About this file

This document is a Justification for Other Than Full and Open Competition (JOTFOC) for a contract to repair or replace an electrical command module panel at the Federal Bureau of Investigation (FBI) Houston Field Office.

The contract will be awarded to Melton Electric, Inc. as a Firm Fixed Price contract for construction services to repair or replace the damaged electrical panel. The repairs are deemed urgent due to limited use of interior office lighting and the need to bring the system back into compliance. Melton Electric is the original subcontractor that installed the panel and has the necessary clearances and familiarity with the project to complete the work quickly. The anticipated cost is deemed fair and reasonable based on an Independent Government Estimate. No additional market survey will be conducted due to the urgent nature of the repairs.

JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

1. Prepared by: The General Services Administration, Public Buildings Service, Greater Southwest Region, Non-Prospectus Projects Branch (7PQC).

2. Identification and description of action being approved: This is a new contract for the repair/replacement of an electrical Command Module panel located at the Federal Bureau of Investigation (FBI) Houston Field Office; 1 Justice Park Dr., Houston TX 77092 (TX0435HF). This will be issued as a Firm Fixed Price contract to Melton Electric, Inc.

3. Description of supplies or services required: Construction services for the repair/replacement of an electrical Command Module panel at the FBI Houston Field Office. Project is estimated to be around . GSA will issue out a request for quote to Melton Electrical, Inc.

4. Identification of statutory authority: 41 U.S.C. 3304(a)(3), Unusual and Compelling Urgency (FAR 6.302-2).

5. Demonstration that the acquisition requires use of the authority cited: FBI Houston requires the repair/replacement of the electrical panel that was damaged after it is believed that the O&M contractor set the panel in the wrong sequence. The Government has spent over 2 months investigating the reason how the damage happened. This panel had just been installed by Melton Electric as a subcontractor on a separate project. The FBI Houston is in immediate need to fix it to continue critical operations. The repairs are urgent due to the limited use of interior office lighting in the building. The contractor has the system on bypass allowing for use of the lighting, but the building is out of compliance for energy usage and utilities. The repairs need to be complete to bring the system operational and prevent any further damage.

6. Description of efforts to solicit as many offers as practicable: Due to the limited time frame in which to procure the construction services to continue FBI operations, the contractor named above will provide all the services required. There are several firms that can perform the work required by this project; however, none of those firms would be capable of being solicited, mobilizing, obtaining clearances, and completing the work in an urgent manner. Melton Electric is a local contractor, and this company is the original sub-contractor that installed the panel that needs to be repair. Melton currently is very familiar with the project, and they currently have FBI clearance to work in the building. Melton understands the urgency the FBI has in the repair effort and is, therefore, considered to be the most capable and advantageous method for accomplishing this work.

7. Demonstration that the anticipated cost will be fair and reasonable: The subject contract will be awarded on the basis that the price is determined fair and reasonable when examined by the GSA Project Manager and Contracting Officer, as compared against the Independent Government Estimate (IGE).

8. Description of the market survey conducted: A market survey will not be conducted for the reasons stated in number 6 above.

9. Other facts supporting the use of other than full and open competition: None.

10. List of sources that expressed an interest in the acquisition: Melton Electric, Inc.

11. Statement of actions to overcome barriers to competition: This unforeseen occurrence (other
