SUBJECT: Justification for Exception to the Fair Opportunity Process (JEFOP) for New Task Order entitled "Lift Recovery for AFC-Enabled High-Lift System" with Boeing on Contract NNL16AA04B, Tota) Estimated Cost $311,909.

In accordance with FAR 16.505, the following information is provided to support this justification:

L Recommendadon

NASA Langley Research Center (LaRC) intends to initiate a new task order with Boeing under the Basic and Applied Aerospace Research and Technology (BAARl) contract. The purpose of this new task order is to use computational fluid dynamics (CFO) based analysis to close the lift recovery gap between the refined conventional high..Jift configuration and the active flow control (AFC) enabled simplified high-Jift configuration, while keeping the AFC power requirements (e.g., mass flow and pressure, electrical, etc.) within the aircraft's system capability.

This task order must be issued on a sole-source basis to Boeing because Boeing is the only source capable of performing the required effort based on its proprietary knowledge and experience with modem commercial transport's high·lift system and AFC. This new proposed task order builds upon past Boeing efforts as described below.

Purehase Request (PR) 4200586471 has been generated to provide funding in the amount of $311,909 for this task order. LaRC plans to utilize the BAART contract, which is a multiple award, indefinite deJivery/indefmite quantity (IDJQ), cost plus fixed fee (CPFF) contract.

The BAART contract period of performance is November 1, 2015 through October 31, 2020.

All work under this task order will .be completed by August 31. 2017.

Il. Bacground

The NASA Advanced Air Transport Technology (AA TI) Project is seeking to demonstrate the potential benefits of reducing the cruise drag associated with a modem high-lift system without sacrificing the aerodynamic and acoustic perfonnances for takeoff and landing (i.e., high-lift configurations). One promising approach is to use active flow control (AFC) to provide the required high-lift performance while reducing the associated external drag.

This task order builds upon work completed under SMAAART Task Order NNL14AB98T entitled "Refined AFC-Enabled High-Lift System Integration Study', where a systems benefit study was perfonned on a refmed AFC-enabled simplified high-lift systems that was based on an updated conventional high-lift system for the NASA Common RcSC&J'Ch Model (CRM).

The final report of the system study indicated up to 2.25% fuel bum reduction is possible if an AFC-enabled simplified high lift system (i.e~, simply hinged flaps inboard and outboard) could provide the necessary lift recovery at the approach angle of attack. The AFC-related performance gains primarily due to the 3.3-count lower excrescenc;e drag reduction in getting rid of 1he cxtcmal fairings for the Fowler flap mechanism.

For this task order, the contractor is tasked to explore design space using innovative flow control concept(s) that could provide the necessary lift recovery for a simple hinge flap high-lift system (as comparing to a conventional high lift system).

This is to be accomplished through reducing the required AFC mass flow by an order of magnitude, as reported in the fmal report of the system study (SMAAART Contract Task Order NNLl 4AB981). This task will contribute to the planned AA IT sponsored test on a CRM-based high-lift model at the NASA LaR.C 14-by-22-Foot Subsonic Wind Tunnel (14x22) in FY2018.

Ill. Natne and/or Description of Required Suppliet/Services

This proposed new task order includes work to explore new design space to close the lift recovery gap identified in the prior system study (i.e., SMAAART Task Order NNL 14AB98T). The Statement of Worlc (SOW) requirements include using computational fluid dynamics (CFD) based malysis to close the lift recovery gap between the refined conventional high-lift configuration and the AFC-enabled sbnplified high-lift configuration, while keeping the AFC power requirements (e.g •• ~ flow and pressure, electrical, etc.)

within the aircraft's system capability. In order to meet the SOW requirements, extensive expertise in multiple aspects of the aircraft system integration such as aircraft high-lift performance, airframe design, flight dynamics, and active flow control (AFC) are required, which only Boeing possesses.

In order to meet the objective of contributing to the planned AA TT sponsored test at the NASA LaRC l 4-by-22-Foot Subsonic Wind Tunnel. this proposed new task order needs to be completed by the end of December 2016. The period of performance for this proposed task.

order is anticipated to be from award to the end of December 2016.

The estimated value of this proposed new task order is $311,909. This new task order fits within the 5':0J>C of the BAART contract Performance Work Statement under Technical Track A- Sub-tracks: A.2.1 "Configuration Aerodynamics", A.2.2 "ComputationaJ Modeling and Simulation", and A.2.3 "Flow Physics and Control". Further, this proposed new task order falls Within the BAART contract perfonnance period and within the maximum contract value.

IV. Identification oftbeEsception to Fair Opportunity and Supportina Rationale

FAR 16.SOS(b )(1 )(i) requires the Contracting Officer provide each awardee under a multiple award contract, a fair opporbJnity to be considered for each order exceeding $3,000 unless a statutory exception applies. Specifically, the exception that precludes the fair opportunity process for this acquisition is FAR 16.SOS(b )(2)(i)(B), which states that ''Only one awardee is capable of providing the services or supplies required at the level of quality required because the service or supplies ordered are unique or highly specialized".

The work in this proposed new task order builds upon extensive past efforts Boeing on their AFC-enable high-lift concepts and system studies. Specifically, the AFC-enable high-lift concepts and system studies developed by Boeing under the prior, competitively awarded SMAAART task order NNL13AB65T, and the sole source award to Boeing on SMAAART task order NNL14AB98T, were resulted from the extensive market rescan:h activity by the NASA Fixed Wing Project

Under this proposed new task order for the AA IT Project, it is advantageous for the Government to contract with Boeing because of its proprietary knowledge and experience with modem commercial transport's high-lift system and AFC. This proposed new task order, which builds upon the works that Boeing has already accomplished, is in the best interest of the Government because LaRC has invested money, time, and effort in task orders NNL13AB65Ttitled "AFC-Enabled Simplified High-Lift System Integration Study" and NNL14AB98T titled "Refined AFC-Enabled High-Lift System Integration Study" with Boeing. One of the SOW tasks (3.1 Perform CFO Analysis to Close AFC Lift Recovery Gap) in this proposed new task order also requires proprietary knowledge end information of existing high-lift system oflargc commercial transport aircraft. Boeing is the only manufacturer of large commercial transport aircraft in this country. As the manufacturer.

Boeing is the only so~ of the proprietary infonnation needed for this specialized work of this SOW.

Additionally. it is not economically feasible to award this task order to a new/different contractor, because award to any source other than Boeing would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Boeing's experience and performance under the prior two awards make it uniquely qualified for this highly specialized proposed new task order.

V. Determination by the Contractin1 Officer That The Anticipated Cost to the Government Will Be Fair and Reasonable

The CPFF amowrt for this acquisition will be determined fair and reasonable by the Contracting Officer prior to award of this proposed new task order. Actions anticipated to ensure reasonableness will be accomplished using the procedures and criteria contained in the Federal Acquisition Regulation (FAR), NASA FAR Supplement (NFS), and other regulatory documents as applicable. Detailed documentation and justification of reasonableness will be disclosed in the Price Negotiation Memorandum (PNM) which will be prepared using the evaluation of the Boeing quoted pricing, compared to the Independent Goverom.ent Estimate (IGE), and the pricing of previous similar efforts. Information other than certified.cost and pricing data will be obtained and used in determining a fair and reasonable cost.

VI. Other Facts S11pportina tile Justification

None.

VIl. Actions the Agency May Take to Remove or Overcome Any Barriers To hcreuing Fair 0Rportunity Before Any Subsegoent Acguisition For the SuPJ>lies or Services

LaRC may have future requirements that can ottlY be met by Boeing. However, the Contracting Officer will continue to scrutinize all SOWs received to ensure fair opportunity is appropriately given. La.RC typically looks for proactive steps that can be taken to eliminate barriers to competition for future requirements. Additionally, LaR.C has no known future requirements for this technology at this time and lacks the ability to incentivize the other BAA.RT contractors to invest the substantial sums that would be required to establish an alternate source for this service.
