About this file
This document is a Justification and Approval for Other Than Full and Open Competition for the procurement of an electroencephalography (EEG) system. The Naval Medical Research Command (NMRC) is seeking to award a firm fixed price contract to Brain Vision, LLC for an EEG system to support a study on neural correlates of spatial disorientation being conducted by the Naval Medical Research Unit - Dayton (NAMRU-D). The objective of the study is to examine potential neural markers of incorrect control inputs and vection, with the desired outcome being a knowledge product such as a conference abstract or peer-reviewed publication. The statutory exception permitting other than full and open competition is FAR 6.302-1, Sole Source Acquisitions. The contract is expected to be awarded in July 2024 for the period of performance from October 2023 to September 2024.

JUSTIFICATION AND APPROVAL
OTHER THAN FULL AND OPEN COMPETITION
1. Identification of the agency and the contracting activity.
This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet Navy Expeditionary Medical Research requirements.
2. Nature and/or description of the action.
Naval Medical Research Unit – Dayton (NAMRU-D) investgators require an electroencephalography (EEG) system to examine neural correlates of spatial disorientation. The
Government intends on awarding a Firm Fixed Price contract. The proposed source is Brain
Vision, LLC, 1204 Village Market Place #300, Morrisville, NC, 27560.
3. Description of Supplies or Services:
The Naval Medical Research Unit – Dayton (NAMRU-D) is conducting a funded study that includes EEG data collection. This study requires an EEG system to record neural activity during the performance of various cognitive and flight-related tasks. Funding has been provided to
NAMRU-D from DHA.
The project discussed is titled: Development of a Neural Marker of Spatial Orientation – Period of performance: Oct 2023 – Sept 2024.
The objective is to examine potential neural correlates of incorrect control inputs and the experience of vection. The desired outcome is a knowledge product describing the results of the study, which may take the form of conference abstract(s) or peer-reviewed publication(s).
4. Identification of the statutory exceptions permitting other than full and open competition.
The statutory exception permitting other than full and open competition for this acquisition is 10
U.S.C. 2304(c)(1) and FAR 6.302-1 sole source (including brand name) acquisitions or FAR
13.106-1(b)(1) soliciting from a single source.
10 U.S.C. 2304(c)(1), Only one responsible source.
FAR 13.106-1(b)(1) <$150K
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
There is only one source, LiveAmp EEG system from Brain Vision, LLC, with the only EEG system that meets the motion-stable, portability, low-profile, active wet electrodes, and 32-channel minimum requirements and also integrates with current EEG equipment and software at
NAMRU-D.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Market research was performed, the results of which are in paragraph 8. This requirement will be posted to the government point of entry in accordance with FAR 5.202.
7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer shall determine whether the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from Brain Vision LLC’s commercial price list and will be determined fair and reasonable.
8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.
Contacted knowledgeable individuals in government and industry regarding market capabilities to meet the requirement.
An internet search was used to identify portable, motion-stable EEG systems. General product information from several EEG manufacturers that include Brain Vision, Biosemi, Electrical
Geodesics, Inc., NeuroScan, Cadwell Laboratories, Bitbrain, and g.tec is available on their respective websites. LiveAmp EEG system from Brain Vision, LLC is the only EEG system that also meets the motion-stable, portability, low-profile, active wet electrodes, and 32-channel minimum requirements and integrates with current EEG equipment and software at NAMRU-D.
Therefore, our only option is the Brain Vision LiveAmp system.
9. Other facts supporting the use of other than full and open competition.
N/A
10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.

2. No other quotes were obtained because no other vendor has a product that meets all of othe requirements listed above.
11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Future requirements will be synopsized in accordance with FAR 5.203.
