All the contractor’s labor hour prices must include expenses for overhead, General and Administrative (G&A) and profit. Thus no separate allowance for travel time, parking, overhead, G&A or profit will be applied when hourly services are ordered.

Offeror must submit offers for all locations in order to be considered for award. Offerors must submit prices for all four of the option periods, in addition to the initial period, to be considered for award. Options shall be priced using the wage determination contained in this solicitation. Upon exercising a renewal option, the contract price will be adjusted in accordance with FAR 52.222-43 Fair Labor Standards Act and Service Contract Labor Standards—Price Adjustment (Multiple Year and Option Contracts) (May 2014).

Offerors should visit the building and become familiar with existing conditions; examine all contract documents relating to this work, and carefully review the requirements contained in this specification.

Offerors shall determine any conditions which affect the work and make a thorough site investigation before submitting an offer. No allowances will be made for failure of an offeror to avail themselves of such information.

Note 1: The number of hours of overtime and additional services is for evaluation purposes only and is based on an estimate of the Government’s anticipated need for such service.

Note 2: Offerors are cautioned not to confuse overtime services with above standard services. Repairs, within the scope of this contract are above standard services. Overtime services are defined as work within the scope of the contract originally intended to be performed during normal working hours, where the Government requests the work be performed outside of normal working hours to expedite the return the equipment to operating condition or to minimize disruption to tenants. Overtime services are not included within the scope of this contract but may at some time become required.

Note 3: Quote a price per hour for providing Above Standard Services (repair services) when ordered that are in addition to the services specified herein for the standard services. Ordered repairs may be placed orally when the amount of the order totals $2,500.00 or less or in the event of an emergency. All orders which exceed $2,500.00 must be placed or confirmed by issuance of a GSA Form 300, Order for Supplies or Services and will be paid by GSA Finance. The GSA Form 300 will describe the service to be provided and will establish, excluding emergencies as determined by the Contracting Officer (CO) or the Contracting Officer’s Representative (COR), the maximum number of hours for which the contractor will be compensated. Orders of $2,500.00 or less may be processed using the Government wide commercial purchase card, which is the preferred method to purchase and to pay for micro purchases. Individual orders for above standard services involving more than forty (40) hours will only be issued with the assent of the contractor. This repair provision is intended to be used to satisfy the Government's short term non-recurring needs for service. Should a continuing need for additional service arise, a contract modification will be negotiated pursuant to the "Changes Fixed Price" clause. Above standard services cannot be accomplished by diverting resources from work that is supposed to be accomplished. Repair services under this contract are above standard services as defined below.

C.4. Government Quality Assurance Surveillance Program The Government may inspect the Contractor using a quality assurance program through random inspections, scheduled inspections, or any other method of inspection that the Government determines reflects the actual successful performance of this Contract. As part of the Government’s quality assurance program, the Government may:

1) Review and, if warranted, reject any reports or other submittals required from the Contractor.

2) Review performance and service records, including, if applicable, but not limited to monthly progress reports and any computerized or hardcopy records maintained by the Contractor documenting performance under this Contract, and require correction of any unsatisfactory conditions noted.

3) Determine the adequacy of the Contractor’s quality control program and documentation and the overall success of this program. The Government may order improvements if it determines the programs are insufficient or ineffective.

4) Obtain tenant satisfaction survey information and require improvements in service on the basis of such information to the extent such results correlate with deficiencies in Contract requirements.

5) Conduct random and routine physical inspections of facility equipment and systems, to include programs and files maintained on computers and Contractor onsite offices and work areas, and require correction of deficiencies noted.

6) Perform inspections with Government personnel or independent third party inspectors.

C.4.1 Contract Performance Contractor performance will be evaluated on the basis of the performance success or deficiencies, success or failure in meeting other Contract requirements, and the Contractor’s record of correcting deficiencies when noted. While corrective actions will be noted, a record of significant performance deficiencies may lead to a performance evaluation that is less than satisfactory even if the Contractor takes corrective action.

C.4.2 Methods The use or nonuse of any quality assurance methods [e.g., a measurement and verification (M&V) program] by the Government will not constitute a waiver of or excuse from Contract requirements. The Government may implement or change quality assurance measures at any time during the term of the Contract.

C.4.3 Cooperation – Inspections The Contractor shall instruct all onsite personnel to cooperate with the Government or third party Contract inspector requests for records access and information. This includes answering honestly and comprehensively all questions related to performance of work.

C.4.4 Contractor Performance Assessment Reporting System (CPARS) GSA uses the CPARS or similar performance measuring system to formally evaluate the Contractor’s performance. Evaluations are generally conducted annually or more frequently on or about the anniversary date of the Contract and also at the end of the Contract period.

C.5. Maintenance and Preventive Maintenance The Contractor shall establish an effective system for scheduling and performing scheduled maintenance and preventive maintenance on all equipment and systems covered under the scope of this Contract. The Contractor shall submit this system to the CO or designee, as the specific maintenance standard or guide describing the preventive maintenance procedure and frequency (see Section C.5.1, Maintenance Standard, below), for approval within 5 days prior to Contract start date.

The contractor shall perform Preventive Maintenance in accordance with Gunnebo SpeedStile FLS Operations and Maintenance Manual and the sample preventive maintenance checklist included in the specification as Exhibit 3. Refer to https://gunnebo.com.au/ccmwp/wp-content/uploads/2017/10/SpeedStile- FLs-OM.Manual.pdf. Where frequencies are not clearly defined by the manual, all maintenance and preventive maintenance will be performed quarterly for the duration of the contract term.

C.5.1 Maintenance Standard As part of the Contractor’s established system for scheduling and performing scheduled preventive maintenance (See C.5, above), the Contractor shall propose to the CO or designee, preventive or predictive maintenance standards or guides for equipment where the manufacturer/designer recommends preventive maintenance. Minimally, the preventive or predictive maintenance standards or guides proposed by the Contractor shall be based on; manufacturer’s recommended maintenance (See Operations and Maintenance Manual referenced in C.5 above).

C.6. Service Request The Contractor shall manage all service calls associated with the work required under this contract. Service request are considered basic services and require acknowledgement of receipt by the Contractor within 2 hours of placement by the CO or COR. That activity includes the intake of calls, dispatching, documenting and reporting. The calls will be generated by the CO or designee during normal working hours. The Contractor will input, track and maintain service request records in an acceptable electronic format as required by the CO or their designee.

The Contractor shall respond to service requests during normal working hours. The Government may transmit work orders to the Contractor for service request verbally or by email. The Government shall create a work order or generate an automated work order. The Contractor shall respond promptly and in accordance with the response times specified herein. The Contractor shall acknowledge service request by email or by phone within 2 hours of the request.

The Contractor shall respond promptly to service requests (i.e. swing door failures, indicator light board failures or doors offline) and complete the required work within 24 hours, during normal business hours, from the time of notification. The Contractor shall immediately notify the CO or their designee if the routine service call cannot be completed within the specified timeframe. If the service call is of an incidental nature, such as swing door failures, and the service call cannot be resolved within 1 business day for any reason, the Contractor will complete the call the following business day.

C.6.2 Emergency Service Request Emergency service requests are service requests where the work consists of correcting failures that constitute an immediate danger to personnel or property, including but not limited to: total system outage.

The Contractor shall respond to emergency service requests immediately, but no more than two (2) hours from the time of notification. The Contractor shall remain on the job until the emergency has been resolved or adequate temporary repairs have been made. If the emergency cannot be fully resolved, the Contractor must notify the CO or designee and provide as part of the service call.

C.7. Repairs

C.7.1 General The Contractor shall perform repairs as described in this document. Repairs will be identified as single incident, not an accumulation of various repairs (bundling). Repairs shall only be performed during normal operating hours of the building and are not to be considered overtime services at any time. If damage is caused by Contractor negligence, the Contractor shall be liable for the full cost of repair, any other provisions notwithstanding.

The Contractor shall not use subcontractors to perform repairs unnecessarily or with the intent of driving up the repair cost. If approved, the cost of the subcontractor will be treated as a repair part and material cost for the purposes of cost evaluation. The subcontractor's cost shall be appropriate and approved in advance by the CO or designee. All repairs shall use supplies, materials, and parts of the highest quality available that are appropriate for the repair of the pass gates. Any replacement parts used during the course of this Contract shall all in no way compromise the Gunnebo Warranty. During the term of this contract it is the Contractor’s responsibility to verify active warranties or guarantees. The Contractor must not remove any parts on the equipment, unless authorized by the CO or their designee. The Contractor shall stock commonly used items and have a network of suppliers that will deliver ordered items without any delay.

Refer to the Gunnebo SpeedStile FLS Operations and Maintenance Manual.

C.7.2 Approval of Work When the Contractor determines that a repair is needed the Contractor shall immediately notify the CO or designee. The CO or their designee shall issue an order to the Contractor before the Contractor may proceed with the repair. The Contractor may defer performance of the reimbursable repair by placing the corresponding work order into a “waiting for funding” status from the time a valid proposal is given to the CO or their designee until the time an order is given to the Contractor. The time during which the work order is thus deferred will not count against the Contractor in calculating timeliness. The Contractor shall provide justification to the CO or their designee for using subcontractors to perform work. The CO or their designee may prohibit the use of subcontractors if the CO or their designee determines the Contractor is unnecessarily driving up the cost of the work and the Contractor’s own employees have the skills necessary to perform the work.

SECTION E – INSPECTION AND ACCEPTANCE

E.1. FAR 52.246-4 Inspection of Services – Fixed Price (Aug 1996)

Inspection of Services—Fixed-Price (Aug 1996)

(a) Definition. “Services,” as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.

(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the Government may—

(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and

(2) Reduce the contract price to reflect the reduced value of the services performed.

(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may—

(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or

(2) Terminate the contract for default.

E.2. Deduction Rate It is the objective of the Government to obtain complete and satisfactory performance in accordance with the terms of the specifications and requirements in this contract. To this end, the Government is contracting for the complete performance of each task identified in the specifications, and deductions may therefore, be made as stipulated in this Section. Deductions for work performed improperly may be made as though the work has not been performed. Inadequate performance is just as undesirable as nonperformance, and the cost of correcting inadequate performance may equal or exceed the cost of initial performance.

a. Calculation of Deductions The hourly rate to be used when calculating deductions is line item in Section B.1.1, Above Standard Services. The rate to be used will be the one in effect for the current period. This rate will be multiplied by the number of productive and administrative hours needed to complete the task as determined by the CO or their designee.

b. Withholding Monies for Non-submission of Reports If the contractor fails to prepare and/or submit acceptable reports as called for in Section C, within the required time frame, this may be construed to mean that the contract work has not been performed and the Government will withhold all payments until the required reports are satisfactorily completed and/or submitted to the CO or their designee.

c. Withholding Monies for Suspension of Work

In the event services are not provided or required by the Government because the building(s) is closed due to inclement weather, unanticipated holidays declared by the President, failure of the Congress to appropriate funds, etc., deductions may be computed as…
