JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Authority Cited: FAR 6.302-1—Only one responsible source and no other supplies or services will satisfy agency requirements.

FAR 6.3 Subpart 6.302-2 Unusual and Compelling Urgency

Date of Preparation: June 12, 2019

Identification of the agency and the contracting activity.

UNICOR, Federal Prison Industries 14601 Burbridge Road, SE Cumberland, MD 21502

2. Nature and/or description of the action being approved.

Purchase of 1,500 solid brass, Showpiece Mantle Clocks.

3. Description of the supplies or services required to meet the agency’s needs.

Amerimac, LTD is to provide blank clocks to the factory to be used on sales order

10653483. The factory will then etch the BOP emblem on the clocks for our customer.

4. Statutory authority for permitting other than full and open competition

FAR 6.302-1—Only one responsible source and no other supplies or services will satisfy agency tequirements. (1) Citations: 10 U.S.C.2304(c)(1) or 41 U.S.C.3304(a)(1).

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

The Showpiece Mantel Clock provided by Amerimac has been approved by our customer

(Federal Bureau of Prisons — Consolidated Benefits Unit). This clock was on a UNICOR contract with the vendor in the past and was utilized by the Bureau of Prisons as their retirement clock. We have provided them with a sample of a variety of clocks to utilize, however, they have indicated that the one produced by Amerimac is the only one that meets their requirements, The alternative clocks found were made of brad plated aluminum. The clock that Amerimac offers is a solid brass clock and is no longer available from other sources.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practical, including whether a Commerce..Business Daily

(CBD) was or will be publicized as required by Subpart 5.2, if not, which exception under 5.202 applies.

Internet searches through GSA and open market sites were conducted. No other source was found to provide the solid brass mantel clock. This requirement will not be publicized before award due to Urgency, 6.3022. A delay in award would result in serious financial loss and customer delinquencies.

7. Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable.

Prices were compared to historical purchases for this particular clock. Current market prices for like items were also used to determine fair and reasonableness.

8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.

Internet searches were conducted; calls to various sources for like items; and previous vendors used by UNICOR.

9. Any other facts supporting the use of other than full and open competition, such as:

The lead time on these clocks is 120 days. Further competition would delay UNICOR in meeting our customers required timeline.

10. Listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

No other sources have currently expressed an interest in providing this item.

11. Statement of the actions, if any, the agency made to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services is required.

We approached our customer about the brass plated aluminum clocks, to see if they would accept them and they informed us they would not, In the future, we will seek competition when the customer lead times allow for this.

12. Contracting Officer certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief.
