JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

UNDER IDIQ CONTRACTS

SOLICITATION 47QFCA19R0024

INTERAGENCY AGREEMENT NUMBER

The General Services Administration (GSA) makes this Justification for the issuance of an Exception to Fair Opportunity order pursuant to Federal Acquisition Regulation (FAR) 16.5.

a. Identification of Agency and Contracting Activity:

Agency:

General Services Administration (GSA) Federal Systems Integration and Management Center (FEDSIM) Acting in support of: 480th Intelligence, Surveillance, and Reconnaissance Wing (480 ISRW) and Air Combat Command (ACC) subordinate organizations

Contracting Activity:

GSA FEDSIM Contracting Office (QF0B) 1800 F Street, NW Washington, D.C. 20405

b. Nature and/or Description of Action Being Approved:

FEDSIM Contracting Office, in support of the 480 ISRW and ACC subordinate organizations that were supported by Booz Allen Hamilton (BAH), proposes to award a sole source Cost Plus Fixed Fee (CPFF) Task Order (TO) to provide subject matter expertise and Intelligence, Surveillance and Reconnaissance (ISR) support, to BAH, under the One Acquisition Solution for Integrated Services (OASIS) Unrestricted Pool 1.

Throughout this justification document references to “ACC subordinate organizations” refers to only those ACC subordinate organizations currently supported by BAH contractor personnel.

The 480 ISRW TO will be awarded No Later Than (NLT) May 19, 2019. This sole source TO will maintain support for 480 ISRW and ACC subordinate organizations to allow for transition to the recently competitively awarded ACC ISR Enterprise TO. The ACC ISR competitively awarded TO consolidates support covered by this contract, as well as services covered under other contracts and new work. A break in service will result in 480 ISRW and ACC subordinate organizations losing critical knowledge or personnel providing ISR analysis. The contractor is responsible for continuously researching, analyzing, and assessing new Irregular Warfare (IrW) threats in operating environments throughout the world where U.S. and partner nation forces deploy. Without this critical wok, military units would deploy to theater without sufficient training to combat the dangers they will encounter.

This sole source TO seeks to definitize the letter contract (47QFCA19F0052) awarded on April 19, 2019. The letter contract provides time for proper documentation and planning to take place. The proposed Period of Performance (PoP) of the TO is a three-month base period from April 2019 through July 2019, with an estimated value of as well as four, one-month option periods with an estimated value of each. The total estimated value of this TO is (inclusive of the letter contract).

The 480 ISRW and ACC subordinate organizations requirements were captured in the recent AF ACC ISR Enterprise TO that was awarded on March 15, 2019. This TO has been protested and is under a Competition in Contracting Act (CICA) stay which has suspended all performance on the TO until resolved. The 480 ISRW and ACC subordinate organizations’ requirements were previously supported under 25th Air Force (25 AF) contract GS00Q17AJC0032, which was awarded to BAH.

This 25 AF contract was awarded by GSA FEDSIM and it includes the following Contract Line Item Number (CLIN) types: CLIN 0001 Labor, CLIN 0002 Travel, and CLIN 0003 ODCs. The 25 AF contract awarded ceiling value is and the PoP was September 22, 2017 through April 21, 2019. The 25 AF contract reached the contractual ceiling value on April 21, 2019, and FEDSIM issued a letter contract for continued performance. In short, due to the protest and its associated CICA stay, 480 ISRW and ACC subordinate organizations will not be receiving ISR support from the recently awarded competitive TO, until the protest has been resolved. Additionally, the 25 AF contract ceiling could not be increased and the contract could not be extended past April 21, 2019, at which time 480 ISRW and ACC subordinate organizations lost the time-sensitive ability to provide critical operational ISR support to the warfighter.

c. Description of Supplies/Services and Estimated Value:

The purpose of this sole source TO is to provide subject matter expertise and Intelligence, Surveillance and Reconnaissance (ISR) support for the 480 ISRW and ACC subordinate organizations’ ISR requirements which are currently supported under the existing 25th Air Force (25 AF) contract. This TO will provide the 480 ISRW and ACC subordinate organizations with assessments/analyses of ISR-relevant information which identify and analyze emerging threats and provide potential capabilities the United States (U.S.)

military can utilize to combat these threats. These ISR activities include, but are not limited to, ISR training support, Information Operations (IO) activities; technical and operational geospatial analysis activities; Full Motion Video (FMV) processing;

Processing, Exploitation and Dissemination (PED) of ISR; and crypto-linguist support to combat operations. The end state of this TO is to bolster the U.S. security interests and positions, both at home and abroad, and to protect forces from emergent threats.

Specifically, the 480 ISRW and ACC subordinate organizations require continued contractor support to fulfill the following tasks currently being supported through the existing 25 AF contract:

The estimated value for Labor, Travel, Other Direct Cost (ODC) and Contract Access Fee (CAF) required to provide the 480 ISRW and ACC subordinate organizations continued ISR support is provided below:

d. Identification of the Exception to Fair Opportunity and Rationale:

This Justification is being prepared as required by:

FAR 16.505, Exception to Fair Opportunity Process The rationale is:

The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays (FAR 16.505(b)(2)(i)(A). These delays significantly increase the risks for mission failure and the potential loss of life of U.S. Armed Forces personnel conducting operational missions in active combat zones.

The 480 ISRW and ACC subordinate organizations are the Air Force lead for globally networked ISR operations which directly support the warfighter, provides ISR enterprise-produced intelligence that supports requirements spanning the full spectrum of conflict such as Overseas Contingency Operations (OCO), humanitarian assistance/disaster relief operations (HA/DR) and irregular warfare, counterterrorism operations, major regional conflict, and counter-insurgency (COIN) operations, provides defense policymakers and force planners in the DoD and the Intelligence Community with intelligence in support of U.S. Air Force planning and operations. In support of that mission, the 480 ISRW and ACC subordinate organizations have been leveraging BAH’s on-site support under the 25 AF contract to provide support for its ISR requirements. The on-site 25 AF contract support for the 480 ISRW and ACC subordinate organizations’ current ISR requirements requires BAH to provide experienced, qualified, and appropriately cleared subject matter experts to ensure mission requirements are fully supported. The 480 ISRW and ACC subordinate organizations’ current 25 AF contract support continues to be driven by the threats impacting its mission, operational environment and the Warfighter.

Minimized Transition Risk: Although the ACC ISR Enterprise TO has been competitively awarded to Leidos, Inc., the ACC ISR Enterprise TO necessitates the award of the subject sole source TO to BAH on the particular tasks that it was previously performing. The Leidos TO includes a requirement for a 90-day transition period. Leidos cannot accomplish an effective transition without working with the outgoing contractor, BAH. There must be contractual overlap to facilitate knowledge transfer between outgoing and incoming contractors.

However, in a more immediate way, the newly awarded Leidos TO necessitates the subject sole source award to BAH because a bid protest has been filed by BAH against the award. A CICA stay of performance has been issued to Leidos. So, despite the fact that a competitive award has been made, the AF will remain without support from the order until the protest is decided. The letter contract with BAH maintains continuing contract coverage for the AF until the protest is decided.

In summary, the agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays (FAR 16.505(b)(2)(i)(A). These delays significantly increase the risks for mission failure and the potential loss of life of U.S.

Armed Forces personnel conducting operational missions in active combat zones.

e. Determination That the Anticipated Cost is Fair and Reasonable:

FEDSIM will compare the labor rates, hours, and costs for the sole source TO with the actual hours and costs being incurred under the previously awarded 25 AF contract (GSC-QF0B-18-33214) for these services. Based on the data gathered, the Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable. The expectation of reaching a fair and reasonable price will be determined through analysis of proposed labor rates and materials and through a price analysis of BAH’s proposed price for the sole-source task order in order to determine best value for 480 ISRW and ACC subordinate organizations. The total amount of funding required for the total estimated period of 7 months (if all options are exercised) is approximately

f. Other Facts Supporting the Justification:

All relevant facts have been identified and discussed elsewhere in this justification.

g. Statement of Actions:

Actions have been taken to ensure the removal of barriers that led to the Government using other than full and open competition procedures for the sole source contract for this requirement. FEDSIM competitively awarded the ACC ISR Enterprise TO which will consolidate all of ACC’s operational ISR requirements which is currently under protest.

Once the protest concludes, the ACC ISR Enterprise TO will resume with the transition-in actions to provide consolidated ISR support to ACC and its subordinate organizations.
