About this file

This is a Qualifications Statement form (EJCDC C-451) submitted by contractors to the City of Buda, Texas for the Garrison Park Construction project. The document serves as a standardized template for contractors to provide comprehensive information about their firm's qualifications, experience, and capacity to undertake the park construction project, which includes site grading, parking lots, utilities, restroom facilities, trails, boat launch, landscaping, and related amenities. The form requires contractors to submit detailed information organized into multiple sections and schedules, including current and previous project experience, major equipment availability, licensing and bonding information, and financial details. Contractors must list all uncompleted projects currently under contract (Schedule A) and all projects completed within the previous five years (Schedule B), along with owner contact information, design engineer details, contract dates, work types, project status, and costs.

The qualifications statement requires contractors to disclose organizational structure, bonding company information with aggregate and available bonding capacity, financial institution details, and audited balance sheets for the last three fiscal years upon request. Contractors must certify whether the firm or any of its officers, partners, or joint venture participants have failed to complete previous construction contracts or have any outstanding judgments, claims, disputes, or litigation. Additionally, the document includes a Vendor Compliance to State Law section (Section 00 45 46) addressing Texas House Bill 620 requirements for non-resident bidders. Non-resident contractors must declare their home state and provide the percentage by which they are required to underbid resident contractors, while Texas resident bidders must identify their principal place of business within the state. All bidders must sign and return the completed form with their proposal.

VENDOR COMPLIANCE TO STATE LAW

00 45 46 - 1

SECTION 00 45 46

VENDOR COMPLIANCE TO STATE LAW

The 1985 Session of the Texas Legislature passed House Bill 620 relative to the award of contracts to non-resident bidders. This law provides that, in order to be awarded a contract as low bidder, non-resident bidders (out of state contractors whose corporate officers or principal place of business are outside of the state of Texas) bid projects for construction, improvements, supplies or services in Texas at an amount lower than the lowest Texas resident by the same amount that a Texas resident bidder would be required to underbid a non-resident bidder in order to obtain a comparable contract in the state in which the non-resident's principal place of business is located. The appropriate blanks in Section A must be filled out by all out-of-state or non-resident bidders in order for your bid to meet specifications. The failure of out-of-state or non-resident contractors to do so will automatically disqualify that bidder. Resident bidders must check the line in Section B.

A. Non-resident bidder in _____________________ (give state), our principal place of business, are required to be ____________ percent lower than resident bidders by state law.

Non-resident vendors in ____________________ (give state), our principal place of business, are not required to underbid resident bidders.

B. Our principal place of business or corporate offices are in the State of Texas:
