GENERAL SERVICES ADMINSITRATION

North Branch, Real Estate Acquisition Division

Justification for Other than Full and Open Competition

4PA0360

Office of Personnel Management

Boyers, PA

1) Nature and/or description of the action being approved

This action is being approved to extend the existing lease for six (6) months, for

220,582 ANSI/BOMA or 253,669 rental square feet (RSF) of office and storage space for the OPM Retirement Operations Center (ROC) at the Boyers Mine located at 1137

Branchton Road in Boyers, Pennsylvania. The current lease, GS-03B-10258, expires

October 27, 2014 and has a current rental rate of

2) Description of the supplies or services required to meet the agency’s needs (including the estimated value)

OPM-ROC currently occupies 220,582 ABOA of office space and file cabinets space and has been located at Iron Mountain since the 1970’s. Throughout OPM ROC’s occupancy, this former limestone mine has served ROC’s filing requirements extremely well, in both a functional and economic sense. The Boyers facility protects the integrity and safety of important OPM records in the event of a natural or manmade disaster. All records must be stored in a climate controlled and highly-secured environment which the current facility provides. This facility also provides office space for the approximately agency and contract employees that require access to the records on a daily basis.

3) Identification of the statutory authority

41 U.S.C. 253 (c) (1) and FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.

4) Demonstration that the proposed contractor’s unique qualifications or nature of the acquisition requires the use of the authority cited

Remaining in the current location will allow the mission of the agency to be fulfilled without disruption, while OPM and GSA complete the succeeding lease. Expending funds for move costs and tenant improvements at an alternative facility would be economically imprudent at this time.

5) Description of efforts made to ensure offers are solicited from as many potential sources as is practicable

In accordance with GSAM 570.106 Advertising, publicizing, and notification to

Congress, "(d) .... the contracting officer need not publicize the proposed acquisition of a leasehold interest in real property, including... lease extensions under the conditions defined in 570.405."

6) Determination that the anticipated cost will be fair and reasonable

The current lease rent for OPM – ROC is net of janitorial and electric, containing only a

“shell” rental rate with no operating costs or escalations. The current rental rate for

ROC is .

The anticipated lease extension rate is which is the same as the current rental rate. revealed above ground lease space in the City of Butler, which is nearby to the delineated area, to be estimated at not including operating costs or any tenant improvements. revealed the North Pittsburgh market, which is nearby to the delineated area, to have a range of including operating costs and a partial TI allowance.

Therefore, shell rates will range from The extension rate of is within the shell rental rate range for the closest market and therefore is considered to be fair and reasonable.

7) Description of market research conducted

Additional market research was conducted using and to research lease rates in the area. There were no properties available in the delineated area that could satisfy the minimum requirement.

8) Any other facts supporting the use of other than full and open competition

The agency has a continuing need for space at this unique facility. More so, there are no buildings in the delineated area that meet the Government’s minimum requirements.

The Boyers facility is a former limestone mine located in rural Western Pennsylvania that provides a unique, underground office and storage solution for private-sector and governmental agencies. There is not another similar facility in the vicinity that provides an equivalent level of protection for OPM’s security sensitive space needs at this time.

9) Listing of any sources that expressed, in writing, an interest in the acquisition

There were no sources of interest other than the current lessor.

10) Statement of actions the agency may take to overcome any barriers to competition

GSA is negotiating a succeeding lease for this space requirement at the current location.

I hereby certify that the above information is accurate and complete to the best of my knowledge.
