About this file
This file is an ordinance attachment from Hillsborough County, Florida, establishing regulatory requirements for portable restroom facilities within the county's jurisdiction. The Hand Sanitizer Ordinance (Ordinance No. 05-8, effective June 17, 2005) mandates that every portable restroom and mobile restroom trailer placed in service in Hillsborough County must be equipped with an operable hand sanitizer dispenser containing sanitation liquid. The dispenser must be affixed to the inside of the restroom or located immediately adjacent to it, and responsible parties must maintain the dispenser in working order and monitor it to ensure operability and adequate sanitation liquid supply at all times. If a dispenser becomes inoperable, freestanding dispensers must be placed in each facility until repairs or replacement occur. Special event organizers are required to file signed contracts with the county's designated department at least three working days prior to any special event, providing specific information including event dates, hours of operation, location, and the portable restroom service provider's contact details.
Compliance with the ordinance is enforced through code inspections conducted by authorized county code inspectors. Violations occur when responsible parties fail to ensure compliance with sanitizer requirements or when special event organizers fail to timely provide required documentation to the county. The ordinance establishes escalating enforcement procedures, including cure periods for violations and provisions for repeat violations when violations occur at the same or different locations. Enforcement is administered through the county's Code Enforcement Ordinance procedures. The ordinance is subordinate to more restrictive state law requirements and does not permit hand sanitizers to replace handwashing facilities where state law mandates such facilities for portable restrooms.
