V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF

THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

Kone is the current Elevator Operations and Maintenance (O&M) Contractor at the McCormack Federal Building. Kone is the only elevator company contracted to provide O&M services at the McCormack Federal Building, and in order for them to provide warranty and perform elevator O&M on the services required under paragraph 3, they must be the Contractor.

As part of the effort, the effected elevators will be taken offline in order to complete the required repairs. Scheduling of the repairs and execution will be done by Kone. Kone’s position as the https://www.acquisition.gov/content/part-13-simplified-acquisition-procedures#i1111258 http://uscode.house.gov/browse.xhtml;jsessionid=114A3287C7B3359E597506A31FC855B3 current elevator O&M allows them to have the unique capability to coordinate all efforts involving scheduling of installation, their technicians, and the shutdown of the elevators.

As the current elevator O&M contractor Kone is uniquely qualified to provide the complete services, per the Government’s requirement, as stated under Paragraph III above.

OPEN COMPETITION

N/A.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

State “See Section VI above.”

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING

SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

In future elevator O&M contracts, GSA should consider including into the scope of work similar minor construction, or, require the elevator to operate and maintain a broader scope, to include items installed by other contractors. Such language would increase the cost to the Government, but would also increase competition on the services required under Paragraph III.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
