PROCUREMENT DESCRIPTION
This acquisition is being procured in accordance with the Brooks Act as implemented in FAR Subpart 36.6. This procurement is set-aside for Small Business concerns.
The Brooks Act (Public Law 92-582), also known as Qualifications Based Selection (QBS), which was enacted on October 18, 1972, establishes the procurement process by which a firm is selected for award of a federal government contract to perform architect/engineer (A/E) services.
The Brooks Act establishes a qualifications-based selection process, in which contracts for A/E services are negotiated on the basis of demonstrated competence and qualification for the type of professional services required at a fair and reasonable price. Under QBS procurement procedures, price quotations are not a consideration in the selection process. There are seven basic steps involved in pursuing federal design work under QBS:
1. Public Announcement The request for qualifications solicitation will be posted in Federal Business Opportunity (FedBizOpps).
2. Statements of Qualification A/E firms with an interest in being considered for design services contracts must submit written information in response to the Phase 1 factors in the solicitation.
3. Evaluation of Submissions GSA will review the written information submitted in response to the solicitation Phase 1 factors in the Fed Biz Opportunity notice.
4. Development of a Short-list (Phase 1) Following the evaluation of the written information submitted in response to the solicitation Phase 1 factors, GSA will rank the most highly qualified firms to continue with the interview process, Phase 2.
5. Interviews with Short-list Firms (Phase 2) The shortlisted lead designers and associated A/E firms will be notified and asked to submit more detailed information indicating each member of the design team, including all outside consultants.
Sufficient time will be provided for the lead designer and associated A/E design firm to establish its team. The firms will be required to complete Standard Form 330 Architect Engineer Qualifications Parts I and II that reflect the entire design team. The government will establish the detailed evaluation criteria and the date that these submittals are due and provide the selection criteria for the interviews along with the Phase 1 shortlist announcement.
The board will interview each team. Candidates should be prepared to discuss all aspects of the criteria indicated above and evaluation criteria as established for Phase 2, and demonstrate their ability to fulfill all project requirements. Emphasis will be placed on the lead designer-A/E team’s understanding of the unique aspects of the project, their design philosophy, project management process, and quality assurance plan. Responses to the evaluation criteria and interview questions will be used to rank the Lead Designer A/E Teams.
The interviews will be held at the agency’s office in person with the A/E firm or with the A/E firm participating via video teleconferencing as agreed by the Government and the A/E firm. The selected firms are allowed up to 45 minutes each for the interview.
6. Recommendation for Negotiation and Award Following its evaluations for Phase 1 and Phase 2, GSA will select for negotiations for award of a contract under this solicitation.
The negotiations will be conducted pursuant to the procedures set forth in FAR 36.606. The government will negotiate the hourly rates for the A/E firm’s disciplines. Proposed fees will be compared to an Independent Government Estimate to determine price reasonableness, realism, and balance. If a firm’s pricing determined to be unreasonable, unrealistic, or unbalanced, that firm may be removed from consideration, and the next most highly qualified firm will be considered.
GSA shall select the most highly qualified rated firm for award that has reasonable, realistic, and balanced pricing.
To be eligible for contract award, a firm must be registered in the System for Award Management at http://www.sam.gov.
SCOPE OF WORK
The scope of professional services will require at a minimum: professional architectural, engineering, interior design, landscape architecture, and related consulting services for concept concept design documents, design development documents, construction documents, specifications, cost estimates, value engineering services, computer-aided design and drafting (CADD), and post-construction contract services (PCCS) for Building 53 that includes the abatement of hazardous materials, repairing structural and architectural deficiencies, modernizing building systems to create an efficient and comfortable working environment, and improving interior spaces to allow for backfill with federal agencies. Space alterations shall support each department’s mission of excellence by developing a gathering place that facilitates a rich professional and community life. The interior space plan should achieve optimal efficiencies in the use and organization of spaces, circulation and core functions. Daylighting strategies such as skylights and floor penetrations created by modification of the roof and floor structure should be considered to bring additional light into the core of the building. Enclosed offices, conference spaces, huddle rooms, and phone booths that require walls shall be placed near the core so that natural daylight will not be blocked. Glass walls and partitions can be used to transmit light. Each directorate’s program will determine the number of conference spaces, huddle rooms, phone booths, reception areas, etc. New enclosed offices, meeting rooms, etc.
will be required. This can be achieved by fixed hard walls or demountable walls. The project is also to include GSA design standards for secure facilities; conformance to the P100 (Facility Standards for Public Buildings), including LEED certification; and customer agency requirements.
CONTRACT DESCRIPTION
A single firm fixed price contract will result from this solicitation.

(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples.
(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has o has not o, within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) “Principal,” for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
This Certification Concerns a Matter Within the Jurisdiction of an Agency of the United States and the Making of a False, Fictitious, or Fraudulent Certification May Render the Maker Subject to Prosecution Under Section 1001, Title 18, United States Code.
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror’s responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an https://acquisition.gov/far/current/html/52_207_211.html#wp1144964 erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
