Performance Work Statement (PWS) Loan File Review for Risk Oversight Support Services Office of Capital Access (OCA)/Office of Credit Risk Management (OCRM)

BPA Contract Number: [00000000] Solicitation Number: [000000] Amendment: [0000]

This Performance Work Statement (PWS) describes the firm‑fixed‑price services the contractor shall provide under this contract/blanket purchase agreement (BPA) to support SBA’s loan file review and risk oversight activities for 7(a) and 504 lenders. All tasks, outcomes, and deliverables identified in this PWS shall be ordered and compensated exclusively through the Contract Line Item Numbers (CLINs) set forth in Section B, which establish the applicable firm‑fixed‑price units (for example, per‑file review, per report, or per transition effort) for each defined scope of work. Offerors shall ensure that their technical and price proposals clearly align proposed approaches and prices with the corresponding CLINs

1. Purpose The contractor shall provide file review services to support OCRM's supervision of 7(a) Lenders and Certified Development Companies ("SBA Lenders") participating in the 7(a) and 504 Loan Programs. All services shall be provided under the supervision of an OCRM employee.

The contractor's services may be provided as part of a risk-based review, examination, audit, increased supervision, or enforcement action.

NOTE: Blanket Purchase Agreement (BPA) Performance Work Statement and Terms and Conditions are effective on all Task Orders.

2. Performance Work Statement Overview This Performance Work Statement describes the required outcomes and performance standards for loan file review and related risk oversight support services. The contractor shall furnish all labor, supervision, management, equipment, materials, facilities, and other services necessary to perform the requirements of this PWS, except as otherwise specified. Performance will be evaluated based on the quality, timeliness, and completeness of the deliverables identified herein and in individual Task Orders.

The contractor shall provide SBA with risk oversight services assistance; access to a virtual data warehouse, preferably with customer relationship management (CRM) and management workflow system (MWS) capabilities; and technical assistance in accordance with the general scope outlined herein. The contractor shall provide SBA with a detailed description of its proposed methodology for review, coordination, tracking, and follow-up as well as its plan for implementing its methodology for all tasks identified. The contractor is expected to work collaboratively with SBA employees, including OCRM, the Office of General Counsel (OGC), the Office of Performance Systems Management (OPSM), and the Office of Financial Program Operations (OFPO).

This PWS applies to the BPA and all orders issued under it. Each Task Order will identify the applicable tasks, volumes, and deliverables for that order.

3. Background OCRM's supervision of SBA Lenders participating in the 7(a) and 504 Loan Programs requires the review of judgmentally or randomly selected loans. Timely file review activities that result in reliable and defensible conclusions are critical to maintaining the integrity of the 7(a) and 504 Loan Programs as the activities assess an SBA Lender's continuing ability to evaluate, process, close, disburse, service, liquidate, and litigate SBA guaranteed loans which assists OCRM with identifying, assessing, and managing credit program risk.

The contractor shall ensure its operations are scalable, subject to continuous improvement, able to adapt to changes in SBA Loan Program Requirements, as defined in 13 CFR § 120.10, increasing loan volume, and increasingly sophisticated and complex loan files.

File review activities are routinely performed away from SBA headquarters, an SBA field office, or the SBA Lender's physical location. However, circumstances may require the review team to work at SBA headquarters, an SBA field office, or an SBA Lender's location for up to five business days. Instances where file review must be conducted at SBA headquarters, an SBA field office, or an SBA Lender's location are rare.

The file review services are commonly referred to as "loan review" and shall assess the overall compliance of individual loans with SBA Loan Program Requirements, as defined by 13 CFR § 120.10. The results of the individual loan files are aggregated and combined with other review activities to determine the risk an SBA Lender presents to the SBA.
