About this file
This is a Request for Quotation (RFQ) for Class 5 Security Cabinets issued by the GSA Federal Acquisition Service. The solicitation seeks multiple Blanket Purchase Agreements (BPAs) for security cabinets with an estimated value of $5 million for a one-year base period, with an optional one-year extension. The procurement covers four specific National Stock Numbers (NSNs) for security cabinets that must be quoted in the aggregate and must be listed on the Qualified Products List (QPL-AA-C-2786).
The RFQ employs a ranked order with proportional award method, with a minimum of 40% of estimated requirements reserved for small business concerns. Vendors will be evaluated on technical acceptability, past performance, shipment time, and price, with shipment time being slightly more important than price. Contractors must quote a shipment time not exceeding 90 days after receipt of order, with faster delivery times potentially receiving more favorable evaluation. Quotes must be submitted via email to securitycontainers@gsa.gov, with questions due by 04/04/2025 and responses issued by 04/09/2025. The government intends to award BPAs based on initial quotes and will conduct annual performance reviews.

This could result in a single award or multiple award scenarios, as described later in this solicitation. The resulting award(s) will be for Open Market BPAs, with an estimated value of $5M for a one-year base period, with an optional one-year period, after an annual review. The estimated quantities for the BPAs are indicated on page 7 of this RFQ.
The Federal Acquisition Service, Supply Chain Management (SCM) Contracting Division, General Products Branch may issue orders against these BPAs for items listed herein. This is not a contract. A binding agreement only arises if SCM issues an order, and the order is accepted by the BPA holder. Estimates contained herein are provided for informational purposes only. PART II - CONTRACT CLAUSES
FAR 52.217-9 Option to Extend the Term of the Contract (Mar 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed two (2) years.
(End of clause)
TIME OF DELIVERY
(a) The Government requires delivery to be made according to the following schedule:
Shipment is required within 90 calendar days after receipt of order. Each delivery order will specify that shipment is required no later than the number of days shown above. If such order also states that “Early Shipment is Precluded,” the Contractor agrees to make shipment no sooner than the calendar days after receipt of order specified on the order. Earlier shipments may result in nonacceptance of the supplies at the delivery point at the time of arrival.
(b) Attention is directed to the BPA Award provision of the solicitation that provides that a written award or acceptance of an offer email, or otherwise furnished to the successful offeror, results in a binding agreement. The Government will email or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through email.
However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the agreement or notice of award by adding one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
52.232-40 Providing Accelerated Payments to Small Business Subcontractors (MAR 2023)
(a)(1) In accordance with 31 U.S.C. 3903 and 10 U.S.C. 3801, within 15 days after receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to https://www.govinfo.gov/link/uscode/31/3903 https://www.govinfo.gov/link/uscode/10/3801 its small business subcontractors under this contract, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, after receipt of a proper invoice and all other required documentation from the small business subcontractor.
(2) The Contractor agrees to make such payments to its small business subcontractors without any further consideration from or fees charged to the subcontractor.
(b) The acceleration of payments under this clause does not provide any new rights under the
Prompt Payment Act.
(c) Include the substance of this clause, including this paragraph (c), in all subcontracts with small business concerns, including subcontracts with small business concerns for the acquisition of commercial products or commercial services.
Economic Price Adjustments (EPA)
EPAs will be at the CO discretion and will be limited to once per year, during the performance period. Price adjustments will only be considered if market conditions warrant percentage change from the last adjustment period. Contractors shall provide documentation to support price adjustments. To ensure the awarded positions (primary, second, third, etc.) are retained, the
Government will consider all documentation submitted, as well as market research conducted to determine a fair and reasonable price increase/decrease. Any market conditions that warrant economic price changes beyond once per year will be considered at the sole discretion of the
Contracting Officer.
52.232-39 UNENFORCEABILITY OF UNAUTHORIZED OBLIGATIONS (JUN 2013)
(a) Except as stated in paragraph (b) of this clause, when any supply or service acquired under this contract is subject to any End User License Agreement (EULA), Terms of Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti-Deficiency Act violation (31 U.S.C. 1341), the following shall govern:
(1) Any such clause is unenforceable against the Government.
(2) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an "I agree" click box or other comparable mechanism (e.g., "click-wrap" or "browse-wrap" agreements), execution does not bind the Government, or any Government authorized end user to such clause.
(3) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.
(b) Paragraph (a) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.
