SUPPLEMENT B – SCOPE OF WORK AND GENERAL INTENTIONS
GENERAL INTENTIONS
Contractor will provide services to include all tools, labor, materials, equipment, and supervision necessary to complete Mental health Courtyard Wall Height Rising, located on the Richmond VA Medical Center campus, Richmond, Virginia.
SITE VISIT
Offerors are encouraged to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of performing these services. In no event shall failure to inspect the site constitute grounds for a claim after contract award.
There will be ONE formal site visit on Tuesday, April 4, 2023, at 9:30 AM (EST)
SUBMISSION OF QUESTIONS AND QUOTES:
To obtain clarifications and/or additional information concerning the contract requirements or specifications, submit a written question via email to Denise.Morman@va.gov. Questions and responses will be responded to as necessary in amendment format which will be posted under Contract Opportunities on www.SAM.gov.
The deadline for submission of questions for this solicitation is Monday, April 10, 2023, at 3:00 PM (EST). No questions will be accepted after this date/time unless determined to be in the best interest of the Government as determined by the Contracting Officer. Telephone questions will not be accepted or returned.

EVALUATION PROCEDURE
EVALUATION—SIMPLIFIED ACQUISITION PROCEDURES FAR PART 13
Basis for Award. As stated FAR 13.106(a)(2)(i), the Government will issue a Firm-Fixed Price contract to the responsible quoter whose quotation conforming to the solicitation will be most advantageous to the Government, based on price alone.
Evaluation Approach. The Government will evaluate quotations using the comparative evaluation process outlined in FAR 13.106-2(b)(1) where quotations will be compared to one another to determine which provides the lowest price to the Government. Each response must meet the minimum requirements of the solicitation. The Government is not requesting or accepting alternate quotations. The Government will evaluate the price by adding the total of all line items priced and provided on the Quote.
Quotes will be compared against each other in an impartial and simplified manner based on FAR Part 13.106-2. The CO may ask questions to one or more submitters but is not obligated to do so. The CO may reject all quotes.
RESPONSIVENESS OF QOUTES
For a quote to be eligible for award, the quoter(s) must ensure they are in compliance with the NACIS code listed on page #1, block #10 of the SF 1442 and by issuing a quote for this solicitation confirms that the quoted amount is good for 120 days from the date issued.
The SDVOSB concerns agrees that from the time of offer, award and during the performance of the contract they shall be verified and registered with the following: OSDBU, SBA VetCert, SAM, and VETS 4212 and comply with VAAR Clause 852.219-73, VA Notice of Total Set-Aside for Verified Service-Disabled Veteran-Owned Small Businesses.
RESPONSIBILITY REQUIREMENTS
A Determination of Responsibility shall be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems will be used to make the Determination of Responsibility. Failure to affirm being within the guidelines above or submitting this information late may result in a determination of “Non-Responsibility” for the offeror. Any information received by the Government that would cause for a negative Determination of Responsibility may make the offeror ineligible for award. This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractor.
INSTRUCTIONS TO OFFERORS/SUBMITTAL REQUIREMENTS

1. Company information to include: UEI number, DUNS Number, Cage Code, Tax ID Number, General Contractor’s License number and State of Licensure, principal points of contact with addresses, phone numbers and email addresses.
1. Complete the SF 1442, Blocks 14, 15, 17, 20A, 20B, and 20C to submit the Quote. All sections of the RFQ, excluding Instructions to Offerors and Evaluation Procedures Sections, constitute the model contract.

1. Quote with breakdown of labor, material, equipment, overhead and profit. An example of the required information has been provided.

5. Experience Modification Rate (EMR): Offerors shall provide documentation to show that the offeror has an Experience Modification Rate (EMR) of equal to or less than 1.0.
1. Once an offer is accepted, the VA will request an official with the authority to bind your company contractually to complete block 30a, sign, and date the SF 1442 Block 30b and 30c. One copy of the SF 1442 must bear an original and/or digital, authorized signature.

Building 500 Mental Health Courtyard
1. General Requirement--The Contractor will provide all transportation, materials, parts, tools, specialized equipment, labor, supervision, and technical expertise to raise the existing 3 walls two feet outside the Mental Health Clinic as outlined in section at Hunter Holmes McGuire VA Medial Center, 1201 Broad Rock Blvd Richmond, VA 23249,
2. Coordination. The engineering Carpentry shop will serve as the focal point and point-of-contact (POCs) for this contract. A COR will be delegated upon award.
2.1. The contractor must pre-coordinate and preschedule work with the POCs. This work can only be performed during normal business hours, M thru F 800AM to 430 PM.
3. Government Provided Tools, Materials and Equipment. The Federal Government will not provide any tools, parts, materials, and equipment. This is a turn-key project with the vendor providing all necessary tools, parts, materials, and equipment.
4. Specifications. The following specifications will apply: Report to the Hunter Holmes McGuire VA Medical Center, Engineering Carpentry Shop POCs/CORs before starting work each day.
5. Scope of Work: All work will be accomplished in-accordance with applicable Life Safety and OSHA codes and regulations, Available in Additionally, the Department of Veteran Affairs guidelines and policies will be adhered to. Duties to include:
5.1. Raise existing Walls two feet in height and provide a peaked cap on top of wall. Existing walls are 24 feet 32 feet in 24 feet, for a total of 80 linear feet. Width of wall is 16 1/2 inches with eight-inch block in the middle surrounded by brick. Install brick ties every 16 to 24 inches as required.
5.2 Brick is to be matched as close as possible by color. Please provide a sample to the COR for verification and approval of color.
5.3. Rental of scaffolding or of a lift is the responsibility of the contractor in accordance with all OSHA guidelines.
5.4. All construction debris shall be removed from the site and is responsibility of the contractor. Laydown area will be established
5.5 Period of Performance: 45 days from issuance of the Notice to Proceed.
6. Other Station Rules and Guidelines. The Contractor will adhere to the following station rules and regulations:
| 6.1. This is a hospital environment. The Contractor and his personnel are expected | appropriately dressed (preferably uniformed) and to conduct themselves professionally. | ||
| 6.2. This is a federal facility as well as a medical center. As such, there is NO tobacco | usage allowed inside any federal building or on campus grounds. Failure to follow | these regulations can result in removal of the worker or Contractor from the facility | and/or a US Magistrate’s ticket and fine. |
6.3. Parking will be in designated lots. Consult with the POC as to allowable parking and material drop-off.
6.4. The Contractor will be responsible for ensuring that all the employees and other personnel visiting the work site have and are using the appropriate Personal Protective Equipment (PPE) that addresses the hazards found at the site. The Contractor will be responsible for the upkeep, issue, and training for the PPE used and maintaining all required documentation.
6.5. Since the incidents of September 11, 2001, the Federal Government has begun to implement new security measures to help protect federal facilities. The Contractor will provide to the POC a list of employees expected to work on this contract.
6.6. The U.S. Department of Veterans Affairs and the U.S. Department of Health and Human Services requires that all Contractor personnel coming on this facility to complete the Veterans Health Administration’s Privacy Policy Training the day of arrival, in 2K-113 Safety’s office in this facility. The Contractor will submit the certificate, to be completed, at the end of the Microsoft Training PowerPoint Presentation for each person assigned to this contract who comes on this facility to work. A company roster certifying course completion may be substituted for individual certificates.

2.2 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.3 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. 2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
