces keying and billing errors, is an integral part of the newspaper’s order entry process, and is a requirement of the official state newspaper contract. Agencies may reproduce DOA 3428 as needed.
These instructions contain general information for preparing the order form and preparing the copy or text of the legal notice. Variable information such as publication deadlines, rates and other details are included in State Procurement Statewide Contract 505ENT-M25-LEGALNOTIC-01 — Legal Notices in the Official State Newspaper.
12.1 ORDERING PROCEDURES
Complete and submit DOA 3428 to the newspaper as directed in State Procurement Statewide Contract 505ENT-M25-LEGALNOTIC-01. The newspaper prefers email rather than mail. To avoid duplicate publication, do not follow up emailed orders with hard copy.
a) ORDER INFORMATION
Use the following guidelines when furnishing information for this section:
• Billing Phone — Enter the area code and phone number the newspaper should call with questions about obtaining payment. (Generally, this is the agency accounts payable office.)
This number also serves as the agency’s account number on the newspaper’s data system.
Contact the newspaper for assistance in identifying your account number.
• Billing Contact Name — Enter the name of the agency staff person who will assist the newspaper with tracing invoices. Generally, this person is reached by calling the number listed under “billing phone.” Agency Name — Enter the agency name associated with the billing address.
• Billing Street or PO Box — the address to which the invoice should be mailed.
• Billing City/State/Zip — the address to which the invoice should be mailed.
• Purchase order number or other billing reference — Enter the purchase order number, release number and/or other coding that should appear on the invoice to assure prompt processing. It is not necessary to include a copy of the actual purchase order, i.e., the purchase order number is required, but the purchase order form is not.
• Advertisement contact name — Enter the name of the person the newspaper should contact if there are pre-publication questions about the notice, e.g., publication dates, text, and format. This person may be the agency printing manager or program person responsible for legal notices rather than the person listed in the text of the notice.
• Notice contact phone and fax — Enter the phone and fax numbers of the person listed under “Notice contact name.”
b) COMMENTS AND SPECIAL INSTRUCTIONS https://vendornet.wi.gov/Contract.aspx?Id=cb56adb4-5ebd-ef11-905c-00505684483d https://vendornet.wi.gov/Download.aspx?type=contract&Id=cb56adb4-5ebd-ef11-905c-00505684483d&filename=DOA-3428+Public+or+Legal+Notice+Order.docx https://vendornet.wi.gov/Download.aspx?type=contract&Id=cb56adb4-5ebd-ef11-905c-00505684483d&filename=DOA-3428+Public+or+Legal+Notice+Order.docx https://vendornet.wi.gov/Contract.aspx?Id=b4226a1f-6abd-ef11-905c-00505684483d https://vendornet.wi.gov/Download.aspx?type=contract&Id=cb56adb4-5ebd-ef11-905c-00505684483d&filename=DOA-3428+Public+or+Legal+Notice+Order.docx
Enter additional information to assist the newspaper with processing the notice. Examples include but are not limited to, special address for affidavit, confirmation/alert of short deadline, notice of special format requirement.
c) REQUIRED WITH INVOICE Indicate the documentation/reference that needs to be included with the invoice. Affidavits and/or tear sheets will be mailed with the invoice unless other instructions are listed in section 7 of Form DOA 3428 .
d) DAY(S) OF PUBLICATION Each day a notice is published in the newspaper is called an “insertion”. Enter day and date for each insertion. If less than three insertions are required, enter (NONE) for the unneeded insertions, e.g., if only two insertions are required, enter (NONE) for the third insertion. If more than three insertions are needed, enter that information to the right of this section and add an alert to this effect under section 7 of Form DOA 3428. Current publication deadlines are included in State Procurement Statewide Contract 505ENT-M25-LEGALNOTIC-01.
e) TYPES OF NOTICES Legal notices in the official state newspaper are grouped into four classifications—Secretary of State, General Notices, Bids/Proposals, and Construction Bids. Secretary of State notices are limited to that agency only. General Notices includes all notices that are not bid- or construction-related. Bids/Proposals includes requests for bids (RFB) and requests for proposals (RFP) and require the special formatting described in section 12.3 below. Construction Bids do not have any special formatting requirements. Bid waivers and sale of surplus property are not bids or proposals and are classified as General Notices.
f) TEXT Enter the text of the legal notice here or indicate “see attached”, if using an attached page.
Include the following at the top of each attached page: Agency name, Notice contact name, Notice contact phone. Use upper case, lowercase and bold as needed. Bold and uppercase letters add to the cost of the notice since they take up slightly more space per line. If underlining, strikeout or italics is required, contact the newspaper for special instructions prior to submitting the notice. The newspaper will format and hyphenate the notice to fit the required column width.
The newspaper will not be liable for missing copy.
Note: It is not necessary to include ADA language in the text for any legal notices to be run in the official state newspaper. Instead, the following statement is published every day as part of the overall State of Wisconsin Legal Notices header and applies to all legal notices: “Reasonable accommodation, including the provision of informational material in an alternative format, will be provided for qualified individuals with disabilities upon request.” The newspaper provides this statement as a service to the state to save the cost of publishing the same language in each notice.
g) SECRETARY OF STATE This classification may only be used for notices placed by the Office of the Secretary of State.
Special formatting and rates are between the Secretary of State and the newspaper.
h) GENERAL NOTICES Enter the text as it should appear in the notice. The newspaper will hyphenate the text and format it to fit the newspaper’s margins. Notice that bid waivers and sale of surplus property are included under General Notices and do not use the special formats described later for bids and proposals.
12.2 GENERAL NOTICE EXAMPLES
Use the following formats when entering text for General Notices in form DOA 3428, Section 12.3.

“Item” always begins a new line and should appear in bold text. “Item” may be repeated as necessary within the notice. See samples below.

Time abbreviations do not include periods and are without space after the hour/minutes, i.e., 10:40am, not 10:40 a.m.; generally follows “RFB/RFP” but may start a new line if one due date applies to several different bids or proposals in the same notice.
