About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a Sustaining Engineering and Technical Support Services (SETSS) Undefinitized Contract Action (UCA) for the C-5M Super Galaxy aircraft fleet. The J&A authorizes a sole-source contract with a specific vendor for a 12-month Period of Performance from 25 July 2024 to 24 July 2025, valued at a redacted amount, to prevent a lapse in critical engineering and technical support services.

The contract will provide specialized engineering services including the Aircraft Structural Integrity Program (ASIP), Functional Systems Integrity Program (FSIP), Corrosion Prevention and Control Program (CPCP), Technical Data Sustainment, and Modernization Sustaining Services. The requirement is unique and cannot be competitively sourced due to the vendor's proprietary technical data, historical knowledge, and direct experience with the C-5M fleet. Market research conducted through a Sources Sought/Request for Information synopsis and multiple website searches confirmed no other vendors can meet the government's specific technical requirements for these specialized engineering services.

Functional Systems Integrity Program (FSIP), and Corrosion Prevention and Control Program (CPCP), as well as Modernization Sustaining Services. Technical Data Sustainment (TDS) is limited to acquiring historical technical data and rights on a case-by-case basis to support current and future sustainment of the C-5M. The TDS data requests are primarily identified in response to Engineering Technical Assistance Requests where gaps are identified in the Technical Data Package (TDP) baseline that should have been delivered under the original production contract but were either missed, incomplete, illegible, or lost by the Government prior to establishing a digital baseline/repository for the C-5M.

The SETSS UCA is one of three ongoing efforts within that are sole source to . The UCA supports Integrity Programs and in-depth investigations on deficiencies associated with structures, mechanical systems, and avionics (hardware only) requiring specific support. The other two sole source efforts which will have separate J&As are for Software Modernization and Contractor Logistics Services. Integrity Programs are considered a 'cost of doing business' in order to effectively sustain and maintain operations for the fleet. ASIP is mandatory in accordance with (IAW) Department of the Air Force Instruction (AFI) 63-140, Aircraft Structural Integrity Program and Air and Space Equipment Structural Management, and AFI 63-101/20-101, Integrated Life Cycle Management, with requirements established IAW MIL-STD-1530D, Aircraft Structural Integrity Program. FSIP is mandatory IAW AFI 63-101/20-101, Integrated Life Cycle Management, with requirements established in MIL-STD-1798D, Mechanical Equipment and Subsystems Integrity Program.

The estimated annual cost of these services is as follows:

Start End Cost ($M) 12-Month PoP 25 July 2024 24 July 2025

Total estimated contract value is . The estimated contract value is based on a 5-year average historical costs of the unburdened actuals reported by the under the current SETSS contract

, with a factor of to account for inflationary factors.

August 2023 CUI Page 9 of 10 continue to send inquire to requesting their interest in selling the TDP and key technical data/IP associated with ASIP, FSIP, and CPCP to the Government. The SPO team will continue efforts to promote competitive awards where workload can transition away from . In addition, the team will work closely with engineering to determine what projects/workloads are appropriate to transition from

Current examples of C-5M Super Galaxy Division workload to remove competitive barriers are:

• Most of the C-5's CPCP Support has been contracted to an 8(a) company as a direct award on a recurring basis. In FY23, overall CPCP programmed funds were awarded to the 8(a) direct award contract. The CLIN for CPCP Support is only for consultation with OEM CPCP expert personnel.

• The ) administers the

Information Analysis Center multiple award contract vehicle which is currently being utilized to provide engineering and technical support for specified mechanical system components and Line Replaceable Units, including environmental systems, landing gear system, flight controls, avionics, and sustainment solutions for structures. has also been utilized by WLS in its previous incarnations of contract vehicles known as Information Analysis Centers and Defense Systems Technical Area Tasks. Another example is support for the Electrical Wiring Interconnect System, which is a project that supports identification and solutions for existing and emerging wiring health issues, creates technical data for aircraft wiring hardware and wires issues, accomplishes reverse engineering on wiring artifacts, and creates wiring test procedure.

The plan to break barriers to competition in the prior J&A was as follows:

• The Government will send an inquiry to requesting Government purpose rights to the technical data prior to each ordering period. The plan was completed on a project basis; however, the continues to assert proprietary rights to critical technical data to successfully maintain Integrity Programs. The Government met some success with gaining Government purpose rights or unlimited rights for some individual drawings.

• Any second source will be required to generate non-proprietary data which will be Government owned. The Government executed this plan by requiring flow down of data rights validation requirements to sub-contractors for delivery of technical data with “other than unlimited rights.”

These requirements were included in the prior SETSS contract. The SETSS contract required delivery of updated drawings and TOs per contract data requirements.

• At the enterprise level, the C-5M Super Galaxy Division planned to collect “any changes to drawings and technical orders that produces, whether it was directed by the Government or internal to .” These changes are delivered per contract data requirements, reviewed, and approved by the technical authority at Robins AFB. The collection of this data may allow for limited organic support in the future. TDS data deliverables have supported various efforts for organic local manufacturing in support of PDM and allowed for to procure parts that would otherwise be no procurable as they would be non-releasable to other vendors.

Based on completion of the prior plan, higher level approval in accordance with DFARS PGI 206.304(a) (S-70)(ii) is not required for this J&A.
