9. BASIS OF AWARD

This procurement is being conducted in accordance with FAR Subpart 12. The Government will issue a purchase order (PO) with the quoter whose quotation represents the best value to meet the Government’s need. Best value is defined as the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement, in accordance with FAR 2.101. Best value is expected to result from the selection of the technically acceptable quote with the lowest price; therefore, the Government will issue a PO to the lowest price technically acceptable (LPTA) quote. No tradeoffs are permitted. The quoters shall submit their best terms and/or their most favored pricing in their initial offer. The quoter shall be found technically acceptable under all evaluation factors in order for the quote to be technically acceptable.

Technically Acceptable is defined as follows:

Table 1: Technical Specification Ratings

Rating
Description
Acceptable
Quote clearly meets the minimum requirements of the solicitation.
Unacceptable
Quote does not clearly meet the minimum requirements of the solicitation.

Table 2: Past Experience

Rating
Description
Acceptable
The quoter has provided project(s) which was/were similar to the contract(s)/project(s) requirements included in the SOW
Unacceptable
The quoter has provided project(s) which was/were not similar to the contract(s)/project(s) requirements included in the SOW

After the RFQ closes, quotations will be ranked by total overall price from lowest to highest; the lowest price quote will then be reviewed for technical acceptability. If the lowest price quote is determined to be technically unacceptable, the next lowest price quotation will be reviewed for technical acceptability. After determination of the lowest price technically acceptable quote is made, any remaining higher-priced quotes will not be reviewed for technical acceptability.

In the event, there are multiple technically acceptable offers with the same lowest price, the CO will advise those quoters and allow them to revise their quotation, and the quoter with the lowest revised pricing will be awarded the PO. This process will continue until a lowest price quotation is received. By submitting a quotation, the quoters is in agreement to this process.

Post-selection negotiations: This is a PO award utilizing the procedures of 13.106-2, Evaluation of quotations or offers wherein the CO may exercise broad discretion in developing appropriate order placement procedures. Accordingly, also reserved to the Government is the right for the CO, at the conclusion of the evaluation process and after the CO has determined the Government’s proposed best value awardee but prior to award, to negotiate exclusively with that proposed awardee on all aspects of that offeror’s proposal that the CO deems appropriate, including but not limited to negotiating changes to specific quote terms, in order to finalize terms of the order for award. If the CO is unable to negotiate with that offeror to terms agreeable to the Government, then the CO reserves the right to negotiate similarly with the offeror that was next-in-line to be the proposed best value awardee; this process may continue with the offerors that submitted quotations until an award is made, or until a decision is made to reopen negotiations with all quoters, or until the CO determines to make no award. Post-selection negotiations, if any, with the proposed best value awardee shall not constitute a competitive range determination and shall not otherwise entitle other quoters, if any, to an opportunity to revise quotations.

Formal Source Selection procedures, in accordance with FAR Part 15, will not be used. Accordingly, the Government is not obligated to determine a competitive range, conduct discussions with quoters, solicit final revised quotations, and use other techniques associated with FAR part 15. The Government, however, reserves the right to conduct confer sessions if the CO determines them to be necessary and in the best interests of the Government.

Quoters are cautioned that failure to submit the items required by the solicitation and any exceptions taken to the terms or conditions of the solicitation could make a quotation unacceptable, unless the solicitation expressly authorizes such an exception with regard to that specific term or condition.

10. QUOTATION EVALUATION
