Justification for Other Than Full and Open Competition

Justification for Other Than Full and Open Competition, Lease Extension

U.S. General Services Administration

GSA Region 4

Leasing Division – Branch B

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

LEASE NUMBER: GS-04B-LGA38081

PROJECT NUMBER: 4GA0249

Agency Name: CDC

1. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED.

The General Services Administration currently leases 44,190 Rentable Square Feet (RSF) with a Common Area Factor (CAF) of 1.12, yielding 39,449 ANSI BOMA Office Area square feet (ABOA) at 2920 Brandywine Road, Atlanta, GA under lease number GS-04B-LGA38081 for the CDC. The current lease expires 02/15/2015. Approval is requested to negotiate a one year lease extension with the incumbent lessor without full and open competition for continued occupancy at this leased location.

2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED.

CDC requires this space to continue to support the owned and leased facilities within the Atlanta area. This lease extension is based on a GSA strategic decision to protect occupancy in order to avoid a lease holdover and allow adequate time for the replacement lease to be completed.

This requirement is for 44,190 RSF of space with a Common Area Factor (CAF) of 1.12 yielding 39,449 ANSI BOMA Office Area square feet (ABOA) for a 1-year, to commence on 02/16/2015.

The estimated annual cost of this lease is $22.28 per RSF per year for an annual cost of $984,349.99 for the first year and a total contract value of $984,349.99 incorporating expected rental adjustments over the term of the lease. The delineated area is I-85 North Corridor, Atlanta, GA.

3. IDENTIFICATION OF STATUTORY AUTHORITY.

41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

4. DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY

CITED.

GSAM 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition.

Award to other than the current Lessor would require relocation of the entire requirement and would cause CDC to incur move and replication costs that would not be recovered through competition.

F. Cost Benefit Analysis Summary

The cost of relocating CDC using the low cost quote exceeds the cost of remaining at Colgate building. The savings to the Government is $1,975,267.46. Based on this cost-benefit analysis, the Government cannot expect to recover relocation and duplication costs through competition.

Therefore, the Government intends to negotiate a lease extension and remain at its current location.

5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICAL.

The incumbent lessor’s expression of interest indicated that the rate would be $22.28 per RSF.

The interested party that provided the lowest cost quoted a rate of $22.50 per RSF in its expression of interest. On January 13, 2015, GSA conducted market research and identified three potentially acceptable locations that might meet the agency’s needs within the delineated area.

6. DESCRIPTION OF MARKET RESEARCH CONDUCTED.

On January 13, 2015, GSA conducted market research using CoStar that identified the following 2 locations including the incumbent:

11. CONTRACTING OFFICER CERTIFICATION AND DETERMINATION THAT THE

ANTICIPATED COST WILL BE FAIR AND REASONABLE.

Recent market research conducted by GSA in Atlanta, GA, for comparable properties showed that the rental rate within the delineated area for those properties ranges from $22.50 to $24.50 per RSF.

The cost quoted to the Government by the current Lessor, at the existing location, is $22.28 per

RSF.

Additionally, it is anticipated that the Government will save approximately $1,975,267.46 in duplication costs which it could not reasonably expect to recover through full and open competition, as demonstrated by the cost benefit analysis in section 4 of this document.

Therefore, as the rate quoted by the existing Lessor falls within the market range found through the market research and due to the fact that the Government will save approximately $1,975,267.46 in duplication costs which it could not reasonably expect to recover through full and open competition, the Contracting Officer determines that the anticipated cost to the Government of $22.28 per RSF for the entire requirement is fair and reasonable.
