EXHIBIT C
Technical Scope of Work
Background
Constructed in 1932, the building originally served as a Custom and Immigration office and U.S.
Post Office. It later evolved into the Custom House and Federal Office Building (CH-FOB). In September of 2020, the US Customs and Border Protection (CBP) agency vacated the CH-FOB and consolidated into the Main Port Building (ND0545AO) of the Pembina Land Port of Entry.
Currently, the old CH-FOB building is 100% vacant. There is little backfill potential, and GSA has declared the property excess to its needs. The property has been given to the office of Real Property Utilization and Disposal (RPU&D) for disposal. An appraisal is required in support of that effort.
Property to be Appraised
The site consists of 0.62 acres and is rectangular in shape. The CH-FOB was built upon it in 1932 and is listed on the National Register of Historic Places. It was designed in the Colonial Revival style and is one of just three postal buildings in North Dakota designed in this manner.
The building contains 15,058 SF and consists of 3 stories (including basement). The appraiser will need to consider the impact of the historic-related use restrictions on marketability and value, if any (see sample Historic Preservation Covenants in the Addenda).
Some asbestos-containing material (ACM) may be present in roofing components, floor tiles, mastics and other building materials. In addition, some lead-based paint (LBP) may also be present at this location. These can be maintained through the implementation of an Operations and Maintenance (O&M) Program. A properly developed O&M Program is sufficient to maintain the property in accordance with current regulatory requirements. The appraiser may assume this will be properly managed in place for purposes of this assignment.
Purpose Of The Appraisal
Estimate Fair Market Value Estimate Disposition Value (based on a specified marketing period of 2-3 months).
The values estimates are to be based on the property’s highest and best use.
Property Rights to be Appraised
Fee simple interest.
Intended Use of the Appraisal
The intended use of the appraisal is to assist the General Services Administration (GSA) in disposing of the property, which is excess to the needs of the Government. The most likely method of disposal will be a competitive sale using GSA’s online auction program. The Government will act as the owner/broker.
Intended User of the Appraisal
This appraisal is exclusively for GSA’s use.
Definitions
a. Fair Market Value : The most probable price that a property should bring in a competitive and open market under all conditions requisite to a fair sale, the buyer and seller each acting prudently and knowledgeably, and assuming the price is not affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified date and the passing of title from seller to buyer under conditions whereby:
(1) Buyer and seller are typically motivated;
(2) Both parties are well informed or well advised, and acting in what they consider their best interests;
(3) A reasonable time is allowed for exposure in the open market;
(4) Payment is made in terms of cash in United States dollars or in terms of financial arrangements comparable thereto, and;
(5) The price represents the normal consideration for the property sold unaffected by special financing or sale concessions granted by anyone associated with the sale.*
b. Disposition Value : The most probable price that a specified interest in property should bring under the following conditions:
(1) Consummation of a sale within a specified time, which is shorter than the typical exposure time for such a property in that market.
(2) The property is subjected to market conditions prevailing as of the date of valuation.
(3) Both the buyer and seller are acting prudently and knowledgeably.
(4) The seller is under compulsion to sell.
(5) The buyer is typically motivated.
(6) Both parties are acting in what they consider to be their best interests.
(7) An adequate marketing effort will be made during the exposure time.
(8) Payment will be made in cash in U.S. dollars (or the local currency) or in terms of financial arrangements comparable thereto.
(9) The price represents the normal consideration for the property sold, unaffected by special or creative financing or sales concessions granted by anyone associated with the sale.*
c. Highest and Best Use : The reasonably probable use of property that results in the highest value. The four criteria that the highest and best use must meet are legal permissibility, physical possibility, financial feasibility, and maximum productivity.*
* Dictionary of Real Estate Appraisal, 6th Edition
Emphasis on Market Analysis, Marketability Study, Analysis of Highest and Best Use
This appraisal assignment is complicated by a few issues that make the highest and best use determination and valuation analysis particularly challenging. For example, the building is a large, special purpose facility. It is also historic-designated, being listed on the National Register of Historic Places. Finally, it is located in an extremely remote, rural area near the U.S.- Canadian border.
Therefore, it is important that a thorough market analysis as well as marketability study be developed to realistically assess reuse/ development potential and the subject’s competitive position. Some information will no doubt need to be obtained from interviews with city/county/state government officials and members of the local professional real estate community.
Valuation Analysis
All three approaches to value must be considered and all applicable approaches developed and presented in the report. If an approach is not applicable, then an explanation must be provided as to why. Detailed descriptions and photos of the comparables must be included in the report, and individual data sheets are required. NOTE: Even if it is determined that the Cost Approach is not applicable, a land valuation must still be performed to support the concluded highest and best use.
SPECIAL REQUIREMENTS & CONSIDERATIONS
Historic Status
The building is listed on the National Register of Historic Places and will be subject to various restrictive use covenants. The appraiser will need to evaluate the impact this could have, if any, on highest and best use, marketability and value. A template of covenants typically included in the deed language is provided in the Addenda of these specifications.
Exposure Time/Marketing Time
In addition to researching and reporting the reasonable exposure time indicated by historic sales data, the Appraiser must also develop and report an opinion of the reasonable estimated marketing time it will likely require to sell the subject property at the concluded Fair Market Value.
Deliverables and Billing Instructions

- Final Report - The contract appraiser shall deliver two hard copies of the final report, as well as an e-mailed version (preferably in a pdf format), to craig.blair@gsa.gov no later than 5 days from the appraiser’s receipt of the reviewers comments on the draft.
