PROJECT DESCRIPTION

Statement of Work (SOW) is issued by the Public Buildings Service of the United States General Services Administration (GSA), Southeast Sunbelt Region, Atlanta, GA, hereinafter referred to as the “Government”, to obtain Design-Build Services of an elevator company (also referred to as Offeror or Contractor) who shall be singularly responsible to satisfy the terms of the resulting contract.

This project shall provide design and construction services for the upgrades and replacements of the six (6) electric traction elevators located in the Clifford Davis-Odell Horton Federal Building in Memphis, TN. The work required is specified in attached Elevator Section 14210.

The Elevator Contractor shall provide all labor, materials, and equipment to successfully fulfill all requirements of this scope of work.

See Appendix A for specific Owners Requirements Project Type This is a Design Build project.

Project Goals and Objectives

GOALS:

The overall strategic project goal of the Elevator Contractor is to provide successful design and construction services for the elevator upgrades and replacements as specified in Section 14210 and noted in Appendix A (Owner’s Project Requirements).

OBJECTIVES:

Expedite execution of the Design-Build project delivery process in all phases. Successfully complete the project design and construction phases.

Project Delivery Approach Work shall be performed by a qualified elevator contractor who follows the Design-Build project delivery method. The elevator contractor is responsible for all submittals during Project Design phase as well as Construction services provided during the Project Construction Phase. The Elevator Contractor is responsible for all work performed by consultants during all phases. See Section 14210 under Qualifications for elevator contractor requirements.

Materials Design and construction work shall comply, as a minimum, with the latest edition and most restrictive of all applicable national and local codes and standards that govern this facility. Elevator design features shall be in accordance with the most restrictive of all applicable building code requirements.

GENERAL REQUIREMENTS

The requirements set forth in this section apply to all phases of the project as described in the Scope of Services section below.

Contract Parties and Contract Work The parties to this contract are the Contractor, hereinafter referred to as the Elevator Contractor, and the United States Government. For purposes of this contract, the office representing the Government is the General Services Administration (GSA), Southeast Sunbelt Region, Public Buildings Service, hereinafter referred to as the GSA.

The individual authorized to act on the behalf of the GSA in the administration of this contract is the GSA Contracting Officer. The GSA Contracting Officer may delegate certain of his or her authorities to others, and if so, will notify the Elevator Contractor in writing of the specific authorities delegated to, and limitations placed upon, named authorized representatives. The Elevator Contractor shall not take any direction, or act upon any information, from individuals other than those having the requisite authority as confirmed by the GSA Contracting Officer’s written notification.

This contract includes both Design Stage services and Construction Stage work, all to be performed by the Elevator Contractor. The Elevator Contractor shall proceed with the Design Stage services upon receipt of the GSA notice to proceed for that portion of the work. The GSA will issue a notice to proceed for the Construction Stage work upon completion of the Design Stage services and the GSA approval of all the Elevator Contractor equipment and design submissions.

The specific activities, tasks, and deliverables required of the Elevator Contractor are further delineated in this Statement of Work.

Professional Ethics and Standards of Practice In the conduct of all activities required for or otherwise related to the performance of the contract work, the Elevator Contractor shall conform to and uphold all established ethical principles and professional standards of practice governing the elevator contractor segment of the construction industry, including the International Union of Architects (UIA) Accord on Recommended International Standards of Professionalism in Architectural Practice, the American Council of Engineering Companies (ACEC) Ethical Guidelines, and the tenets of professional ethics contained in the Design-Build Institute of America (DBIA) Design-Build Manual of Practice.

Project Delivery Team Roles and Responsibilities In the performance of the requirements of this contract, the Elevator Contractor shall work in concert with other parties on the Project Delivery Team. The Project Delivery Team will include other contractors, the GSA personnel, and other stakeholders. The GSA will develop, periodically update, and maintain throughout the course of the project, a listing of the Project Delivery Team membership and respective roles and responsibilities.

The GSA may engage other parties to perform specialized duties and requirements as appropriate for the project.

Owner’s Project Requirements (OPR) The Design Stage services and Construction Stage work under this Statement of Work must comply with the GSA owner’s project requirements (OPR) documentation provided in Appendix A.

Budget The cost range for this project is $2,000,000 to $3,000,000.

Schedule

Anticipated Award Date: First Quarter FY2019

Equipment & Material Submittals for approval ----------------------- From Design Stage NTP for 120 days

Construction Substantial Completion ------------- Due 240 calendar days after Construction Stage NTP

Total time for Design Phase of the project is 120 calendar days which includes all equipment & material submittals and reviews. Total time for Construction Phase of the project is 240 calendar days from Notice to Proceed to Substantial Completion.

The Construction NTP may not be issued immediately after Design Phase completion. We have estimated there may be approximately 30 calendar days between completion of the Design Phase and Construction Phase NTP. Issuing the construction NTP will depend on delivery of new elevator equipment and security clearances.

Schedule delays: The Elevator Contractor will be responsible for any general conditions, extended overhead, and management costs resulting from work performed beyond the target date other than those resulting from Government initiated scope changes.

Elevator Contractor Team The Elevator Contractor shall provide experts in disciplines listed in PBS-P100, Facilities Standards for the Public Buildings Service, and otherwise required in this section, with credentials as indicated, as they apply to this project. The Elevator Contractor shall provide sufficient staff to perform the required work in a timely manner.

See FAR 52.236-5, Material and Workmanship, regarding removal of any employee deemed incompetent, careless, or otherwise objectionable.

See also FAR 52.244-4 regarding subcontractors and outside associates and consultants.

Performance Objectives Standards and Criteria Documents Applicability All services must be conducted in accordance with the documents listed below. The applicable version of each document shall be the version current at the time of award of this contract. In the event of a conflict between the requirements stated in these documents and requirements provided elsewhere in this Statement of Work, the requirements in the Statement of Work will prevail.

Attachment A – Electric Traction Elevator Specifications Section 14210

PBS-P100, Facilities Standards for the Public Buildings Service, including all applicable standards, criteria and guides listed therein. Design Stage submissions must comply with PBS-P100 Appendix A unless otherwise indicated in this Statement of Work.

Architectural Barriers Act Accessibility Standard (ABAAS)

Any conflicts or ambiguities within or among the referenced standards and criteria documents, or any deviations from requirements contained in the standards and criteria documents, must be reported to the GSA in writing, for determination as to applicability.

Sustainable Design/LEED® The GSA is committed to incorporating principles of sustainable design and energy efficiency into all of its building projects.

The contractor is responsible for incorporating the following sustainable design objectives in design and construction of this project.

1. Optimize Energy Use

2. Protect and Conserve Water

3. Use Environmentally Preferable Products

4. Enhance Indoor Environmental Quality (IEQ)

5. Optimize Operational and Maintenance Practices Green Purchasing Plan GSA is required to buy recovered materials as designated by the U.S. Environmental Protection Agency (EPA) through the comprehensive procurement guidelines (CPG). Information can be obtained about the EPA list of designated products and accompanying recycled–content recommendations on the internet at www.epa.gov/cpg. Additional requirements for use of bio-based, rapidly renewable content, and recycled content materials are as per P100 2010 page 94.

C&D Waste Management Requirements GSA's minimum requirement is to divert 50% of C&D waste from landfills/incinerators, with a higher goal of 70% diversion.

Miscellaneous Green Requirements In addition, the contractor shall provide a way that implements the following environmental objectives:

· Eliminate or reduce the generation of hazardous waste and the need for special material processing (including special handling, storage, treatment, and disposal)

· Promote the use of nonhazardous and recovered materials

· Realize life-cycle cost savings

· Promote cost-effective waste reduction when creating plans, drawings, specifications, standards, and other product descriptions authorizing material substitutions, extensions of shelf-life, and process improvements

· Promote waste reduction through the use of duplexing (two-sides copying and printing) and electronic communications Fire Protection/Life Safety Except as otherwise indicated in referenced programming documents, fire protection and life safety design requirements must comply with PBS-P100, Chapter 7. As provided in PBS-P100 Chapter 7, NFPA 101 is the primary applicable standard. In cases where NFPA is silent on an issue, and IBC addresses the issue, the IBC requirement will apply.

2.8.4 O & M Requirements

Operations and Maintenance (O&M) Contractor support: The contractor performing work shall ensure that their price includes cost for paying the O&M contractor personnel for all support on the project. Such support could include, but is not limited to, draining and filling of systems, escorting of contractor personnel (during and after hours), operating or restoring fire alarm systems where placing system in bypass is required, disabling and enabling points are required, setting a fire watch, operating electrical or HVAC systems, tagging out of systems, or any other activity where the O&M contractor personnel are required in order to sequence the project requirements. The O&M contractor hourly price for this support is annotated in the O&M contract bid and shall be provided by the O&M contractor Contracting Officer.

Cost Management Construction Cost Management This contract is for a Firm-Fixed price for design and construction services.

Project Management Responsibilities Communications Plan The Elevator Contractor shall assist GSA in developing and complying with a project communications plan. This plan will be used and maintained throughout the project and modified as necessary to suit each project phase.

The Elevator Contractor’s contractual responsibilities are to GSA only and not to other contractors, tenant agencies or local community interests where the project is located. The Elevator Contractor shall direct all questions and requests from tenant agencies and local community interests to the GSA. Prior to contacting any parties other than the GSA regional personnel, the Elevator Contractor shall confirm all meetings and/or communications with the GSA.

The Elevator Contractor shall not release any oral, written or graphic information regarding this project to outside sources without obtaining prior consent from the GSA. All requests for information concerning the project must be referred to the GSA for response.

All presentations to non-GSA entities must be first approved by the GSA.

Detailed Project Schedule Development and Maintenance The GSA overall project schedule is provided above in the Schedule section of these General Requirements.

The Elevator Contractor shall provide schedule updates to the GSA, showing progress on and completion of all required Design services (Submittals) and Construction work. If the schedule updates indicate that previously approved schedules may not be met, GSA will give immediate notice and request appropriate recommendations from the Elevator Contractor.

Refer to FAR 52.236-15 Schedules for Construction Contracts and to the Scope of Services Construction Delivery Phase section for additional schedule requirements.

Project Progress Meetings/Presentations During the Design Stage, the Elevator Contractor, GSA, and other stakeholders shall have bi-weekly conference calls to keep all parties apprised of the design phase progress/status as it relates to submittals, approvals, and equipment orders/deliveries.

After construction begins, the Elevator Contractor, GSA, and other stake holders shall continue the bi-weekly progress conference calls to keep all parties apprised of the construction phase progress/status and to discuss and resolve any project issues/concerns. The Elevator Contractor, GSA, and other stakeholders shall also attend any periodic site meetings during the construction phase that are set up on one of the bi-weekly conference calls.

Meeting Agendas, Attendance, Minutes and Correspondence

The Elevator Contractor representation at all meetings shall include those individuals having knowledge of the agenda topics and authority to make decisions and commit resources. .

Design Phase Quality Assurance The GSA will conduct reviews of all Elevator Contractor equipment and material submittals during the design phase of this project. During the reviews, the GSA will perform quality assurance that the equipment and materials submitted meet all the requirements of the SOW and Specification Section 14210.

Electronic/Print Media Electronic Documents All equipment and material submissions must be submitted in an electronic format. All electronic media must be in a form readable by standard office automation applications.

Other documentation required as needed:

Project Team Directory – Contractor shall provide an updated directory of contact information for all companies, subcontractors and project team members who are engaged on this project.

Schedules – Contractor shall provide schedule updates throughout the project. .

Contract Management – Contractor shall provide administration of all contract tasks related to the project.

Pay Applications Requests (Invoices) – The Contractor shall submit draft invoices for review by GSA. Once the invoices are approved by GSA, then the invoices should be submitted to GSA per the instructions given by the Contracting Officer.

Progress Photos – Contractor shall provide progress photos where appropriate.

Submittal Review Comments – Contractor shall provide and/or respond to review comments related to his/her role in the project team.

Request For Information (RFI) – Request for Information shall be provided and responded to by the Contractor.

Issue Tracking – Contractor to log and respond to issues that are related and affect other stakeholders within the project team.

Submittals –Contractor is responsible for providing submittal documentation and tracking the submittal process.

Change Management – Contractor shall be responsible for reporting potential changes and logging Requests for Change Orders. The Contractor shall also provide and manage all documentation supporting Requested Change Orders.

Shop Drawings – The Contractor shall provide all required shop drawings for review by GSA.

GSA reserves the right to require the Contractor to provide other documentation not mentioned above that is needed to support the project.

DB Contractor Personnel Security Requirements In the performance of work required under this contract, all Elevator Contractor personnel must present proper identification to gain access to occupied building areas housing federal operations. Elevator Contractor personnel refers to Elevator Contractor employees and subcontractor employees at all tiers.

Elevator Contractor personnel requiring daily/weekly access to occupied building areas housing federal operations, over a period of 180 days or more, shall undergo background investigations conducted by the United States Government, and will be issued Government-wide standard secure and reliable forms of identification issued by the federal Government (i.e., federal personal identity verification (PIV) credentials) as required under Homeland Security Presidential Directive-12 (HSPD-12). Credentialed Elevator Contractor personnel must wear their PIV credential cards visibly above the waist at all times while in occupied building areas housing federal operations.

All other Elevator Contractor personnel requiring access to occupied building areas housing federal operations will be issued visitor badges upon entry, must wear their visitor badges visibly above the waist, and must surrender their visitor badges upon exit.

All non-PIV credentialed Elevator Contractor personnel must be escorted at all times (including after hours) while in occupied building areas housing federal operations. The escort must be a PIV credentialed individual who has been found suitable after completion of the required background investigation. An exception to this requirement will be provided for Eevator Contractor personnel requiring daily/weekly access to occupied building areas housing federal operations, over a period exceeding 10 days but less than 180 days. These individuals shall undergo a law enforcement check. Those who receive favorable results will be granted unescorted access to specified building areas. Those who receive unfavorable results will be denied any access to occupied building areas housing federal operations, pending completion of any adjudication and/or appeal process or final determination.

Law Enforcement Checks and Background Investigations The GSA will designate a Department of Homeland Security (DHS) Federal Protective Service (FPS) representative to coordinate the required law enforcement checks and background investigations. The Elevator Contractor shall justify the need for and obtain the GSA approval of all requests for Elevator Contractor personnel law enforcement checks or background investigations, before initiating further action.

For each Elevator Contractor employee (including subcontractor employees) required to undergo a law enforcement check, the Elevator Contractor shall provide a legible ten-print fingerprint submission.

For each Elevator Contractor employee (including subcontractor employees) required to undergo a background investigation, the Elevator Contractor shall provide the following documents:

· A completed Questionnaire for Non-Sensitive Positions (Standard Form 85)

· A legible ten-print fingerprint submission

· A Declaration for Federal Employment (Optional Form 306) with items 1, 2, 8 through 13, 16, and 17a completed (or a document containing the same information)

The required forms may be downloaded from the GSA website at: www.gsa.gov/forms .

The Elevator Contractor shall provide the documents required above to the GSA or directly to the designated DHS FPS representative, at least 30 days before the subject individuals will require daily/weekly access to building areas housing federal operations. The documents required for each applicant shall be provided in a separate sealed and secure envelope.

Elevator Contractor personnel requiring daily/weekly access to building areas housing federal operations may be in possession of previously issued valid federal PIV credentials. For each such Elevator Contractor employee (including subcontractor employees), the Elevator Contractor shall provide evidence verifying that the employee: (1) possesses a valid (unexpired) federal PIV credential; and (2) has undergone the required suitability or national security level investigation comparable to or higher than that required on this contract. If both of these conditions cannot be met, a new background investigation shall be required.

Credentialing and Return of Credentials A federal PIV credential may be issued after an initial background check has been completed. If the ensuing further background investigation results in a preliminary finding that the subject individual is unsuitable to occupy a position at the designated sensitivity level, the PIV credential may be revoked and the subject individual denied access to building areas housing federal operations pending completion of any adjudication and/or appeal process or final determination. Unsuitable individuals may be escorted out of building areas housing federal operations by DHS FPS, Immigration and Customs Enforcement (ICE), or other law enforcement entities, if necessary to protect government employees, property, and interests.

To receive an approved PIV credential, the applicant must appear in person before the designated DHS FPS representative and again present an original valid (unexpired) picture ID issued by a state government or the federal government. Additionally, the applicant must sign an affidavit attesting to acceptance of the PIV credential and related responsibilities.

The Elevator Contractor immediately shall deliver to the GSA each federal PIV credential obtained for performance of this contract, under whichever of the following conditions occurs earliest:

· Receipt of notification from GSA that the PIV credential has been revoked

· Determination that the subject individual no longer requires daily/weekly access to building areas housing federal operations

· Release of the subject individual from Elevator Contractor or subcontractor employment

· Completion of subcontract work (for PIV credentials issued to subcontractor employees)

· Expiration of this contract

In the event that a Elevator Contractor PIV credential is damaged, lost, misplaced or stolen, the Elevator Contractor immediately shall notify the GSA and, if needed, request a replacement. Damaged PIV credentials shall be returned to the GSA.

Subcontracts The Elevator Contractor shall incorporate provisions in all applicable subcontracts as necessary to ensure compliance with all requirements provided in this Elevator Contractor Personnel Security Requirements section.

Document Security Sensitive but unclassified (SBU) building information will be generated and/or must be disseminated to and stored by various parties in the course of executing this project. SBU building information is information that, if misused, poses a potential security risk to a building, its occupants and visitors, and/or its contents. The Elevator Contractor shall comply with the following requirements regarding SBU building information.

Documents As used in this section, the term “documents” means any media or devices used to capture, store, and transmit information, including printed images and electronically or optically stored forms of graphic and written information, as well as physical or virtual models.

Identification and Labeling/Marking Original elevator contractor generated documents that contain building information must be reviewed with the GSA to identify any SBU content, before the original or any copies are disseminated to any other parties. If SBU content is identified, the elevator contractor shall affix SBU document labels/markings to the original documents and all extant copies, as instructed by the GSA, prior to any dissemination.

Copying from Labeled/Marked Documents Any documents containing SBU content copied from SBU labeled/marked documents must have the same SBU labels/markings affixed, unless the copies are redacted and reviewed as provided below.

Redacting The Elevator Contractor may redact complete or partial copies of SBU labeled/marked documents to remove or completely and unalterably obscure the SBU content. The Elevator Contractor shall review the redacted copies with the GSA to ensure that all SBU content has been removed or obscured. Copies so redacted and reviewed are no longer subject to these requirements regarding SBU building information.

Safeguarding and Storage The Elevator Contractor shall properly safeguard any documents bearing SBU labels/markings at all times while those documents are in Elevator Contractor possession. Access to such documents when in use by the Elevator Contractor must be limited to individuals having a need to know the content in order to perform work required under this contract. When not in use, SBU labeled/marked documents in Elevator Contractor possession must be securely stored such that they can be retrieved only by those individuals having a need to know the content.

Dissemination Other than within the Project Delivery Team, the Elevator Contractor shall disseminate SBU labeled/marked documents only to parties assigned or authorized to perform a role in the execution of the project and having a resultant need to know the document content. Documents may be disseminated in face-to-face meetings, by courier or secure shipment with evidence of delivery, or by electronic transmission. Electronic transmission of SBU information shall be encrypted as provided in current National Institute of Standards and Technology (NIST) data encryption standards and cryptographic module security requirements for processing SBU information.

Destruction SBU content that is no longer needed shall be purged from all SBU labeled/marked documents and destroyed, or the complete document shall be destroyed, such that the SBU content is rendered unreadable and incapable of being restored. Data storage devices containing SBU information that is no longer needed shall be destroyed or the SBU content shall be erased using a permanent erase utility or comparable method.

Reporting The Elevator Contractor immediately shall report to the GSA any known or suspected instances of improper dissemination of SBU information, or other circumstances in which the security of SBU information may be compromised.

Subcontracts The Elevator Contractor shall incorporate provisions in all applicable subcontracts as necessary to ensure compliance with all requirements provided in this Document Security section.

Record Keeping The Elevator Contractor is responsible for preparing correspondence and other documentation and maintaining accurate and detailed records of the project's progress during each Phase. The Elevator Contractor is responsible to maintain records so as to facilitate document storage and retrieval. Refer to the Scope of Services section below for detailed requirements for project documentation.

1. SCOPE OF SERVICES

The Elevator Contractor shall perform all services described in this Scope of Services (including services required under exercised options, if any) in accordance with applicable requirements and provisions set forth in the General Requirements above.

Design Stage Equipment and Material Submittals Provide equipment and material submittals for review and approval before the ordering of equipment and materials as required by Specification Section 14210. Long lead items should be submitted as soon as possible to insure timely delivery in regards to the project schedule. The Elevator Contractor shall also submit a proposed construction schedule for review and approval that shows all phased work (work on two elevators at a time) and inspection and testing time frames.

Construction Stage Upon receipt of notice to proceed with the Construction Stage work, the Elevator Contractor shall perform all services described in this section as a part of the Construction Stage work. Construction shall not interfere with the current tenants of the federal building. If this cannot be avoided during typical working hours, then construction shall occur beyond these hours as to not interfere or disrupt current tenants.

Construction Delivery Phase Construction Start Coordination Pre-Construction Conference Participate in the pre-construction conference.

Pre-Construction Photographs The Elevator Contractor may want to submit pre-construction photographs for the record of damaged areas not specified to be repaired or replaced in this contract.

Construction Administration Schedule of Values Prepare and submit a schedule of values for the GSA approval.

Construction Delivery Phase Record Keeping Provide record keeping as stated in this SOW.

Construction Progress Reporting Provide progress reporting as stated in this SOW.

Project Progress Meetings Attend progress meetings/conference calls as stated in this SOW.

Construction Schedules The Elevator Contractor shall provide and maintain construction schedules in accordance with the requirements of this SOW.

Inspections and Testing Conduct inspections and tests as required by the construction specifications.

Conduct construction safety (OSHA) inspections as required.

Clarifications/Requests for Information/Change Orders

Each RFI must include a specific description of the issue requiring clarification, citing the specific related contract document item requiring clarification. RFI’s should only be submitted after performing due diligence to confirm that the contract requirements in question are in fact unclear or otherwise inadequate.

Upon receipt of the response to each RFI submitted, coordinate the response with all involved subcontractors to ensure understanding and appropriate action.

Payment Requests

Before submitting each payment request, meet with GSA to review the advance copy of the construction progress report. Ensure that GSA is in agreement as to the progress of the construction work and the value of the work completed.

Based upon agreed value of work completed, submit monthly payment requests to the GSA.

Turnover Process Substantial Completion Prior to substantial completion, assist the GSA in conducting a pre-final walk-through.

Punch-List After the GSA certification that the work or each designated portion thereof is substantially complete, assist the GSA in conducting a final inspection and preparing a punch-list documenting remaining work.

Participate with the GSA in conducting follow-up inspections to administer resolution of punch-list items.

Operation and Maintenance (O&M) Manuals Submittal Prepare and submit complete and properly organized O&M manuals at the completion of the project.

Warranties, Guarantees and Certificates Prepare and submit warranties, guarantees, and certificates, ensuring that the GSA rights and responsibilities are clearly defined.

Material Samples, Attic Stock and Spare Parts As a condition for the GSA certification of substantial completion, provide an inventory list of all attic stock items to be turned over to the GSA at close-out (if applicable).

Preparation for Occupancy Coordinate the planning and scheduling of property management training (if applicable) with the GSA property management staff, allowing sufficient lead time for the GSA to prepare for the training and to ensure that the appropriate personnel will be available.

Conduct training of operating staff in optimal operation and maintenance (if applicable).

Include any available and suitable video material from manufacturers and suppliers in the training sessions.

Closeout Stage Final Project Photographs Not used.

OPTION Building Preservation Plan (BPP) Not Used DB Contract Closeout Resolve all remaining punch-list items.

Submit release of claims.

Payment for Construction Delivery Phase Work Refer to FAR 52.232-5 Payments under Fixed-Price Construction Contracts and FAR 52.232-27 Prompt Payment for Construction Contracts.

Travel Unless otherwise indicated in the Scope of Services sections, the Elevator Contractor is responsible for travel costs to support the requirements contained in this Statement of Work, including all progress meetings, reviews, and site visits. The Elevator Contractor shall assume all travel will be within the vicinity of the project site.

Reproduction and Delivery Printing, reproduction and delivery costs necessary for execution of this contract shall be included the contract price.

APPENDIX A - Owner’s Project Requirements

1. Design and construction work shall comply with the requirements of the attached Elevator Specifications Section 14210 for electric traction elevators.

2. See attached Specifications Section 14210 for related HVAC, Electrical and Fire Safety requirements.

3. Submittal reviews and progress inspections shall be conducted by GSA or a designated CM contractor.

4. All submittal selections will be performed by GSA and approved by GSA..
