In May 2018, GSA awarded task order number 47PB0018F0028 Real Estate Support Services for FASTA to CBRE, Inc (CBRE). The task order was awarded using the competitive procedures under FAR 8.405-3.The Scope of Work for that task order included language reading: “provide Federal portfolio analysis and related real estate services to assist GSA in implementing the goals of FASTA. GSA requires support for inventory review, market analysis, the development of a list of FASTA Candidates suitable for consideration by the Board, and a FASTA Evaluation Report.” The services provided under paragraph 3 were intended to be performed under task order 47PB0018F0028, but the Board was not yet sworn in when that contract expired.
CBRE will take the report they provided to GSA under 47PB0018F0028, provide further analysis, and draft a report for PBRB. The supporting rationale justifies the use of 8.405- 6(a)(1)(C) as the authority for awarding 47PB0019F0056 to CBRE.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).
CBRE was awarded task order 47PB0018F0028 on a best value basis under competitive procedures using FAR part 8.405-2. As a logical follow on to that task order, the best value provided by CBRE translates to this task order and the services being provided.
CBRE has provided labor rates under their federal supply schedule at a discount, and the labor mix provided for each submitted task will be reviewed for reasonableness.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Market research was not conducted because no other schedule holder would be able to provide the services nor the key personnel that CBRE could.
7. Any other facts supporting the justification.
Although FASTA was enacted in December 2016, the PBRB members were not sworn into office until May 2019. The swearing in of the board members resulted in the commencement of timelines prescribed by the FASTA law. Due to the short timeframe for PBRB to deliver a report to OMB identifying recommendations, a prolonged contracting action for real estate support was not viable. Given CBRE’s past experience under 47PB0018F0028, it was determined that a follow-on contract would be the most efficient and effective action to allow PBRB to meet its legislatively mandated deadlines.
Much of the additional work being performed under this task order would be unacceptably delayed while the new contract is solicited and the new contractor gets up to speed (FAR 8.405-6(a)(1)(i)(A)) leading to missed deadlines by the FASTA Board. In addition, almost all the work being performed requires an in-depth knowledge of the work previously performed which would make it very difficult for any other Contractor to cost-effectively perform the work (FAR 8.405-6(a)(1)(i)(B)).
