About this file
This document is a Limited-Sources Justification (LSJ) for a federal contract opportunity under the Federal Supply Schedule program. The GSA Federal Acquisition Service Assisted Acquisition Services (AAS) is supporting the U.S. Army Program Management Office for Protection and Integration (PM-PI) to procure highly specialized equipment for U.S. Special Operations Forces (SOF). The items, including protective apparel, packs, and other specialized gear, are unique and necessary to fulfill PM-PI and Naval Special Warfare mission requirements. The LSJ cites FAR 8.405-6(a)(1)(B) as the authority to limit the sources to only Watershed LLC, as market research determined they are the sole provider of the required equipment that has undergone the stringent testing and validation required by USSOCOM. The estimated value of the resulting delivery order is $847,250.79, with a total customer funding of $876,983.00. The contracting officer has determined that Watershed's GSA schedule pricing represents the best value.

LIMITED-SOURCES JUSTIFICATION
FOR FEDERAL SUPPLY SCHEDULE PROGRAM
Acquisition ID No. 47QFNA24K0037
Upon the basis of the following justification, prepared in accordance with Federal Acquisition Regulation (FAR) 8.405-6(c) the use of sources limited to fewer than those required in FAR 8.405- 1, pursuant to the authority of 41 U.S.C. 251 as implemented by FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. This acquisition is conducted under the authority of the Multiple-Award Schedule (MAS) Program (41 U.S.C. 251, et seq. and 40 U.S.C.
501).
1. Identification of the agency and the contracting activity.
Contracting Activity: General Services Administration (GSA) Federal Acquisition Service (FAS) Assisted Acquisition Services (AAS) Army.
Client: United States (US) Army Program Management Office for Protection and Integration (PM-PI).
2. Nature and/or description of the action being approved.
The GSA FAS AAS Army supports PM-PI to fulfill a variety of brand name, commercial item requirements to procure equipment to enhance the survivability, readiness, and mobility of the individual operator. This justification is in accordance with FAR 8.406(b) Items peculiar to one manufacturer and necessary to fulfill a requirement of PM-PI, Naval Special Warfare (NSW) and Tax Packs, Watershed and Mystery Ranch equipment as shown in Request for Quote (RFQ) Attachment 1.
The U.S. PM-PI require highly specialized equipment to perform their missions and require specific and highly specialized equipment for Special Operations Forces (SOF) missions, that SOF testing and operational use has demonstrated are the only certain items capable of meeting the associated requirements of the Special Operator. The requiring agency maintains the test reports, Acquisition Decision Memoranda (ADMs), Program Executive Officer (PEO) directives and other various documents justifying the specific and highly specialized, approved equipment.
The specified items shown in RFQ Attachment 1 are known to perform under the stresses caused by the full spectrum of special operations and under a wide range of climatic conditions. Such operations routinely include activities such as reconnaissance, patrol, airdrop, search and rescue, and combat actions. As such, special operators require “tried and true” equipment, known to function and endure under the toughest circumstances. Substitution of untested or unproven items is not acceptable per the list of required items referenced in RFQ Attachment 1. The attachment provides the specific items required for this order and the required operational testing of the equipment to meet the stringent requirements of Special Operations Forces. Accordingly, market research has determined that only Watershed can provide all the required equipment and therefore this acquisition is being issued under the authority of FAR 8.405-6(a)(1)(B) to Watershed.
3. A complete description of the supplies and/or services required to meet the agency’s needs.
This limited source justification is in support of the PM-PI acquisition and all equipment listed in RFQ Attachment 1 includes the item name, part number and estimated quantity. The estimated value of this order is $847,250.79. The estimated quantity is -/+ 20% of items showed RFQ Attachment 1, and the Government reserves the right to increase or decrease line-item quantities to ensure the total cost of the delivery order does not exceed the customer’s funding of $876,983.00.
4. An identification of the LSJ rationale, and if applicable, a demonstration of the contractor’s unique qualifications to provide the required supply or service.
This justification and the resulting order referenced in paragraph 3 above are made under FAR 8.405- 6(a)(1)(B). The United States PM-PI units are composed of the nation’s elite war fighters, specializing in counterterrorism, direct action, foreign internal defense, special reconnaissance, and unconventional warfare. Located in Natick, Massachusetts, the U.S. Army Soldier Systems Center is responsible for research, development, and management of technologies and equipment used by PM-PI and other soldiers during their missions. These technologies and equipment include food, clothing, shelter, airdrop systems, medical equipment, as well as Soldier support systems. The items shown in RFQ Attachment 1 are to support United States Special Operations Command (USSOCOM) missions and is highly specialized and validated for use by SOF and the supplies have undergone the stringent testing required by USSOCOM directives and is the only manufactured equipment that can meet the requirements for the resulting order.
5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d) and FAR 8.405-2(d).
Market research shows that only Watershed can provide this equipment on their GSA MAS. As such, Watershed’s quoted price for each item will be reviewed against their GSA MAS pricing to ensure the quoted prices is in line or below the GSA schedule pricing. Additional discounts from the MAS pricing will be sought. The delivery timeframe will be reviewed by the customer to ensure the delivery schedule is reasonable to meet their need. Current market conditions have impacted supply chains and resulted in extended delivery timelines, which will be reviewed by the PM-PI customer.
6. Any other facts supporting the limited source justification.
Market research was conducted by the Contracting Officer by first considering the mandatory sources listed in FAR 8.002 and 8.003 and then 8.004, none of which apply. The Contracting Officer determined the GSA Multiple Award Schedule would be best suited under category 339113PA (Protective Apparel).
7. Any other facts supporting the limited source justification.
All facts supporting the justification are provided above.
8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.
Special Operations Forces require highly specialized equipment. The client agency for this order, PM-PI, acquires specific items that are validated for use by USSOCOM. However, PM-PI performs research and development and continually monitors the market, subjecting new potential technical solutions to the rigorous testing required to validate new items, as well as to invalidate obsolete products and prevent their further use. New vendors are also being sought at the GSA MAS level to provide additional competition for future requirements.
The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel.
