42479IFB26 TWELVE MILE SWAMP CONSERVATION AREA

– WEST AUGUSTINE (SJ59) MULCH MOWING

PART 1 – SCOPE OF WORK

I. LOCATION/ INTRODUCTION

The Twelve Mile Swamp Conservation Area/West Augustine (SJ59) parcel is an irregular shaped parcel consisting of approximately 565 acres (LA # 2009-022-P1) located north of SR 16, east of Interstate 95 and south of the Twelve Mile Swamp Conservation Area in St. Johns County (Figure 1). It is within the Lower St. Johns River Basin in mitigation drainage basin 5 - Six mile and Julington Creeks and within USACE hydrological unit (HUC- 03080103) known as the Lower St Johns.

The Twelve Mile Swamp Conservation Area consists of approximately 21,375 acres and is owned and managed by the St. Johns River Water Management District. This area was purchased using funding from the FDOT for a portion of the mitigation associated with 9B road project segment from I-95 to CR 2209, FDOT FM# 213516-4.

This mitigation serves as partial mitigation for SJRWMD permit 4-031-102025-6 and the USACE permit SAJ-2014- 1931 (SP-AWP). The property consists of both wetlands and uplands and includes several named swamps in the Twelve Mile Conservation Area. This area is the headwaters and directly influences six major tributary systems.

Three of these areas Turnbull, Mill and Sampson Creeks all discharge into the St. Johns River while Moultrie Creek and Red House Branch discharge into the Matanzas River and Stokes Creek discharges into the Tolomato River.

Enhancements to this property will aid in the in the protection of the water quality and overall habitat enhancement for an important area in the Lower St. Johns River Basin. This scope of work is to provide mowing and mulching in areas to help reduce fuel load. Due to the property location on SR 16 and proximity to Interstate 95 burning the site is difficult, but necessary to maintain a low understory to help prevent catastrophic wildfire.

II. OBJECTIVES

The objective of this scope of work is to mow and mulch approximately 180 acres within mesic flatwoods ecosystems to reduce fuel loads and support future prescribed-fire activities. The project area consists of trees and shrubs requiring mowing and mulching to lower vegetation height and reduce wildfire risk to the surrounding areas.

Work shall include the entirety of the hatched areas shown in Figure 2 and 3, including all understory vegetation up to four inches in diameter at breast height (DBH).

III. PROJECT DESCRIPTION

Work shall include mowing and mulching within the designated treatment areas. Access to the project site will be via SR 16 gate. The staging site for fueling and equipment maintenance shall be in a designated location agreed to by both Project Manager and Contractor. Contractor shall minimize rutting within the project area. If site conditions result in rutting, the Contractor shall immediately notify the Project Manager, and work may be suspended until conditions improve. Any rutting deemed excessive by the Project Manager shall be repaired or mitigated by the Contractor at no additional cost to the District. Project boundaries will be identified in the field using Avenza maps.

Contractor Responsibilities include:

• Contractor shall notify District at least one (1) week prior to entering the project site.

• Contractor shall provide all labor, equipment, fuel, transportation and other resources necessary to complete the Work.

• Contractor shall provide sufficient equipment and personnel to maintain production rates necessary to complete the Work within the specified timeframe.

• Contractor shall repair or replace, at its cost, any damage to fences, gates, or other improvements resulting from its operations. Any repairs necessary after completion of the Work shall remain the Contractor’s responsibility.

Rev. 7.25.26 42479IFB26 | Page 4 of 47

• Contractor shall ensure that all gates are closed and locked at the end of each workday. When a gate is left open during operations, any combination lock provided by the District shall be secured so that the combination is not visible.

• Mobilization and demobilization to and from the project site.

• Perform joint inspection of completed Work with District’s Project Manager. Verification of completed Work shall be based on the Project Manager’s on-site observations and inspection.

• Maintain all equipment in good working order throughout the duration of the Work.

• The District reserves the right to request copies of equipment maintenance records at any time.

• Contractor shall ensure that work area is kept clear of rubbish. Discharge of oil, diesel fuel, hydraulic fluid, or other contaminants is prohibited within the project area.

• In the event of equipment failure, the Contractor shall repair and return the equipment to service within seventy-two (72) hours of the breakdown or provide replacement equipment of equal or greater capability at no additional cost to the District. If the Contractor fails to do so, the District reserves the right to terminate the Contractor’s operations and award the remaining Work to the next lowest responsive and responsible Respondent.

• Provide the Project Manager with at least twenty-four (24) hours’ notice prior to requesting inspection of completed Work.

• Repair or mitigate, at the Contractor’s expense, any rutting deemed excessive by the Project Manager.

• If equipment repairs are expected to exceed seventy-two (72) hours, the equipment shall be removed from the site and replaced with suitable equipment. The Contractor shall notify the Project Manager before removing any equipment that will be out of service for seventy-two (72) hours or longer.

• Exercise due care to prevent the initiation or spread of fires during mowing and mulching operations. The Contractor shall be responsible for all damages resulting from fires caused by its operations or personnel.

• Prevent the introduction and spread of non-native vegetation by inspecting and cleaning equipment in accordance with the procedures outlined in the U.S. Department of the Interior, Bureau of Reclamation, Technical Memorandum No. 86-68220-07-05, Inspection and Cleaning Manual for Equipment and Vehicles to Prevent the Spread of Invasive Species (May 2010).

• Provide a post-treatment Avenza map to demonstrate the acreage mowed and mulched.

• Examine the Agreement documents and inspect the project site prior to commencing Work to become fully familiar with site conditions, access limitations, and all requirements necessary to complete the Work.

Contractor is solely responsible for being fully informed of the conditions under which the Work is to be performed in relation to existing conditions. Contractor is responsible for carefully examining the general area of the Work, the requirements of the Request and other contract documents related to the Work, the time in which the Work must be completed, and any other details of the Work. Contractor must satisfy itself from its own personal knowledge and experience or professional advice as to the character of the Work, the conditions and materials to be encountered, the character, quality, and quantities of the Work, and any other conditions affecting the Work, including surrounding land.

Failure to satisfy the obligations of this paragraph will not relieve a Contractor from its obligation to furnish all material, equipment, and labor necessary to perform the Agreement and to complete the Work for the consideration set forth in the agreement. Any such failure will not be sufficient cause to submit a claim for additional compensation.

District Responsibilities include:

• District’s Project Manager will determine routes for ingress and egress to the property. Access is shown on Figure 2.

• Describe the nature of the Work and provide maps delineating the work area.

• Coordinate scheduling and site access with the Contractor.

2.14 AWARDING THE AGREEMENT

(a) All Respondents will be notified of the District's intent to award or decision to award the Agreement. For the purpose of filing a protest under §120.57(3), Fla. Stat., the time period will commence as provided in the Section titled PROTEST PROCEDURES, herein.

(b) The Agreement will be awarded to the lowest responsive, responsible Respondent, being the Respondent with the lowest Total Bid as reflected on the Bid Form who demonstrates, in accordance with the requirements of the submittal documents, a verifiable history of the skill, ability, integrity, and reliability necessary for the faithful performance of the Agreement (the “Successful Respondent”). The Agreement may be modified based on the District’s acceptance of any alternatives listed in the submittal that the District deems in its best interest.

(c) If two or more submittals are equal in all respects, the Agreement will be awarded as follows: (1) to a Respondent that certifies compliance with §287.087, Fla. Stat., via the Drug-Free Workplace Form; (2) to a Respondent university in the State University System pursuant to §373.63, Fla. Stat.; (3) to a Respondent whose submittal contains commodities manufactured, grown, or produced within the state of Florida pursuant to §287.082, Fla.

Stat.; or (4) by lot.

(d) The District reserves the right to award the Agreement to the next lowest available Respondent in the event the successful Respondent fails to enter into the Agreement, or the Agreement with said Respondent is terminated within ninety (90) days of the effective date.

(e) Section 286.0113, Fla. Stat., exempts from being open to the public, any portion of a meeting at which: (1) a negotiation with a Respondent is conducted pursuant to a competitive solicitation; (2) a Respondent makes an oral presentation as part of a competitive solicitation; (3) a Respondent answers questions as part of a competitive solicitation; or (4) negotiation strategies are discussed. Also, recordings of, and any records presented at, the exempt meeting are exempt from §119.07(1) and §24(a), Art. I of the State Constitution (Public Records) until such time as the District provides notice of an intended decision or until thirty (30) days after opening the submittals or final replies, whichever occurs earlier. A complete recording shall be made of any portion of an exempt meeting. No portion of the exempt meeting may be held off the record.

(f) Pursuant to §286.0113 Fla. Stat., if the District rejects all submittals and concurrently provides notice of its intent to reissue the competitive solicitation, any recordings or records presented at any exempt meeting relating to the solicitation shall remain exempt from §119.07(1) and §24(a), Art. I of the State Constitution (Public Records) until such time as the District provides notice of an intended decision concerning the reissued competitive solicitation or until the District withdraws the reissued competitive solicitation. A recording and any records presented at an exempt meeting are not exempt for longer than 12 months after the initial District notice rejecting all submittals.

(g) Upon award, Respondent becomes Contractor.

2.15 EXAMINATION OF CONTRACT DOCUMENTS

Respondent is solely responsible for being fully informed of the conditions under which the Work is to be performed in relation to existing conditions. Respondent is responsible for carefully examining the general area of the Work, the requirements of the drawings and other Contract Documents (defined in the Agreement) related to the Work, the time in which the Work shall be completed, and any other details of the Work. Respondent shall satisfy itself from its own personal knowledge and experience or professional advice as to the character of the Work, the conditions and materials to be encountered, the character, quality, and quantities of the Work, and any other conditions affecting the Work, including surrounding land.

Failure to satisfy the obligations of this paragraph will not relieve a Successful Respondent of its obligation to furnish all material, equipment, and labor necessary to perform the Agreement and to complete the Work for the consideration set forth in its submittal. Any such failure will not be sufficient cause to submit a claim for additional compensation.

No verbal agreement or conversation with any District officer, agent or employee, either before or after the execution of the Agreement, will affect or modify any of its terms.

2.16 EXECUTION OF AGREEMENT

Failure to timely execute the Agreement and proceed with performance as required may be deemed a breach and may result in rejection of the submittal, cancellation of award, and any other remedies available to the District under the solicitation, the Agreement, or applicable law.

(c) Unless all submittals are rejected, the Successful Respondent shall execute and return the Agreement to the District within ten (10) business days of receipt along with each of the following:

(d) The District will not execute the Agreement until the above documents have been executed and delivered to the District. The Agreement will not be binding until executed by the District. A copy of the fully executed Agreement will be sent via e-mail to the Successful Respondent. The District reserves the right to cancel award of the Agreement without liability at any time before the Agreement has been fully executed by all parties and delivered to the Successful Respondent.

(e) Failure upon the part of the Successful Respondent to execute the Agreement or timely submit the required evidence of insurance coverage, or any other matter required by the Agreement, will be just cause, if the District so elects, for the recommended award to be annulled.
