About this file

This is an Offeror Bond/Bid Bond Form for the Atlanta Independent School System, a Georgia-based public school district. The form establishes the bonding requirements for offerors submitting proposals in response to the Demolition Bundle for West Atlanta, Peterson, Brewer, Anderson Park, and Pryor Street project. The bond serves as a guarantee that the selected offeror will execute a written contract, secure all required performance and payment bonds acceptable to the school system, and comply with all terms, conditions, and obligations outlined in the request for proposals and resulting contract. The bond obligation remains in full force for a minimum of 90 days from the offer date, or longer as required by law or mutual agreement between the owner and offeror.

The bond amount is to be determined and filled in by the surety and offeror prior to submission. The surety's maximum liability under the bond is limited to the stated penal sum amount. The form requires certification by an attorney-in-fact for the surety, notarization, and attachment of a certified copy of the power of attorney and all-purpose acknowledgment. Additionally, the court may award reasonable attorneys' fees and costs to the prevailing party in any suit brought on the bond, potentially exceeding the penal sum. The bond form cannot be altered, modified, or changed from its original format.
