1 Attachment 11 - Proof of Sales

How would you like Bidders to submit this Attachment if we need additional rows? Is it permissible to add rows to the document to include additional items?

Please see IFB 23361 (revised 2/27/2025), Attachment 11- Proof of Sales, which now includes the following additional instructions:

“Bidder may complete and submit additional copies of Attachment 11-Proof of Sales in its Bid submission if Bidder requires additional rows.

Bidder shall name the files to indicate the number of additional copies included (example:

Attachment 11 – Required Proof of Sales Summary 1 of 3;

Attachment 11 – Required Proof of Sales Summary 2 of 3;

Attachment 11 – Required Proof of Sales Summary 3 of 3. etc.)”

2 IFB Main Document Section 4.10 - Manufacturer's Certificate

How should Manufacturers complete Attachment 10 - Manufacturer's Certificate if they are submitting on their own behalf?

Please see IFB # 23361 (revised 2/27/2025), Section 2 – Bidder Qualifications, subsection 1, which now reads, in part, as follows:

“A Manufacturer submitting a Bid that includes ONLY their own Product Line(s) will not be required to submit an Attachment 10 – Manufacturer’s Certificate.”

3 IFB Main Document Section 6.22.4 - Contract Goals

Will OGS reconsider the MWBE Participation goals of the contract as the State's Certified Directory only lists one company within the Firefighting PPE category?

In addition to the product lines we plan to bid, we would like to propose submitting our company’s retail price list with a % discount off of all brands that we stock in our catalog.

No. OGS declines to accept the proposed deviation to the scope of IFB # 23361 (revised 2/27/2025).

Please be advised that IFB # 23361(revised 2/27/2025), Section 2 – Scope, subsection (A), provides in part that:

“Consideration will only be given to those Protective Outerwear Products with demonstrated protective value that fall within any of the following nine (9) Product categories (“Lots”):

LOTS DESCRIPTION

Lot 1 EMS/Search & Rescue Clothing Lot 2 Firefighting Boots Lot 3 Firefighting Proximity Clothing Lot 4 Firefighting Turnout Gear Lot 5 Gloves (Firefighting/Rescue) Lot 6 Helmets (Firefighting/Rescue) Lot 7 Safety Shoes (various) Lot 8 Specialty Boots (EMS/Rescue) Lot 9 Wildland Clothing

IFB # 23361 (revised 2/27/2025), Section 2 – Scope, provides further that “NYS’s determination of acceptable Product Lines shall be final. NYS reserves the right to eliminate Products in a price list bid that (1) are not considered within the scope of this award, or (2) are available from Preferred Sources (See Section 6.28 Preferred Source Products). Contract awards shall be made by Product Line within each Lot to the Responsive and Responsible Bidders with the lowest Net Prices.”

Please refer generally to the rest of IFB #23361 IFB # 23361 (revised 2/27/2025), Section 2 – Scope, for further information on the scope of the Products that may be bid on this Invitation for Bids.

6 IFB Main Document Section 6.40 – Environmental Sustainability and NYS Executive Order Number 22

How is a potential Bidder to know if a product meets GreenNY specifications or not? We need this information to populate the GreenNY columns in Attachments 1 & 8.

Please see IFB # 23361 (revised 2/27/2025), Section 6.40 Environmental Sustainability and NYS Executive Order Number 22, which provides the following links and resources to Bidders:

Resources are available on the OGS website at https://ogs.ny.gov/greenny-purchasing-requirements-and-tools for procurement managers and Contractors to learn about which Contracts provide environmentally preferable Products.

A list of currently approved specifications is located on the OGS website at https://ogs.ny.gov/greenny/approved-greenny-specifications.

Our company creates firefighting gear customized to customers’ standards. There are dozens of options creating hundreds of possible combinations. If we list every possible SKU, part number or product code the resulting pricelist will be hundreds of rows long. Likewise, the number of available options will lead to sales reports hundreds of rows long. Is this level of detail necessary?

Yes. Pursuant to IFB # 23361 (revised 2/27/2025), Section 4.4 – Content, Subsection A, “all documents must be completed in accordance with the instructions for the individual document.”

IFB # 23361 (revised 2/27/2025), Attachment 1 – Pricing, Instructions Tab – Instructions, provides:

For each Product Line Bidder is bidding, please add the complete subset of the Product Line including all products that fit within the scope of the Lot bid on the following Product Line tabs.

For each Product that can be customized, Bidders must specify the Model Number in the "Model Number (For Products that are customized)" column.

Enter all Part/Stock Numbers for all options that may be used to build each Product.

IFB # 23361 (revised 2/27/2025), Attachment 8 – Report of Contract Usage Instructions Tab – Instructions, provides in part:

“A Contractor must complete all non-shaded cells on the ContractUsage tab,” which includes cells for “Contractor's Part/Stock Number,” and “Model Number of Product (For Customized Products)” for which Bidders must provide the “Product's Model Number.

This number must match Model Number found on the approved Pricelist.

This must be included for all Part Numbers used to make up the customized product that was purchased.”
