The contract is for base+4 fire alarm service at the Jesse Brown VA Medical Center in Chicago, Illinois, with an award amount of $80,534.30. Key services include maintenance, testing, and repair of the fire alarm control panel and various smoke detectors, pull stations, heat detectors, duct detectors, fire dampers, and other notification devices in accordance with NFPA standards. The initial term is one year from February 1, 2024 to January 31, 2025 with four additional optional one-year periods. (4) Identify the Authority and Supporting Rational: The SimplexGrinnell Fire Panel System and components are proprietary to Johnson Controls. There is no educational material commercially.
available from which a non-Johnson Controls technician can qualify to edit the system. Johnson Controls is the only company that can make program revisions and corrections to the system. All improvements and enhancements are available only through Johnson Controls. All parts for the system are manufactured by Johnson Controls and not commercially available from any other vendor. All parts from Johnson Controls can be available overnight for these life safety systems as requested. Internal wiring diagrams are only available to Johnson Controls technicians to troubleshoot the system.
D FAR 8.405-6(a)(l)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:
FAR 8.405-6(a)(l)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; The SimplexGrinnell Fire Panel System and components are proprietary to Johnson Controls. There is no educational material commercially available from which a non-Johnson Controls technician can qualify to edit the system. D FAR 8.405-6(a)(l)(C): In the interest of economy and efficiency, the new work is a logical follow- on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.
| □ | FAR 8 405-6(b): Items peculiar to one manufacturer: |
| D | A patent, copyright or proprietary data limits competition. The proprietary data is: |
| D | These are "direct replacements" parts/components for existing equipment. |
| D | The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. |
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: The current pricing has increased with the implementation of the new GSA contract awarded in the last month. It was found that the cost for testing maintenance and repair of the components have increased by almost since when the contract was initially awarded back in 2019. When compared to other companies it was found that the increase was also found to have increased sustainably in the past year.
. The CO has determined that the new pricing is fair and reasonable to the government based on past and current contract price listed off of GSA. At this time the contracted increase for each OY renewal. This pricing is in line for similar services from another vendor that has a sole source contract also.
(6) Describe the Market Research Conducted: The Simplex Fire Alarm Panels are micro-processor- controlled fire alarm systems and the Simplex fire alarm systems are manufactured entirely by Johnson Controls and as such, Johnson Controls is the sole source for parts and some aspects of maintenance/service with technical update information regarding the Simplex fire alarm systems. Simplex has internal wiring diagrams available to Johnson Controls technicians, which are helpful for troubleshooting the system. Preferential service calls are given to those who have a Johnson Controls contract in place. A sources sought/Intent to sole source was issued on 11/14/2023, with a due date of 11/20 and yielded no interest from potential contractors with the NAICS code of 561621. Johnson Controls Inc. is the only provider that can work on the systems at the station due to proprietary equipment. Market research found the following: GSA listed 6 vendors when using the key words” Fire Suppression System Maintenance”. Using the NAICS 561621 code it resulted in 39 results When VIOP was Queried with the same Key words above it listed 2747. When using the same NAICS 561621 it yielded 561 for both SDVOSB (530) and VOSB (31). When looking into the results it was found that a large majority had construction, electrical or limited experience with fire suppression as detailed in the SOW. SAM.gov yielded 92 results with the NAICS of 561621. FPDS reporting a majority of awards to Johnson Controls due to the proprietary nature of the panels that a re used at the station. GSA currently has a negotiated contract with Johnson Controls and was found to have the best value to the government when including all testing, maintenance and repair.
(7) Any Other Facts Supporting the Justification: Johnson Controls Inc. is the only provider that is able to work on the systems at the station due to proprietary equipment.
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: None
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
