About this file
This is a Limited Sources Justification for a General Services Administration (GSA) Public Buildings Service (PBS) construction management (CM) services acquisition. The document justifies awarding continued CM support services to Johnson, Mirmiran, & Thompson, Inc. (JMT) under the logical follow-on authority of FAR 8.405-6(a)(1)(C) for the Veterans Affairs Regional Office (VARO) located at 5000 Wissahickon Ave, Philadelphia, PA 19144. The procurement covers ongoing generator project construction management, CM services for a planned electrical expansion project (a follow-on to a previous electrical expansion project managed by JMT), and associated procurement support activities including design-build RFP development and execution for the electrical upgrade. The estimated contract value is undisclosed per year for the base year, with annual option periods extending up to four additional years.
The justification argues that limiting sources to JMT is in the government's best interest because JMT possesses detailed facility knowledge, established project controls, existing relationships with government and construction personnel, and proven performance in managing complex construction efforts. The document asserts that transitioning to a new contractor would create substantial onboarding costs, schedule delays, duplicated efforts, and heightened project risks, particularly given the critical nature of electrical and power infrastructure involved. Market research was not conducted among other National CM BPA schedule holders due to the logical follow-on nature and continuity requirements. The Contracting Officer certified the pricing as fair and reasonable representing best value under FAR 8.404(d), with final pricing determination to be supported by an Independent Government Estimate (IGE). Per FAR 8.405-6(a)(2)(ii), GSA PBS shall publish notice and post this justification to the General Services Portal (GPE) and GSA website for a minimum of 30 days within 14 days of order placement.

Limited Sources Justification Tab 4
VA CMa Contract
The purpose of this justification is to document a Limited Sources Justification for the referenced project, IAW FAR 8.405-6(c).
(1)This document is a Limited Sources Justification (LSJ), written on behalf of the General Services Administration (GSA), Public Buildings Service (PBS), Acquisition Project Delivery East Division.
(2)This is a LSJ for the acquisition of Construction Management (CM) support services from Johnson, Mirmiran, & Thompson, Inc. (“JMT”).
(3)This acquisition is for continued CM support services for the Veterans Affairs Regional Office (VARO) at 5000 Wissahickon Ave, Philadelphia, PA 19144. The replacement call will provide continued support of the ongoing generator project which is currently in active construction, CM services for a planned electrical expansion project that is a follow on from an existing electrical expansion project previously overseen by JMT, as well as associated procurement support activities including anticipated design-build RFP development and execution for the electrical upgrade. The estimated value of this acquisition is per year for the base year, plus annual option periods up to four (4) additional years.
(4)This justification references the statutory authority of FAR 8.405-6(a)(1)(C) Logical Follow-On as the primary authority.
The new work covered under this order is a logical follow-on to an original FSS order placed in accordance with the applicable ordering procedures, and is being established as a logical follow-on in the interest of economy and efficiency. By placing this order as a limited sources order, and in the interest of economy and efficiency, this order will avoid unnecessary transition costs and delays, will preserve the established project controls and management processes, and will ensure consistent quality oversight by a team already knowledgeable of the facility and project history. JMT has detailed knowledge of facility systems, phasing requirements, ongoing construction projects and site-specific constraints, as well as established relationships with government, designer, and construction contractor personnel. Their performance is proven in managing complex, multi-discipline construction efforts with minimal disruption to facility operations. These assets are a value-add to the Government. Competing this requirement poses unnecessary and unacceptable risks to the project schedule, timeline, deliverables, and budget. Transitioning CM services to a new contractor would require substantial time and effort for onboarding, site familiarization, and re-establishment of project controls, which would likely result in duplicated efforts and increased costs to the Government, reduced efficiency during critical construction phases, heightened risk to schedule delays
Docusign Envelope ID: A74FEBC9-2051-4C8B-B469-90F557ECBCFA and coordination issues as well as quality impacts, and separation of future projects and ultimate responsibility. Given the size, complexity and risk profile of the ongoing and planned projects, particularly those involving critical electrical and power infrastructure, continuity of CM services is essential to protect the Government’s interests.
IAW the requirements of FAR 8.405-6(a)(1)(C), the original order from which this procurement is a logical follow-on, was not previously issued under sole-source or limited-sources procedures.
(5)The anticipated cost to the Government for this procurement is fair and reasonable, and represents best value to the government IAW FAR 8.404(d). The Contracting Officer will make a final determination of fair and reasonable pricing prior to the award of the contract, as supported by an IGE.
(6)Market research was not conducted among other schedule holders/awardees under the National CM BPA, due to the logical follow-on nature of this requirement and the need to maintain continuity of construction management services for ongoing and closely related projects. Conducting market research would not reasonably identify an alternative source capable of performing these services without unacceptable duplication of cost and risk.
(7)Other factors supporting the justification, including the support for best-value provided by the limitation of one contractor, includes that JMT has previously provided these support services for this site as the current awardee for the project from which this order would be a logical follow-on, and is best situated with active and ongoing knowledge of the building and ongoing projects to provide these services at the best value to the Government.
(8)The Government intends to evaluate future CM requirements to determine whether they can be structured and competed separately from ongoing projects, thereby allowing for full and open competition once continuity requirements no longer apply. Furthermore, IAW the requirements of FAR 8.405-6(a)(1)(C), as this order will be issued under limited-sources procedures, future orders for this specific work may not utilize the logical follow-on justification for limiting sources.
(9)By inclusion of their signature, the Contracting Officer certified that this justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief.
(10) Any supporting data that is the responsibility of the technical or requirements personnel and which forms a basis for the justification, is certified as complete and accurate by the technical or requirements personnel, as evidenced by their signatures below.
