About this file

This document is a Sole Source Request and Determination Form for a contract between the New Mexico Department of Transportation (NMDOT) and the New Mexico Activities Association (NMAA). The contract is for a four-year term and provides NMDOT with various advertising and promotional opportunities through NMAA's platforms, including rotating banner ads on NMACT.ORG, ads in championship programs, presence at championship events, access to the NMAA 24/7 Mobile App, social media posts, emails to athletic directors and coaches, commercials in the weekly NMAA High School Show, and logo/commercial presence at championship events. The total investment for NMDOT over the four-year contract period is $239,980.

The document explains that NMAA is the only entity with the authority and capacity to manage the state's middle and high school tournaments and provide the requested services, making it a sole source procurement. NMAA is a private, non-profit organization that serves as the sanctioning body for interscholastic activities in New Mexico and has a close affiliation with the state's Department of Education, allowing it to reach all schools in the state.

IV. Provide an explanation of the criteria developed and specified by the agency as necessary to perform and/or fulfill the contract and upon which the state agency reviewed available sources. (Do not use “technical jargon;” use plain English. Do not tailor the criteria simply to exclude other contractors if it is not rationally related to the purpose of the contract.)

Prevention and educational messages communicated through a variety of venues are especially important in reaching people of all ages. New Mexico Department of transportation would like to partner with the New Mexico Activities Association (NMAA) to display messages or campaigns developed and approved by the Traffic Safety Division on the LED sideline, Big Board, and video board with Department provided information message at NMAA events.

V. Provide a detailed, sufficient explanation of the reasons, qualifications, proprietary rights or unique capabilities of the prospective contractor that makes the prospective contractor the one source capable of providing the required professional service, service, construction or item(s) of tangible personal property. (Please do not state the source is the “best” source or the “least costly” source. Those factors do not justify a “sole source.”)

NMAA is a private/non-profit organization formed in 1921 whose principle purpose is the regulation, direction, administration and supervision of interscholastic activities in the State of New Mexico. The NMAA is the sanctioning body for the State of New Mexico as designated by the Department of Education and prides itself in its leadership, providing educational and social experiences for the students and communities of New Mexico. The

NMAA has taken a leadership role nationally in several areas, including sportsmanship, media relations, coaches preparation, corporate development and interscholastic activities.

Because of this NMAA is the only entity with the capacity to reach this target audience.

VI. Provide a detailed, sufficient explanation of how the professional service, service, construction or item(s) of tangible personal property is/are unique and how this uniqueness is substantially related to the intended purpose of the contract.

NMAA is the only entity with the authority to manage the NM state middle and high school tournaments.

VII. Explain why other similar professional services, services, construction or item(s) of tangible personal property cannot meet the intended purpose of the contract.

NMAA is the only firm to date that we have found who meets the needs of Traffic Safety

Division for the specific underage drinking program because of their close affiliation with the Public Education Department and their ability to reach all schools in the state.

VIII. Provide a narrative description of the agency’s due diligence in determining the basis for the procurement, including procedures used by the agency to conduct a review of available sources such as researching trade publications, industry newsletters and the internet;

reviewing telephone books and other advertisements; contacting similar service providers;

and reviewing the State Purchasing Agent’s vendor list. Include a list of businesses contacted (do not state that no other businesses were contacted), date of contact, method of contact (telephone, mail, e-mail, other), and documentation demonstrating an explanation of why those businesses could not or would not, under any circumstances, perform the contract;

or an explanation of why the agency has determined that no businesses other than the prospective contractor can perform the contract.

NMAA is the only contractor we have found that has access to all schools across the state and the ability to assist the Department to educate New Mexico youth and their families on

Traffic Safety.
