About this file

This is a Justification and Approval (J&A) document for other than full and open competition from the Pearl Harbor Naval Shipyard and Intermediate Maintenance Facility for refurbishment services of a Rotational Deployment Mechanism (RDM) in support of the USS COLORADO (SSN-788).

The sole-source contract will be awarded to Curtiss-Wright Electro-Mechanical Corporation (CW-EMD) for $397,837.50 with a period of performance from 9/30/24-9/29/25. The justification cites that CW-EMD owns all proprietary procedures, drawings, processes, and equipment necessary for RDM refurbishment, including inspections, repairs, painting, and testing of the Secondary Propulsion System RDM, Training Motor and Rotary Joint. A Sources Sought notice posted from 8/1/24-8/7/24 received no viable responses. The Contracting Officer will use contract N32253-24-C-0007 as historical reference for price reasonableness. The J&A was approved on 8/12/24 by the Chief of Contracting Office under the authority of 10 U.S.C. 3204(a)(1).

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 3204 (a)(1) as implemented by FAR 6.302-1- Only One Responsible Source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

Curtiss Wright EMD (CW-EMD)owns the proprietary procedures, drawings, processes, and equipment (tooling/fixturing) necessary to complete the required refurbishment of the RDM unit. CW-EMD has not shared their proprietary procedures, drawings, processes or equipment with any entity, including the Government.

The RDM components were designed by CW-EMD and CW-EMD does not authorize usage of its proprietary drawings by any third parties. CW-EMD will perform a receipt inspection, disassembly, and reassembly of RDM assembly components including the hydraulic motor, worm gear, driving ring, and thrust collar. CW-EMD engineers will assess and accomplish refurbishments utilizing CW-EMD’s proprietary drawings, past refurbishments of units, and proprietary processes and equipment in order to meet the Government’s requirements.

No other contractor is capable of providing the refurbishment services to the RDM to meet the Government’s requirement as the procedures, drawings, processes and equipment necessary to complete the refurbishment services are proprietary to CW-EMD.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Online market research found no other qualified vendors to provide the required supplies/services identified in paragraph 3.a.

A search of mandatory sources and Interagency Contract Directory yielded no relevant results.

A Sources Sought was posted on 08/01/2024 with a close date of 08/07/2024 at 3:00 p.m. HST. The Sources Sought posting was used to verify if there were any sources capable of fulfilling this requirement. No viable responses were received in conjunction to the Sources Sought posting.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The Contracting Officer will use contract N32253-24-C-0007 as historical reference for the price reasonableness determination.

8. Actions to Remove Barriers to Competition

Actions to remove future competition should be reviewed at the time the vessels are built. For example, whether component(s) being installed shipboard will remain property to the OEM. For this reason and the rationale set forth in paragraph 5, PHNSY&IMF has no plans at this time to compete future contracts for the types of supplies/services covered by this document. PHNSY&IMF will assess whether competition for future requirements is feasible should another potential source(s) emerge.
