RFI Question Response Posted to SAM.gov

The plans call out stone repair S1, crack repair as a general note on 1/AE201 and 1/AE202. Other than the callout on the stairs on the Commercial Street elevation, should a particular quantity of LF be carried for the project?

For bidding purposes, please include a minimum of 50 linear feet of crack repair.

12/15/2021

The Solicitation and Specifications are silent on the preferred timeframe/duration for the work. Is there specific timeframe for execution for the work?

Summary of Work, Section 010100, page 4 indicates working hours are 7 am to 5 pm, Monday through Friday. However, since all work is exterior in nature, government would consider work outside of those hours including weekends, if the contractor would prefer to work alternate hours. This could be a 4 day work week working 10 hours days or whatever the contractor's normal schedule is. 12/15/2021

Please confirm the extent of pointing required at the West elevation adjacent to the stairs, ie the area at the sidewalk where the stairs tie into the sidewalk. Please also confirm that any work on the street-side elevation stops at the north and south corners.

West Elevation repointing is limited to the entire west facade to the ground level. However, repointing at the stairs is limited to the edge of the north and south corners of the stairs including the stair walls leading up the stairs but not the stone copying and stone balusters and railing north and south of the stairs along the sidewalk.

12/15/2021

General Note 1 mentions removal of loose and flaking granite, but no direction on potential repair for these spalls. Is the intent to only remove the loose material and leave as-is after cleaning?

Specification section 040140 - Stone Masonry Restoration outlines the requirements for repair of spalling granite.

12/15/2021

Are the metal window grilles to be removed and reinstalled as part of this contract?

If metal window grilles have to be removed to accomplish work outlined in the contract, they should be removed and then reinstalled once masonry restoration work is completed. 12/15/2021

Will there be an assigned laydown area provided by govt and if so where and what size?

The govt will provide 150 SF of space in the moat. This space is under the sidewalk and is secure with a locking door. 12/15/2021

Will scaffolding be allowed to stay in place for the duration of project?

Scaffolding will be allowed to remain in place for the duration of the contract. 12/15/2021

Portland Custom House: Masonry Restoration Project RFIs & Answers

47PB0022R0003

Will historic permits be required by govt or local municipalities?

Historic permitting is not required as part of this contract. However, permitting may be required from the City of Portland, if construction operations result in having to shutdown sidewalks to complete the work. 12/15/2021

Please advise the full area allowed to be secured, are there ROW that cannot be closed or fenced off on area surrounding building up to street curb edge?

The two elevations that are being completed as part of this project are at two main entrances to the building. All required egress/entrance paths to and from the building will need to be maintained throughout the duration of the project. 12/15/2021

Please advise which ROW will be needed for visitors access to building, what doors will be used during the project?

Assuming ROW is "Right of Way".

The two elevations that are being completed as part of this project are the two main entrances to the building. All required egress/entrance paths to and from the building will need to be maintained throughout the duration of the project. 12/15/2021

Will contractor be allowed to use govt electrical connections at building?

Use of government exterior electrical as well as water connections to provide power and water for required contractor equipment/activities will be allowed. 12/15/2021

Are there required pedestrian detour plans? The two elevations that are being completed as part of this project are at two main entrances to the building. All required egress/entrance paths to and from the building will need to be maintained throughout the duration of the project. 12/15/2021

What is the timeframe that this project is expected to start? Will govt allow for project physical commencement in April or May 2022 for NTP?

Construction award is anticipated for January. However, the intent is to not actually start construction until the spring to avoid cold weather conditions. The contract duration allows for start and completion of the project in warmer weather which is more conducive to contract related work. It is anticipated that submittals and any other documentation related work will be completed through the winter to be ready for a spring construction start. 12/15/2021

14 Has project been funded? Project is fully funded. 12/15/2021

Are there any protected species nesting on existing structure? If yes will govt remove prior to project commencement?

There are no protected species that the government is aware of. If protected species are encountered, government will arrange for removal outside of this contract or will issue an RFP to the contractor to arrange for required removal of any protected species. 12/15/2021

Does the contract include installation of bird netting and if so what locations?

Two areas of bird netting are identified to be addressed. They are identified on sheet AE201, Keynote S2 which indicates to remove existing bird netting and install new bird netting. There is a graphic scale on the drawings that can be used to measure the area required.

However, in scaling the drawings, the rectangular area is approximately 4'-6" in height by 23' in length which is approximately

103.5 square feet. This would be required at the east and west elevation so for bidding purposes, contractor should carry a total of 207 square feet of bird netting to be installed. 12/15/2021

How accurate is the price range of the 1 – 5 million range on this project?

According to FAR 36.204, the estimated total value of the project (base and option) lies within the range of 35.204(f): "between $1 million and $5 million". The government is required to use one of the predetermined ranges found in FAR 36.204, and this does not mean that the contractor is required to propose within this range.

12/15/2021

This contract is subject to FAR 52.219-14, Limitations on Subcontracting. Can you please confirm if this is a Construction, Construction by Specialty Trade, or Services) contract? If other than services, please see that FAR 52.204-14 Service Contract Reporting Requirements is incorporated by reference, as well as FAR 52.222- 6 Construction Wage Requirements is incorporated by reference.

This is a Construction project, and only FAR 222-6 will be included in the contract award.

12/15/2021

Will the government accept modification requests if the cost of materials increases from the date the proposal was submitted to the date the contract is awarded and approved to commence?

The government will consider change order requests via the process outlined in the contractual documents.

12/15/2021

Will the contract be governed by Service Contract Labor Rates or Davis Bacon Labor Rates? Please specify. If so, has the government identified the specific job classification(s) that must be used for this contract.

This project will be using the Construction Wage Determination labor rates under the category ME20210016 and 12/03/2021.

12/15/2021

Will the Prime Contractor have to submit Weekly Payroll Logs for this contract?

Is there a log of submittals that are required upon award and during contract performance? Can this be provided prior to due date of proposals?

Submittals required as part of this contract are outlined in the specifications. A submittal log is not available. 12/15/2021

Can you please confirm if proposals may be submitted via email? The solicitation indicates in section V.A. that email submission may not be approved.

Yes, proposals will only be accepted via email.

12/15/2021

Will the government provide bathroom facilities during contract or will the contractor be responsible for these facilities?

Contractor is responsible to provide their own bathrooms facilities at the site. A location will be provided on site to place a portable toilet.

Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.95 for calendar year 2021 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.95 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2021. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate,if it is higher than the conformed wage rate). The EO minimum wage rate will be adjusted annually. Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

II.D. Technical Proposal

The Technical Proposal shall include the information requested below for the non-price factors described in Section VI.

Definitions

For the purposes of these evaluation factors, “Similar Project” means the extent to which a project is comparable in nature, type, and complexity as defined by the following characteristics

(in no order of importance):

i. Construction services for masonry restoration, repairs, alterations, or improvements performed on buildings of similar size,

ii. Masonry restoration, repairs, alterations, or improvements on federal facilities,

iii. A project dollar value between $500,000 and $1,500,000,

iv. Offeror managed the project as the prime contractor, and

v. Completed, or at least 50% complete with construction, within the last 5 years of the proposal due date.

Factor 1 – Company’s Past Performance – 25%

Description: This factor considers the depth, breadth, and quality of the offeror’s past performance on

Similar Projects, or any other acquired past performance information, with regards to considerations such as technical success; customer satisfaction; successful management of the project; perceived quality of the final product from end users and clients; timeliness and responsiveness of the offeror; adherence to contract documents, project baseline schedule, and budget; and the ability to coordinate activities and work with various stakeholders. The factor considers the relevance and recency of the submitted Similar

Projects. The relevance of the factor is evaluated against the extent to which the submitted Similar

Project(s) aligns with the stated characteristics in the statement of work. The factor considers the quality of comments to support reference ratings on CPARS and PPQs.

The Government will use a combined assessment of all aspects of past performance to arrive at a conclusion of overall past performance for each Similar Project. The assessment of the overall past performance for each Similar Project and any other past performance information may be used to arrive at a conclusion and evaluation of the offeror’s overall past performance. The Government will consider the quality of the entire portfolio of submitted Similar Projects (not to exceed five) to assess past performance and will not necessarily give a more favorable rating for a greater quantity of submitted Similar Projects.

The Government’s sources of information for evaluating the offeror’s past performance may include, but are not limited to, any and all information the Government becomes aware of (whether or not before or after the deadline for initial offers and whether or not the sources are provided by the offeror). While the

Government may elect to consider data and information from any source, the burden of providing detailed, current, accurate and complete past performance information by the deadline for the initial offers’ rests with the offeror. The Government may consider contractor past performance information it obtains on its own or from other sources regarding past performance on projects other than those submitted for Similar Projects.

Submittal Requirements: Provide at least three (3) and no more than five (5) examples of Similar

Projects that demonstrate successful past performance. The selected Similar Projects submitted for past performance should include owner reference(s) and owner information and should include the following:

name, title/position, and contact information (such as a phone number and email address). The selected references should be familiar with the submitted project such as the owner’s representative and owner’s project manager having oversight for the project. The selected similar project should include the following information: name of project, location of project, contract number or unique project identifier

(as applicable), original awarded value of the project, final awarded value of project, period of performance, number of modifications, and a project description. The submitted past performance information should be completed on the Past Performance Questionnaire for GSA Solicitation No.

47PB0021R0021. It is the responsibility of the offeror to inform the references to expect to be directly contacted for the purpose of discussing past performance on the project.

The offeror may submit any of the following to satisfy the proposal submittal requirement for past performance:

1. the past performance questionnaire (PPQ) (included as an attachment to the RFP), completed by the client/owner reference, for projects the offeror selected to submit for past performance; or

2. a completed evaluation in the Contractor Performance Assessment Reporting System.

Offerors should make every effort to submit a portfolio of projects that covers all of the stated characteristics for Similar Project. It is not necessary for each project to cover all of the characteristics of a Similar Project, but the portfolio as a whole should cover the entire variety of stated characteristics requested in the definition of Similar Project.

Basis for Evaluation: For each of the Similar Projects submitted and performed by the offeror, the

Government will consider information published in CPARS/PPIRS evaluation reports (if available) and the PPQ. The Government may elect to call references to gain a better understanding of past performance.

Questions asked of references may be tailored to the particular project in order to improve the

Government’s understanding of past performance. The Government may take into consideration the relevance and recency of the past performance. Any additional information the Government ascertains related to the overall past performance may be considered as part of the evaluation. If past performance information is not provided with the proposal, then the Government will evaluate the absence of past performance as Neutral. A Neutral evaluation does not negatively or positively affect the overall rating.

The standard of evaluation is met when offerors demonstrate at least an overall Satisfactory past performance based on all available information, whether or not included in the proposal, when considered together as part of the overall assessment of past performance. Offerors which receive ratings higher than

Satisfactory or Neutral by references (such as in CPARS, PPQs, or direct conversations) may be rated more favorably. References’ evaluated ratings that are strongly substantiated by comments, remarks, awards, recognition, descriptions, or other evidence may be evaluated more favorably. The Government evaluation team may take into consideration the depth and quality of comments to determine the evaluated rating given for Company’s Past Performance. A more favorable rating may be evaluated for

Company’s Past Performance to the extent such experience aligns with the requirements of the RFP, the statement of work, and the stated characteristics of a Similar Project

Factor 2 – Construction Management Plan – 25%

Description: This factor considers the means and methods in the offeror’s approach to construction management for activities such as planning, subcontractor coordination, risk management, mobilization, staging, closeout, and day-to-day activities for this project. The factor considers the soundness of the identified phases, activities, methodologies, procedures, risks management, resource allocation, and approach in the construction management plan. The factor will specifically consider subfactors below to evaluate the construction management plan.

Subfactor 2.1 – Coordination and Management – 15%. The subfactor evaluates procedures and methodologies for overall coordination, management, and resource implementation and management. The subfactor includes evaluation of the management plan for coordination and management of subcontractors’ and suppliers’ activities. The subfactor considers the overall soundness of the approach to team coordination, staging, and phasing.

Subfactor 2.2 – Schedule, and Quality Control – 10%. The subfactor considers the management of schedule control and construction quality for construction activities. The factor considers the soundness of the schedule and quality control in the construction management plan.

Submittal Requirements: The offeror should submit a technical narrative for a construction management plan that details the means and methods to manage activities throughout construction. The construction management plan should use written statement(s) outlining the approach to manage all phases of construction and closeout of the project. Items that may be include in the construction management plan include items such as phasing plan, building occupant and visiting public safety, broad planning of the construction project, etc. The Offeror should submit a critical path method (CPM) schedule detailing the

Offeror’s approach to meeting the technical requirements included in the RFP and the specifications by or before the timeframe stated. The construction management plan should clearly identify and describe any activities or means and methods that add value to the project.

Basis for Evaluation: The standard for this evaluation subfactor is met if the submitted information demonstrates a sound approach to manage activities throughout construction. Construction management plans that fail to align with the project schedule may be evaluated less favorably. Construction management plans that add value beyond the basic requirements in the SOW and contract documents may be evaluated more favorably.

Factor 3 – Relevant Experience of Key Personnel Qualifications – 25%

Description: This factor considers the relevant experience and qualifications of key personnel proposed.

Offerors should have key personnel with required relevant experience to perform their respective responsibilities and functions at a highly competent and professional level. The factor evaluates the proposed extent and depth of experience of the identified positions of project manager, construction superintendent, and quality control specialist (or similar titles within the industry that perform similar job functions and responsibilities).

Submittal: The offeror should identify the personnel proposed to fill key positions listed below and state their roles and responsibilities for the project. The offeror should provide evidence of competency, qualifications, and related experience of key personnel. The offeror should provide resumes for each key personnel clearly indicating their currently held position/title, proposed project position/tile, education, qualifications, professional licensing and certifications, and work experience (including roles) over the last five (5) years. Resumes may not exceed five (5) pages per person (standard page 8.5”x11” or electronic equivalent).

At a minimum, the build key personnel for the project must consist of the following positions:

• project manager

• construction superintendent

The offeror should provide a table (one page) clearly identifying the roles that key personnel held on the project submitted under Factor 2 (if applicable). The offeror should also include in the table the identified roles of key personnel held on Similar Projects that may have not been submitted under Factor 2. As part of the resume and narrative, the offeror should describe the key personnel’s role within any identified projects and detail how the experience of the team member contributed to the success of the project. The narrative should also detail and identify how the qualifications and experience of key personnel will contribute to the effective performance of the required work. Offerors should include an organizational chart (one page) that presents the overall team structure.

Basis for Evaluation: The offeror meets the evaluation standard provided all key personnel are successfully identified and the information clearly identifies the relevant experience…
