About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition to award a sole source contract to Qiagen LLC for off-the-shelf bioinformatics software.
The Naval Medical Research Command (NMRC) requires Qiagen's CLC Genomics Server Premium and Grid Node Plus software to perform bioinformatics analyses on high-throughput genomic sequencing data in support of its Biological Defense Research Directorate. Qiagen is the original equipment manufacturer and sole provider of this specialized software, which is necessary for NMRC's critical and ongoing pandemic response efforts. The contract will be a firm fixed-price award with a base period and two option years. Market research confirmed Qiagen as the only available source. NMRC will consider any expressions of interest from other potential sources, but currently has no plans to compete future requirements for these services.

JUSTIFICATION AND APPROVAL
OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity.
This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet the Naval Medical Research and Development mission.
2. Nature and/or description of the action.
The need is for off-the-shelf (OTS) software produced by Qiagen LLC that will perform a range of bioinformatics analysis services on high-throughput sequencing data for the Biological Defense Research Directorate (BDRD) Genomics and Bioinformatics Department (G&B). The Government intends on awarding a Firm Fixed Price contract. The proposed source is Qiagen LLC, Germantown, Maryland, USA (https://www.qiagen.com/).
3. Description of Supplies or Services:
The Genomics & Bioinformatics Department of the Biological Defense Research Directorate, Naval Medical Research Command maintains a state-of-the-art genomics and bioinformatics research program. The department applies bioinformatics and/or cutting-edge high-throughput technologies – such as genotypic and phenotypic expression profiling, biomarker characterization, and bacteriophage expression systems – to the study of infectious diseases, biodefense, and enhanced global disease surveillance for early pathogen detection and response.
The Department is actively involved in pandemic response as a core lab for the GEIS Next Generation Sequencing & Bioinformatics Consortium and is currently engaged in sequencing of COVID-19 samples, other respiratory illness samples, and acute febrile illness samples. As a part of this critical and ongoing effort, BDRD utilizes OTS software from Qiagen to analyze these data. The CLC Genomics Server software will allow BDRD to run critical bioinformatics analyses on our high-performance compute (HPC) cluster, thereby reducing the time involved to achieve an analysis result.
Funds have been approved and will be used to purchase the CLC Genomics Server Premium and 7 Grid Node Plus. Base plus two option years.
4. Identification of the statutory exceptions permitting other than full and open competition.
The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and FAR 13.106-1(b)(1) soliciting from a single source.
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

Qiagen LLC is the OEM of this genomic software and this is the ideal source of the product. In addition, Qiagen LLC is the only vendor that can provide the software.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
There are no other service providers. Market research was performed, the results of which are in paragraph 8. This requirement will be posted to NECO and/or FedBizOpps in accordance with
FAR 5.202.
7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.
Market research was conducted by technical experts in the January/February 2024 timeframe.
The results of the market research are documented in a Market Research Memorandum.
9. Other facts supporting the use of other than full and open competition.
10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.
To date, no other sources have written to express an interest.
11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Future requirements will be synopsized in accordance with FAR 5.203.
For the reasons set forth in Paragraph 5, NMRC has no plans at this time to compete future contacts for the types of services covered by this document. If another potential source emerges, NMRC will assess whether competition for future requirements is feasible.
12. Point of Contact.
The point of contact at the Naval Medical Research Command, Silver Spring, MD, regarding the contents of the sole source justification is, Deborah M. Sharpe, who may be reached at (301) 319-6471.
