JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY - TASK ORDER 47QFCA25F0008
This document is a Justification for an Exception to Fair Opportunity under an Indefinite Delivery/Indefinite Quantity (IDIQ) contract. The General Services Administration (GSA) Assisted Acquisition Services (AAS) is issuing a modification to extend the Military Community and Family Policy (MC&FP) Outreach and Digital Enterprise Services (MODES) Bridge Task Order under the One Acquisition Solution for Integrated Services (OASIS) Unrestricted Pool 1 IDIQ contract vehicle. The current contractor, Miracle Systems LLC, will continue performance under Option Periods 3, 4, 5, and 6, extending the period of performance from October 22, 2026 through April 30, 2027 (if all options are exercised). The extension consists of Time-and-Materials (T&M) labor, Other Direct Costs (ODCs), and Long-Distance Travel Contract Line Item Numbers (CLINs). The total estimated value for the additional option periods is redacted in the document.
The justification for this exception to fair opportunity is based on the urgent need to avoid unacceptable delays caused by a post-award protest filed on September 2, 2026 against the competitive MODES III Task Order #47QFCA26F0027 awarded to DecisionPoint Corporation. The automatic Competition in Contracting Act (CICA) stay allows up to 190 days for protest resolution and transition, during which the MODES Bridge TO must continue to ensure continuity of critical services to U.S. military service members and families, including Outreach and Engagement (O&E) support, strategic communications, Content and Creative Services, digital strategies, and IT/cybersecurity enterprise support across Defense Information Systems Agency (DISA) and Amazon Web Services (AWS) GovCloud environments. Miracle Systems is identified as the only source with the requisite technical knowledge to perform these services without extensive ramp-up time. The contracting officer will verify that proposed labor rates and pricing are consistent with the original award and that pricing is fair and reasonable before modification execution.

JUSTIFICATION FOR AN EXCEPTION
TO FAIR OPPORTUNITY
UNDER INDEFINITE
DELIVERY/INDEFINITE QUANTITY
(IDIQ) CONTRACTS
Task Order 47QFCA25F0008
Military Community and Family Policy (MC&FP) Outreach and Digital Enterprise
Services (MODES) Bridge Extension in support of:
Office of the Deputy Assistant Secretary of Defense for Military Community and Family
Policy (MC&FP)
U.S. General Services Administration (GSA) Federal Acquisition Service
Assisted Acquisition Services (AAS) Defense
Interagency Agreement Number 47QFCA24S0091
The General Services Administration (GSA) Assisted Acquisition Services (AAS) makes this justification for the issuance of a modification to extend a Task Order (TO) under an Exception to Fair Opportunity pursuant to Revolutionary FAR Overhaul (RFO)-2025-16 Federal Acquisition Regulation (FAR) 16.5.
a. Identification of Agency and Contracting Activity:
Agency:
GSA AAS acting in support of the Deputy Assistant Secretary of Defense (DASD) for Military Community and Family Policy (MC&FP)
Contracting Activity:
GSA AAS Contracting Office (QFAE) 1900 E Street, NW Washington, D.C. 20415
b. Nature and/or Description of Action Being Approved:
The MC&FP and AAS Contracting Office propose to formally add Option Periods 3, 4, 5, and 6 to the current MODES Bridge TO which was awarded under the One Acquisition Solution for Integrated Services (OASIS) Unrestricted Pool 1 IDIQ contract vehicle and consists of Time-and-Materials (T&M) labor, Other Direct Costs (ODCs), and Long-Distance Travel CLINs, extending the performance from 22 October 2026 to 30 April 2027 if all options are exercised. The total estimated value for the additional option periods is .
On July 22, 2026, GSA AAS awarded MODES III Task Order #47QFCA26F0027 to DecisionPoint Corporation (DecisionPoint) under Solicitation 47QFCA26R0003. On September 2, 2026, a post-award protest for this solicitation was filed with the U.S.
Government Accountability Office (GAO). The protest was filed within the timeframe that triggers an automatic Competition in Contracting Act (CICA) stay under RFO-2025- 33 FAR 33.105-3. As a result, the timeline to transition performance from the MODES Bridge TO to the MODES III TO has been delayed up to 190 days, which includes the GAO protest period of up to 100 days and the required 90 days to transition to a new MODES III awardee, if applicable.
Due to this delay, AAS has determined that an extension of the MODES Bridge TO with the incumbent contractor is necessary to ensure that critical services are maintained. The MODES Bridge TO is being performed by Miracle Systems LLC (Miracle Systems). All current MODES Bridge option periods have been exercised and the TO is set to expire on October 21, 2026. The proposed extension is necessary to maintain the services currently provided. A delay or lapse in the critical Outreach and Engagement (O&E) support for U.S. military service members and their families.
The extension will ensure continuity of services for MC&FP, provide for a sufficient timeline for resolution of the MODES III post-award protest, and allow for the required 90 days for a seamless transition of the respective services. GSA AAS has structured Option Period 3 - Option Period 6 to limit the total extension period to the shortest time necessary to resolve the protest and complete the transition from MODES Bridge to MODES III. GSA AAS will only exercise the option period(s) necessary to complete this process.
By approval of this action, the MODES Bridge contractor shall continue to provide the required support in accordance with the PWS as outlined in Section C of the current MODES Bridge TO. All required MODES Bridge services currently being performed are required during the proposed extension.
c. Description of Supplies/Services and Estimated Value:
The MODES Bridge TO is a performance-based TO that entails the performance of complex professional services. The scope of this TO is to provide support for all MC&FP O&E activities, programs, policies, and resources including stakeholder affairs, strategic communications and analysis, Content and Creative Services (CCS), digital strategies, and community and public engagement. The contractor is required to provide support for all IT and cybersecurity disciplines and activities that are necessary to maintain the continuity of O&E operations. The transformation, modernization, sustainment, and enhancement of the MC&FP IT Enterprise are necessary for the O&E operations to function. The contractor is required to provide TO program management, O&E support, and IT and cybersecurity enterprise support, including operations, maintenance, modernization, and sustainment as well as cloud migration, transition execution and long-distance travel anticipated to be required in support of this effort.
The total estimated value for the extension including all option periods is .
Below is the estimated life-cycle costs per CLIN and period of performance:
satisfy the requirements identified in the Performance Work Statement (PWS). The contractor shall use the MC applications to obtain MC&FP assignments, report progress, maintain workflow transparency, obtain MC&FP approval on completed assignments, record time spent, and document deliverables. The contractor shall provide status updates and weekly reports, for these optional activities as directed by the Government, utilizing the MC&FP TAR.
Task 2: Provide O&E: The contractor shall provide support for all O&E activities, including stakeholder affairs, strategic communications and analysis, CCS, digital strategies, and community and public engagement. The contractor shall leverage data analytics to forecast potential challenges and opportunities with the goal of maximizing the effectiveness and outcomes of the O&E activities. The contractor shall provide detailed reporting on the ongoing O&E initiatives, progress against strategic goals, and any emerging issues or opportunities with recommendations for addressing them while remaining aligned with the goals of enhancing brand recognition and reputation.
Task 3: Information Technology (IT) And Cybersecurity Enterprise Support: The contractor shall provide comprehensive IT and cybersecurity support for the MC&FP IT Enterprise in both the Defense Information Systems Agency (DISA) and Amazon Web Services (AWS) GovCloud regions. The contractor shall provide full-scope system, application, network, storage, and security management support, as well as integration and maintenance support for new and existing features, functions, content, and components of the MC&FP IT environment. All contractor services shall be in support of cybersecurity enterprise support.
The extension will ensure continuity of services for MC&FP, provide for a sufficient timeline for resolution of the MODES III post-award protest, and allow for the required 90 days for a seamless transition of the respective services from MODES Bridge to
MODES III.
d. Identification of the Exception to Fair Opportunity and Rationale:
This TO Justification is being prepared as required by:
RFO-2025-16 FAR 16.507-6, Exceptions to Fair Opportunity
1.
providing a fair opportunity would result in unacceptable delays (RFO-2025-16 FAR 16.507-6(b)(1)).
The MODES Bridge TO contractor, Miracle Systems, is the only source with the requisite technical knowledge of the operations to support the mission without an extensive learning curve
The current MODES III contractor, DecisionPoint, has suspended performance under the CICA stay. An extension of the current MODES Bridge TO will ensure continuity of services for MC&FP, provide for a sufficient timeline for resolution of the MODES III post-award protest, and allow for the required 90 days for a seamless transition of the respective services. Without issuing an extension of the current MODES Bridge TO, the delays as outlined above in section b., will cause
Bridge TO contractor continue services without interruption. The continuation of these services is needed to deliver support to MC&FP encompassing all O&E activities, programs, policies, and resources including stakeholder affairs, strategic communications and analysis, CCS, digital strategies, as well as military community engagements. Delay or failure to provide these services could impact the ability of MC&FP to achieve its overarching mission for the military community.
The period of performance for the MODES Bridge TO currently providing these services expires on October 21, 2026. The TO was awarded to Miracle Systems on the OASIS Unrestricted Pool 1 IDIQ contract vehicle. While the OASIS Unrestricted Pool 1 contract vehicle expired on March 1, 2025, this extension is a continuation of the services currently being provided2. Additionally, as the MODES Bridge TO was awarded to provide continuity of services while the competitive MODES III action was awarded, it is appropriate and more expeditious to extend the current MODES Bridge TO rather than award a separate stand-alone bridge contract.
It is essential for service members, their families, survivors, supporting service providers, and the broader support network of a service member to be informed about and have continued access to quality-of-life services and resources. These services should be globally available and easily accessible through reliable outreach and communication channels. MC&FP has developed a comprehensive portfolio of O&E services and digital resources available to the military community. Disruption of TO services currently provided, would compromise the essential role of MC&FP.
An extension to the MODES Bridge TO will enable MC&FP to carry out mission-critical services without delay and allow for transition-in to the awardee of the competitive MODES III action, following resolution of the protest.
If additional competitive procedures are used in place of an extension to the MODES Bridge TO, the estimated delay would result in a lapse in MODES services. Therefore, extending the MODES Bridge TO prior to its expiration in October 2026 is the only feasible and practical alternative.
e. Determination That the Anticipated Cost is Fair and Reasonable:
to determine if the additional option periods are proposed with labor categories and at rates consistent with those originally proposed, evaluated, and awarded for the MODES Bridge TO and its extension under Modification P00010, that the level of effort and the mix of skills available for the tasks is realistic for the work to be performed, and that the with RFO-2025-16 FAR 15.404-1. Award of the resulting TO modification will not be made until the CO has the OASIS term expires as long as the final task order option period does not extend the cumulative term of the task order beyond 5 years after the OASIS term expires. After the OASIS term expires, OASIS will remain an active contract until the final task order is closed-out and shall govern the terms and conditions with respect to active task orders to the same extent as if it were completed during the OASIS term. Accordingly, the cumulative term of all
