About this file
This is a Memo to File documenting the justification for a lease renewal without competition. The document concerns Lease Number LIN17880 occupied by Probation at Johnson's Creamery, 400 W 7th Street, Bloomington, Indiana 47404-3901, expiring February 28, 2026. The government requires a 5-year renewal with 3 years firm, with an estimated net annual rent and total contract value within the Simplified Lease Acquisition Threshold (SLAT). The renewal decision is supported by GSAR 570.405, with the government encountering unexpected delays outside its control in acquiring replacement space selected as the primary justification.
The rationale for the lease extension relies on cost-based reasoning rather than mission-based justification. The government argues that lease renewals represent necessary short-term contracting actions to protect occupancy rights when the government cannot vacate premises by the existing contract expiration date, avoiding holdover tenancy costs and the impracticability of recovering relocation costs through full and open competition for a separate short-term lease. The memo was signed by Henry Hargrove III, Leasing Specialist, and Jeanette Torres, Lease Contract Officer, both on July 24, 2025. Project Number 4IN0212 is assigned to this action, with DocuSign Envelope ID 1DCAF9A4-9197-439A-83C1-B1EEFD915007.

Cost based rationale
Lease renewals represent short-term contracting actions which are necessary to protect the occupancy rights of the government when the government cannot vacate the premises by the expiration of the existing contract term.
Renewals avoid the costs associated with holdover tenancies. Additionally, the government cannot reasonably expect to recover the costs associated with relocation of the tenant agency through full and open competition of a separate short-term lease to cover the term of this renewal.
