LIMITED SOURCES
JUSTIFICATION FAR 8.405-6
In accordance with Federal Acquisition Regulation 8.405-6 Limited Sources, I hereby determine that the Food and Drug Administration (FDA) requirement to place Architectural Barriers Act Accessibility Standard (ABAAS) compliant wayfinding name plate inserts on all offices and conference rooms throughout the FDA White Oak Campus, Silver Springs MD is required through a sole source procurement and competition is precluded for the reasons indicated below.
Please select the appropriate statutory authorities in accordance with FAR Part 8.405-6, Limited Sources:
(Per FAR 8.405-6(a)(1)(i)(b) Orders placed or BPAs established under Federal Supply Schedules are exempt from the requirements in Part 6)
X FAR 8.405-6(a)(1)(i)(b) Limited Sources;
1. Identification of the Agency and the Contracting Activity
This requirement is in support of the US Food and Drug Administration, White Oak Campus, 10903 New Hampshire Ave, Silver Springs MD.
2. Nature and/or description of the action being approved In Accordance with (FAR) 8.406-6(a)(1)(i)(b), Limited Source Justification and Approval, GSA intends to award a contract to 2/90 Sign Systems Inc. (GS-07F-0265N).
3. A description of the supplies or services required to meet the agency’s needs (including the estimate value) Purchase twelve thousand (12,000) static room number inserts to fit into existing frames and comply with Architectural Barriers Act Accessibility Standard (ABAAS) requirements. Additional static signage for conference rooms are needed which requires three-hundred and one (301) conference room number and three-hundred and one (301) room name signs. FDA has determined in accordance with the agency’s standardization program that only specified makes and models of parts will satisfy the agency’s needs for replacement items, and only one source is available. Specifically FDA’s current signage requires replacement inserts only and 2/90 Sign Systems is the only manufacture that provides inserts compatible with the existing signage frame. It was also determined that it was economically not feasible to replace the entire sign in lieu of replacement inserts. The independent government estimate is $509,916.39 to include purchase and installation of replacement inserts.
4. Identification of the justification rationale (see FAR 8.405-6 (a) and (b)) and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide supply or service.
GSA has determined that the procurement requires a sole source in order to satisfy the Agency’s need. Specifically, the basis for Limited Sources is that the FDA has determined, in accordance with the agency’s standardization program, that only specified makes and models of parts will satisfy the agency’s needs for replacement items and only one source is available. FDA’s current signage requires replacement inserts and 2/90 Sign Systems is the only manufacture that provides inserts compatible with the existing signs. It was also determined that it was economically not feasible to replace the entire sign in lieu of replacement inserts. In accordance with FAR 8.406-6(a)(1)(i)(b) Only one responsible sources and no other supplies or services will satisfy agency requirements.
5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d) GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, in accordance with 8.405-2(d), the government intends to consider the level of effort and mix of labor to determine the total price is reasonable prior to award. By placing an order against a schedule contract using the procedures in 8.405-2, the ordering activity has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs. Although GSA has already negotiated fair and reasonable pricing, the Special Programs Division shall seek additional discounts before placing an order (see 8.405-4).
6. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited 2/90 Sign Systems is the sole manufacture of the 2/90 modular sign system and as a result other manufactured inserts would not be compatible with the existing signs. The replacement of the entire signage on campus is not practical and economically not feasible when compared to the partial replacement of inserts on the existing signage.
7. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Including whether a notice was or will be publicized as required by Subpart
5.2 and, if not, which exception under 5.202 applies A notice will be publicized as required by Subpart 5.2.
8. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable The following IGE $509,916.39 represents a fair and reasonable value to the government based on market research, historical procurement data, and/or specific industry knowledge by the technical representative.
9. A description of the market research conducted (see part 10) and the results or a statement of the reason market research was not conducted The following steps were performed in order to conduct market research before sole sourcing:
Market research was limited to existing Government contract awards, which none satisfied the government requirement and Federal Supply Schedules published on the GSA Advantage website.
The existing static signage and frame at the FDA campus is a proprietary system and only one Federal Supply Schedule contractor was capable of meeting the government requirement.
10. Any other facts supporting the use of other than full and open competition Due to the fact that all room # plate inserts on campus are being changed, adding a relatively minimum amount of conference room signs to that sole source procurement will be in the best http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/08.htm#P157_26744 http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/08.htm#P126_22051 http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/02.htm#P14_694 http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/08.htm#P277_47249 interest of the government and eliminate duplication of effort and decrease the total procurement cost.
11. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition None
12. A statement of actions, if any, that agency may take to remove or overcome any barriers to competition before any subsequent for the supplies or services required None
Program/Technical Official Certification:
I hereby certify and accept the responsibility that any and all supporting data provided above or used to justify the above requested for a sole source procurement (e.g., verifying the Government’s minimum needs, schedule requirements, and/or other rationale for other than full and open competition) is accurate and complete to the best of my personal knowledge and belief.
