JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 02.
2. Description of the Action Being Approved
Award a Firm Fixed Price, Supply Contract on a sole source basis to JCL for the procurement of handheld antennas. In support of the guided missile destroyer weapons testing.
3. Description of Supplies/Services
The Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division Telemetry Systems Branch (PA44) has a requirement to provide telemetry systems capable of supporting missile testing for multiple projects at various missile test ranges as well as broad open-ocean testing, and specifically for the guided missile destroyer (FLT III DDG) weapons testing.

4. Statutory Authority Permitting Other Than Full and Open Competition
The statutory authority permitting this sole source action is 41 U.S.C. 1901, Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a).
5. Rationale Justifying Use of Cited Statutory Authority
The statutory authority permitting other than full and open competition applies to this procurement because the JCL Handheld Antennas and filter are the only parts that meet all of Corona Division’s land-based and shipboard requirements for reasons below:
The JCL antennas have the following features, which are necessary to meet needs: (1) interface compatibility; (2) ability to be integrated with the shipboard portable Advanced Telemetry System; (3) and required specifications, including frequency, passband, and rejection.
No other antenna can be modified to meet Government needs.
These antennas are unique because they are developed from US Navy specifications for performance and interface compatibility to support specific telemetry requirements for US Navy DDG FLT III weapons systems development testing. The individual specifications detailed in the purchase description are needed for the units to function as intended for the missions.
Additionally, these are the only parts that have demonstrated reliability, as the Navy has previously used these parts and they have been tested, evaluated, and verified to conform to the required specifications.
Additionally, the filters in the purchase description are the only parts that meet needs because they are the only filters that are compatible with existing antennas and are the only known replacement filter that can be integrated into the shipboard portable Advanced Telemetry System The filters are intended to provide retrofitting and spare components for existing similar JCL and legacy antennas. The vendors that
Ser Code 02/0265 furnished those legacy antennas no longer exist. The JCL filters will provide for a similar, but not exact, functionality as the legacy antennas. The filter meet government needs specific to minimum redundancy, insertion loss (1.5 dB Max), rejection rate and passband specifications.
Currently, the JCL antennas and filter are the only parts that are capable of supporting missile testing at various missile test ranges as well as broad open-ocean testing. It is in the best interests of the Navy to purchase these parts because without the JCL the Navy will be not be successful in providing the required mission support, including FLT III DDG weapons testing.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A Sources Sought Notice was posted on System for Award Management’s (SAM) website indicating the Government’s intent to sole source the requirement to JCL Antennas. The posting was issued on 8 February 2023 and closed on 15 February 2023. There were no interested vendors. In an effort to identify competitive interest, the Performance Assessment (PA44) branch, as part of market research, reviewed market capabilities to determine if companies other than JCL have the technical capability to meet requirements. However, no other company’s parts meet requirements and no other company has expressed an interest in providing the parts. The lack of any response to the SSN validates PA44’s determination that, for the reasons listed in paragraph 5 above, that no other parts can meet the Governments minimum needs.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the contracting officer has made the determination that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer will use price analysis, including commercial price lists, to determine that the final price to the Government is fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Section 5, Corona Division, Contracts Department has no plans at this time to compete future
Ser Code 02/0265 contracts for the types of supplies covered by this J&A. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
